Thanks for checking into this. I've been kayaking for a couple of years now and I've been surprised at how well the river
banks are protected by the buffer systems. This was probably the first time I have seen. a streambank cut down this
much. The guys I go with know where I work so that all ask about water quality especially when we see something
suspicious. Sometimes I have to explain about the outfalls we see as we go downstream but for the most part things
look pretty good at the rivers.

Hi Kent,
conducted an inspection of the Hanson Aggregates -Rocky Mount Quarry on 8/10/10. 1 checked for compliance with
the Buffer Authorization issued by DWQ on November 17, 2009. The buffer impacts did not exceed the authorized
impacts. The project construction is not yet complete. They will be installing the conveyor over the river and this will
involve the installation of crane pads.
Attached is the Buffer Authorization for the project. If you would like to see the plans, I can send those along. I've also
attached a drawing of the mine plans, but it is not too easy to read.

Hey Kent,
I can't remember if I responded to your concern.... Recently, we reviewed/commented on a DLR mine expansion permit.
At that time we discovered a 401 Water Quality Certification was issued by the wetlands units for this crossing. We had
several concerns /comments regarding the proposed activity. (They are building a conveyor across the river to move
product from a new pit to an existing processing area)...
We are following up with a site inspection (e.g. mining stormwater permit compliance review, 401 Certification and
buffer rule compliance.)

Danny,
We kayaked down the Tar river from Battle park in Rocky Mount and the Rocky Mount WWTP outfall (looked OK). We
did notice that an area of the river bank had been stripped on both sides of the river near where the quarry is. Someone
had heard a rumor that the quarry was expanding and they were clearing for their construction/destruction. All the
trees are gone on one side and most from the other. Of course, maybe there never were any trees on that side.
Have you heard anything about it.

6i. Comments: The help file indicates that the only temporary buffer impacts are in the case of "temporary roads" or
Page 6 of 12
"temporary erosion control devices". Please note that this project is a linear project in nature and requires temporary removal
of the riparian areas for the construction of the enclosed aerial conveyor belt. The construction activities will require 3 large
cranes to be put in place on each side of the Tar River in order to build the conveyor belt with no impacts to the jurisdictional
waters. All areas identified as "temporary" will be re -vegetated as required by the Division of Water Quality.
Additionally, please note Impact B2 is an exempt activity per the IVCAC 2B .0259

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
This project started off as potentially a "barge" or "floating dock" that would cross the Tar River, this system would be
necessary in order to move material from the existing mine site (east side of Tar River) to the new mine site (west side of
the Tar River). After working with the USACE, the applicants proposed an idea that would avoid impacts to jurisdictional
waters. The current proposed activity is an enclosed aerial conveyor crossing, which would effectively move materials
from the existing mine site to the new mine site.
With regards to the minimization of impacts associated with the riparian buffers, in order to construct the enclosed aerial
conveyor system an extensive construction corridor is necessary. The construction activity requires 3 cranes to be set up
on each side of the Tar River. The cranes will be used to construct the enclosed aerial conveyor crossing in addition to
the permanent towers needed (RP20 & RP 19), which are a part of the enclosed aerial crossing system. All structures in
this area require materials to stabilize and must render a minimum of 3,000 Ibs/PSF soil bearing density.
The post construction the proposed permanent stone within the buffers areas are needed because of the following
reason; to protect and provide maintenance for the proposed conveyor system and structures associated with the
plant on both sides of the Tar River. As seen on the overall site plan, the berm areas to the north and south on the
east side of the Tar River will be cut down and have a final elevation of 74.5. The buffer area on the east side of
the river will have just an island remaining when the project is finalized, this island will have a final elevation of
89.0. Protection of the island and proposed conveyor system is mandatory to withstand potential flooding and
erosion. Furthermore, the buffer area on the west side of the river is in a low lying area and the proposed conveyor
system and structures associated with the plant will need to be protected from potential flooding and erosion.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques.
Silt fencing will be placed along the limits of disturbance and 25' off of the toe of slope. All required Sedimentation &
Erosion Control BMP's will be in place according to their approved Sedimentation & Erosion Control Plan.

Beazer Materials & Services, Inc. changed its name to Beazer East, Inc. on March 26, 1990. Beazer
East is the parent company of Hanson.
Hanson is the successor by name change and subsequent merger to Nello L. Teer Company.
Specifically, the name of Nello L. Tear Company was changed on March 20, 1995 to Benchmark
Carolina Aggregates, Inc. In turn Benchmark Carolina changed its name to Hanson Aggregates
Carolina, Inc. on January 25, 1999. Hanson Aggregates Carolina was merged in Hanson
Aggregates Southeast, Inc. on December 28, 2001. Finally, Hanson Aggregates Southeast, Inc. was
converted to an LLC on January 1, 2009.

Enclosed is a Department of the Army permit to install an enclosed aerial conveyor
crossing over the Tar River, in Rocky Mount, Edgecombe County, North Carolina. The
Corps is issuing this permit in response to your written request of October 5, 2006 and the
ensuing administrative record.
Any deviation in the authorized work will likely require modification of this permit. If
a charge in the authorized work is necessary, you should promptly submit revised plans to
the Corps showing the proposed changes. You may not undertake the proposed changes
until the Corps notifies you that your permit has been modified.
Carefully read your permit. The general and special conditions are important. Your
failure to comply with these conditions could result in a violation of Federal law. Ceztaiu

You are authorized to perform work in the Accordance with the terms and conditions specified below.
Project Description: To expand their existing rock quarry to a site that is across the Tar River
from their existing site. The applicant plans to build a conveyor system to move material
from the new quarry site to the existing quarry site for processing. The conveyor would be
completely enclosed above the river for 120 feet from the center line, and would include a
walkway for maintenance purposes. it would cross the Tar River, downstream from its point
of navigability, northeast of Rocky Mount, Edgecombe County, North Carolina.
Project Location: The site is located south of CR 97 and CR 1250, cast along the Tar River, in
Rocky Mount, Edgecombe County, North Carolina.
Permit Conditions:
General Conditions,
1. The time Limit for completing the work authorized ends on_ December 31, 2011 if you find that
you occd more time to complete the authorized activity, submit your request for a time extension to this
office for consideration at least one month before the above date is reached.
I You most nmint do the activity ,authorized by this permit in good condition and in conformance with
the terms and conditions of this permit. You are not relieved of this requirement if you abandon the
permitted activity, although you may make a good faith transfer to a third party in compliance with
General Conditions 4 below. Should you wish to cease to maintain the authorized activity or should you
desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this
office, which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accompli.ahing the
activity authorized by this permit, you must immediately notify this office of what you have found. We
will initiate the Federal and state coordination required to determine if the remains .Tarrant a recovery
effort or lithe site eligible for lifting in the National Re-gister of Historic Places.

General Conn itions
Work Llmits
a) All work authorized by this permit must be performed in ,strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be
approved by the US ,Army Corps of Engineers (USACE) prior to implementation.
b) Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land -clearing activities shult take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit
clots not authorize temporary placement or double handling of excavuted or fill material
within waters or wetlands outside the permitted area. This prohibition applies to all
borrow and fill activities connected with this project.
c) Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of
this project, in such a rttanner as to impair normal flow` and circulation patterns within
waters or wetlands or to reduce the r6cb of waters or wetlands.
Rulntcd Laws
d) if the worth Carolina Division of Water Qttality has issued a conditioned Water Quality
Certification for your project, the conditions of that certification are hereby incorporated
as special conditions of this permit. For your convenience, a copy of the certification is
attached if it contains such conditions.
e) All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants. hydraulic fluids, or other
toxicmaterials. In the event of a spill of pulmleum products or any other hazardous
waste, the permittee shall immediately report it to the N.C. Division of Water Quality at
(919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act will be followed_
Project Maintenance
f) The permittee Shall advise the Corps ip writing upon complt 6011 of the work authorized
by this permit.
g) Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland ;otvice and will be clean and free of any pollutants

except in trace quantities. Metal products, organic materials (including debris from lard
clearing activities), or unsightly debris will not be used.
h) The permittee shall require its contractors and/or agents to comply with the terms and
eondi6ons of this permit in the construction and maintenance of this project, and shall
provide each of its contractor and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including
all conditions, shall be available at the project site during construction and maintenance
of this proicct
i) The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
moveTmnt of earthen fill. And the immediate stabilization of all disturbed areal.
Additionally, the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter
1.13A Article 4).
j) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United States and in such time
and spanner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its prejrojuct condition.
Enforcement
k) Violations of Horse conditions or violations of Section 404 of the Clean Water Act of Section
10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the petmittee's discovery of the violation.
Section 10
1) The permittm upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United Stotec and in such time
and manner as the Secretary of the Army or his authorized representative may direct,
restore the waterway to its fbmx er conditions. If the permittee fails to comply with this
direction, the Secretary or his represettative may restore the waterway, by contract or
otberwise, and recover the: cost from the perrnittee.
rn) The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made
by the permitt= to prevent the full and free use by the public of all navigable waters at or
adjacent to the authorized work for reason other than safety.
n) The permittee understands and agrees that, if future operations by the United States
require the mrooval, relocation, or other alterEtiorn, of tho structure or work herein
authorized, or if, in the opinion of the Secretary of the Army or his authorized
representative, said structure or work ;hall cause unreasonable: obstruction to the free
navigation of the navigable waters, the permittee will be required, upon due notice from
the U.S. Army Corps of Engineers, to remove, relocate. or alter the structural work or

obstructions caused thereby. without Gxpensc to the United States. No claim shall be
rnade against the United States on account of any such removal, relocation, or alteration.
The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data
Unit N CS261. 1315 E West HWY- RM 7316. Silver Sprin t, MD 20910-3282 at le ut
two weeks prior to beginning work and upon completion of work.
o) The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through rcgnlations or otherwise, on authorized
facilities. For further information, the permittee should contact the U.S. Coast C`ruard
Marine Safety Office at (910) 772-2191.
Special Permit Conditions
a) The conveyor will be completely enclosed over the river to prevent any danger to boaters.
and fill material entering in the river.
b) The entire conveyor project will not impact any other Waters of the US or Special
Aquatic Sites, including wetlands. This includes fill tesultina from material falling from
the conveyor.
c) The portion of the convevor over the river will be well maintained during use, and
removed &q soon as it is no longer in usc.

Phase IV of Stage (1)
1) Begin moving dirt from pit area and place in stockpile area 1A (See plan sheet). Also,
begin placing dirt to ground level in pond areas #4, 3 & 5. NOTE: When excavated
material is placed in areas #3 & #5, pumping of water will be required to the existing pond
adjacent to river. When excavated material is placed in area #4, pumping of water will be
required to the existing pond south of Stage 2 of the proposed pit.
2) When sufficient dirt has been moved to bring the three ponds to grade, the project
engineer should have the contractor begin raising waste area #4 to its final maximum
elevation of 130.0'.
3) Begin driving piles for both bridge crossings SR 1250 and the Tar River only when
access to both sides of the river has been established. (See plant side construction
Phase III of Stage 1 item 1.)
4) Begin road gallery construction and begin conveyor pier construction when areas reach
final grade from road gallery to the river crossing. Note: The encroachment agreement
for the road alle installation ex Tres on December 19 2009.
5) Construct the crane pads at the west side of the river crossing and construct half the river
gallery. Set the cranes and place the gallery across the Tar River. Remove the cranes
when complete. (See Phase III of Stage 1 item #5 of plant side construction)
G) Begin the 24" pipe encasement when NC DOT has finished resetting the ditches. Note:
These encased pipes will not be utilized under Phase I, however, the encroachment
agreement with NCDOT will expire on May 21 2009 if the j3ipes are not -put in place b
this date. (Option — Do not place at this time — acquire a new encroachment agreement
when the new plant phase is approved.)
7) Place road gallery and conveyor #3 when foundation work is completed.
8) Seed slopes and ditches as required. (See erosion control plan)
Phase V of Stage (1)
1) Stake out final protective berm (north-east and west of the newly constructed pit area)
and 5' high temporary berm at the Stage 2 limits. (Just south of the newly established pit
area)
2) When rock level in the new pit area has been reached (in the area where the primary
crusher will be placed) begin placing the protective berm around the newly opened pit
area to its final elevation on the north, east and west sides only. Also, place a 5' high
temporary berm near the stage 2 limit as shown on the plan sheet. (South side of pit)
Begin foundation work for the existing jaw crusher and conveyors #1 and #2.
3) See Phase III of Stage (1) items 1-14 for work to be completed on the plant side of the
river. (To be constructed simultaneously with west side construction)
4) Continue stripping in the pit area and place it into waste area 3 and 5A.
5) Construct Station No. 1 and place conveyors #1 and 42.
Phase VI of Stage (1)
1) Seed the newly constructed visual barrier berm and begin any planting of trees where
required — waste area #4, #3 and along the visual barrier berm. (See erosion control
plans)
2) When conveyor construction is complete, begin placing the 6' chain link fence at
designated locations as shown on the plans. NOTE: Utilize the existing staging area
fence by resetting at designated areas as directed by the project manager.
3) Dress up and reseed all disturbed areas.
4) The stabilization at the staging areas may be scarified if deemed necessary and
reseeded as required on the erosion control plans.
NOTE: All material under structures must render a minimum of 3,000 Ibs PSF soil bearing
density.
Stage (2) will begin after the new pit is protected and the old pit inlet and outlet berm has
been removed, or when additional stripping is required.
STAGE (2)
Phase I of Stage (2)
1) Begin moving dirt from pit area 5B and place it in waste are #5B.
2) Maintain all erosion control items as stated on the erosion control plans.
3) Seed all disturbed areas and plant trees at waste area #5 when 5B pit removal is
complete and placed at waste area #5. The bench at the proposed elevation of 96' will
have been established and made ready for the tree planting.
NOTE: Stage 3 and 4 will follow using the same criteria when additional pit development is
required.
Rocky Mount - Simultaneous Plant Side Construction Including Existing Berm Removal
STAGE (1)
Phase I (Existing Plant Area) of Stage (1)
1) The following areas to be staked by Hanson: (See plans)
a) Three locations along the existing berm adjacent to the existing pit east of the Tar
River (Inlet, Outlet and Island Area)
b) Conveyor center line (east of the Tar River) Rough in only — To be used for lay down
of stabilization
c) All clearing limits (plant side of river)
d) Location silt fence and all erosion control items
e) East side river staging area (See detail)
f) Grade stakes to establish 89' elevation at conveyor crossing on existing berm
g) Try to establish variable undercut limits at Sta. #2 and at the old silt pond area
Phase 11 of Stage (1)
1) Install silt fence and all erosion control items listed on plans at the following locations:
a) Adjacent to the river at the existing berm
b) Adjacent to NC 97 at waste area
2) Begin required clearing at areas designated by the project engineer
Phase III of Stage (1)
1) After clearing has been completed, develop access to RP19 (Elev, 70'+1-) by shaping
a trough area around RP19 (4B2 & 4133) large enough to allow a pile driver, workers
and a concrete truck to safely access this temporary work area. (See plan and profile
and any details for an approximate picture of what would be required at this
location.)
NOTE: The pile driving cannot proceed until the area west of the river and SR 1250 are made
ready for the pile driver to begin his operation. (See pit area construction Phase IV of Stage 1
Item 3)
2) Begin undercutting Sta. #2 and backfill. As the work proceeds in constructing Sta.
42, make sure that none of the required operations would interfere with the
operations listed below (Items 3-10).
3) Once the work at RP19 (462 &463) is complete, the area from 25' east of the rivers
edge for the entire face of the proposed conveyor support island should be stabilized
with Class 2 Rip Rap or Shot Rock to Elev. 78'+1- (which stabilizes the entire island
area to withstand high water up to a 500-year event) and should be temporarily
capped with Surge Stone to create a safe crane pad working area. (See detail)
4) Concurrently begin excavating a portion of the existing island berm area and all of
the inlet berm area (Shown in green) down to Elev. 87'+1-. A ramp will be required
from Elev. 89'+1- up to the existing outlet berm elevation and used as a haul ramp.
Haul to waste area adjacent to NC 97. When excavation is completed to Elev. 87'+/-,
stabilize the island work pad area as shown on detail which will allow the river gallery
to be constructed and put in place.
5) Construct half the river gallery, prepare the crane pads and set the cranes. Place the
river gallery and remove the cranes when work is complete. (See pit development
construction Phase IV of Stage 1 Item #5.)
6) Once the cranes have been removed begin excavating the inlet area again. A haul
ramp will be required as the material is excavated down to Elev. 72.5+1- from the
island 89' elevation. Place and compact a portion of this inlet material over the rock
that was placed to Elev. 78'+/- in Item 3 above. Bring the entire island area up to a
finished elevation of 89'. Haul the remaining excavation to the waste area. Place
fabric and Class 2 Rip Rap to finished 74.5' elevation as shown on detail for inlet
floodway. Remove the temporary haul ramp.
7) Once the inlet area is complete and the ramp is removed, complete the foundation
work and pier construction for 4132 and 4133. Also, begin 4134 — 41312 and place
conveyors.
NOTE: Temporary conveyors #10T and #11T maybe placed at this time.
8) Once the conveyor system is mostly completed in the above specified areas, begin
the undercut along the conveyor alignment adjacent to the outlet tloodway at the old
silt pond location and backfill. (See detail) If any undercut is required at RP 6 and
RP7, complete the necessary work at this time.
9) When the berm area around the new pit is nearing completion, begin removing the
material from the outlet berm (See detail — Orange Area), using the newly stabilized
conveyor alignment as a haul route. Tie to the existing road. Backfill and compact
the area near RP6 (Transfer 9T and 10T) if not already completed. (See temporary
conveyor profile.) As the material is removed from the outlet berm to Elev.72.5'+/-, a
ramp at a suitable grade must be developed from Elev. 74.5' back up to the
remaining island 89' elevation. To be used for final belting operations and future
maintenance. Place fabric and Class 2 Rip Rap to the 74.5' finished elevation along
the floor of the outlet floodway.
10) When the outlet berm construction is complete, begin completing the conveyor
system from 41313 to Sta. #2. Develop a maintenance road across the Class 2 Rip
Rap and construct a suitable ramp from Elev. 745 up to the existing berm area
south of Sta. #2. Construct a connector road from the existing tire storage area to
the existing road between the first two settling ponds. (See dashed yellow line) This
newly constructed access will remain as a permanent access to the east side gallery
area.
11) Place temporary conveyors 8T and 9T.
12) Reseed any disturbed areas including the existing waste area adjacent to NC 97,
13) Stabilize the area along the conveyor alignment east of the Tar River as directed by
the Project Engineer.
14) Maintain all erosion control measures installed on the east side of the river.
NOTE: All material under structures must render a minimum of 3,000 Ibs/PSF soil bearing
density.

trees are gone on one side and most from the other. Of course, maybe there never were any trees on that side.

Hi Kent,
conducted an inspection of the Hanson Aggregates -Rocky Mount Quarry on 8/10/10. 1 checked for compliance with
the Buffer Authorization issued by DWQ on November 17, 2009. The buffer impacts did not exceed the authorized
impacts. The project construction is not yet complete. They will be installing the conveyor over the river and this will
involve the installation of crane pads.
Attached is the Buffer Authorization for the project. If you would like to see the plans, I can send those along. I've also
attached a drawing of the mine plans, but it is not too easy to read.

I can't remember if I responded to your concern.... Recently, we reviewed/commented on a DLR mine expansion permit.
At that time we discovered a 401 Water Quality Certification was issued by the wetlands units for this crossing. We had
several concerns /comments regarding the proposed activity. (They are building a conveyor across the river to move
product from a new pit to an existing processing area)...
We are following up with a site inspection (e.g. mining stormwater permit compliance review, 401 Certification and
buffer rule compliance.)

Dear Mr. Sprinkle:
You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 19,403 square feet of Zane 1 Tar -Pamlico River basin protected riparian
buffers and 14,986 square feet of Zone 2 Tar -Pamlico River basin protected riparian buffers, as described
in your application dated January 23, 2009, and received by the Division of Water Quality (DWQ) on
January 23, 2009, to construct the proposed conveyor crossing at the site. This authorization certification
is for the purpose and design that you described in your application. If you change your project, you must
notify us and you may be required to send us a new application. If the property is sold, the new owner
must be given a copy of this authorization letter and is thereby responsible for complying with all
conditions. This authorization requires you to follow the conditions listed below. This authorization
replaces the previous authorization issued by DWQ on February 4, 2009.
In addition, you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non -
discharge regulations.
The Additional Conditions of the Certification are:

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the 'impacts depicted in the Pre -Construction Notification. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.
3. Erosion and sediment control practices must be in full compliance with all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor -owned or leased borrow pits associated with the project.
c. Sufficient materials required for stabilization and/or repair of erosion control measures and
stormwater routing and treatment shall be on site at all times.
4. Sediment and Erosion Control Measures
Sediment and erosion control measures shall not be placed in wetlands or waters without prior
approval from the Division. If placement of sediment and erosion control devices in wetlands and
waters is unavoidable, design and placement of temporary erosion control measures shall not be
conducted in a manner that may result in dis-equilibrium of wetlands or stream beds or banks,
adjacent to or upstream and down stream of the above structures. All sediment and erosion control
devices shall be removed and the natural grade restored within two (2) months of the date that the
Division of Land Resources or locally delegated program has released the project;
5, Diffuse Flow
All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at
non -erosive velocities through the protected stream buffers such that it will not re -concentrate
before discharging into a stream as identified within 15A NCAC 2B .0259 (5). If this is not
possible, it may be necessary to provide stormwater facilities that are considered to remove
nitrogen(and phosphorus if in the Tar -Pamlico River Basin), This may require additional approval
from this Office.
6. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization- shall be clearly marked with orange warning fencing
(or similar high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities;

Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act and the Tar -Pamlico riparian buffer protection rule as described within 15A NCAC 2B .0259. If you

of the riparian areas for the construction of the enclosed aerial conveyor belt. The construction activities will require 3 large
cranes to be put in place on each side of the Tar River in order to build the conveyor belt with no impacts to the jurisdictional
waters. All areas identified as "temporary" will be re -vegetated as required by the Division of Water Quality.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
This project started off as potentially a "barge" or "floating dock" that would cross the Tar River, this system would be
necessary in order to move material from the existing mine site (east side of Tar River) to the new mine site (west side of
the Tar River). After working with the USACE, the applicants proposed an idea that would avoid impacts to jurisdictional
waters. The current proposed activity is an enclosed aerial conveyor crossing, which would effectively move materials
from the existing mine site to the new mine site.
With regards to the minimization of impacts associated with the riparian buffers, in order to construct the enclosed aerial
conveyor system an extensive construction corridor is necessary. The construction activity requires 3 cranes to be set up
on each side of the Tar River. The cranes will be used to construct the enclosed aerial conveyor crossing in addition to
the permanent towers needed (RP20 & RP 19), which are a part of the enclosed aerial crossing system. All structures in
this area require materials to stabilize and must render a minimum of 3,000 lbs/PSF soil bearing density.
The post construction the proposed permanent stone within the buffers areas are needed because of the following
reason; to protect and provide maintenance for the proposed conveyor system and structures associated with the
plant on both sides of the Tar River, As seen on the overall site plan, the berm areas to the north and south on the
east side of the Tar River will be cut [town and have a final elevation of 74.5. The buffer area on the east side of
the river will have just an island remaining when the project is finalized, this island will have a final elevation of
89.0. Protection of the island and proposed conveyor system is mandatory to withstand potential flooding and
erosion. Furthermore, the buffer area on the west side of the river is in a low lying area and the proposed conveyor
system and structures associated with the plant will need to be protected from potential flooding and erosion.

Silt fencing will be placed along the limits of disturbance and 25' off of the toe of slope. All required Sedimentation &
Erosion Control BMP's will be in place according to their approved Sedimentation & Erosion Control Plan.

Corps is issuing this permit in response to your written request of October 5, 2006 and the

Any deviation in the authorized work will likely require modification of this permit. If
a chime in the authorized work is necessary, you should promptly submit revised plants to

from their existing site. The applicant plans to build a conveyor system to move material

walkway for maintenance purposes. it would cross the Tar River, downstream from its point
of navigability, northeast of Rocky Mount. Edgecombe County, North Carolina.

S. Reeraluation of Permit Decision. This i)Mce may reevaluate its decision on this permit at any time the
circtitnstanee_c warrant. Circumstances that could require a reevaluation include, but are not Iintited to,

b. The information provided by you in support of your permit application proves to have been Use,
incomplete, or inaccurate (see 4 above).
c, Significant new information surfaces which this office did not consider in reaching the original
public interest decision.

modification, and revocation procedures contained in 33 CFR 32-5.7 or enforcement procedures such as

Work Limits
a) All work authorized by this permit must be performed in strict compliance with the
attached plants, which are a part of thin permit. Any modification to these plans mint be
approved by the US ,Army Corps of Engineers (USACE) prior to implementation.
b) Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized lar4-clearing activities shalt hake place at any time in
the construction or maintenance of this project, within waters or wetland~. This permit
does not authorize temporary placement or double handling of excavated or fill material
within waters or wetlands outside the permitted area. This prohibition applies to all
borrow and fill activities connected with this proiect.
c) Except as specified in the plans attached to this permit, no excavation, Fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of
this project, in such a manner as to impair normal flows and circulation patterns within
waters or wetlands or to reduce the reach of waters or wetlands.

d) if the North Carolina Division of Water Quality has issued a conditioned Wetter Quality
Certification for your project. the conditions of that certification are hereby incorporated
as special Conditions of this permit. F pr your convenience, a copy of the certification is
attached if it contains such conditions.
e) All mechanized equipment will'be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other
toxic materials. In the event of a spill of petroleum products or any other hazardous
waste, the permittee shall imrocdiately report it to the N.C. Division of Water Quality at
(919) 733-5083, Ext, 526 or (800) 662-7956 and provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act will be followed.

f) The petmiltee shall advise the Corps in writing upon completion of the work authorized
by this permit.
g) Unless otherwise authorized by this permit, till fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants

except in trace quantities. Mctal products, organic materials (including debris from land
clearing activities), or unsightly dcbria will not be used.
h) The permittee shall require its contractors and/or agents to comply with the termis and
conditions of this permit in the construction and maintrnattce of this project, and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including
all conditions. shall be available at the project site during construction and maintenance
of this project
i) The permittm shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices arotmd all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed nreaq.
Additionally, the project must remain in full compliance with all aspects of the:
Sedimentation Pollution Control Act of 1973 (Notch Carolina General Statutes Chapter
1.13A Article 4).
j} The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United States and in such tiune
and manner as t1w, Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre-prajt!ct condition.
Enforcement
k) Violations of these conditions or violation:: of Section 404 of the Clean Water Act of Section
10 of the Rivers and Harbors Act must he reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 2.4 hours of the petmittee's discovery of the violation.
Section 10
1) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the Uinited States and in such time
and manner as the Secretary of the Army or his authorized representative may direct,
restore the waterway to its fortmr conditions. if the permittee fails to comply with this
direction, the Secretary or his representative may restore the waterway, by contract or
otherwise, and recover the cost from the permittee.
m) The authorized structure and associated activity must not interfere with the public's tight
to free navigation on all navigable waters of the United States. No attempt will be made
by the pertnittte to prevent the full and free use by the public of all navigable waters at or
adjacent to the authorized work for reason other than safety.
n) The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other %Iteration, of the; structure or work herein
authorized, or if, in the opinion of the; SL:crctary of the Army or his authorized
representative, said structure or work shall cause unreasonable obstruction to the free
navigation of the navigable waters, the permittee wil I be required, upon due notice from
the U.S. Army Corps of Engineers, to remove, relocate. or alter the structural work or

obstructions caused thereby, without expense to the United States. No claim shall be
made against the United States on account of any such removal, relocation, or alteration.

Special Perrinit Conditions

b) The entire conveyor project will not impact any other Waters of the US or Special
Aquatic Sites, including wetlands. This includes fill resulting from material falling from
the conveyor.
c) The portion of the conveyor over the river will be well maintained du0na use, and
removed as soon as it is no longer in use.

Phase III of Stage (1)
1) Stabilize equipment staging area

6) Stabilize conveyor alignment 80' wide (50'-30')
7) Stabilize the proposed access road between the future pit berm and waste area #4.
8) Maintain all erosion control items installed on the west side of the river.
Phase IV of Stage (1)
1) Begin moving dirt from pit area and place in stockpile area 1A (See plan sheet). Also,
begin placing dirt to ground level in pond areas #4, 3 & 5. NOTE: When excavated
material is placed in areas #3 & #5, pumping of water will be required to the existing pond
adjacent to river. When excavated material is placed in area #4, pumping of water will be
required to the existing pond south of Stage 2 of the proposed pit.
2) When sufficient dirt has been moved to bring the three ponds to grade, the project
engineer should have the contractor begin raising waste area #4 to its final maximum
elevation of 130.0'.
3) Begin driving piles for both bridge crossings SR 1250 and the Tar River only when
access to both sides of the river has been established. (See plant side construction
Phase III of Stage 1 item 1.)
4) Begin road gallery construction and begin conveyor pier construction when areas reach
final grade from road gallery to the river crossing. Note: The encroachment agreement
for the road gallery installation expires on December 19, 2009.
5) Construct the crane pads at the west side of the river crossing and construct half the river
gallery. Set the cranes and place the gallery across the Tar River. Remove the cranes
when complete. (See Phase III of Stage 1 Item #5 of plant side construction)
6) Begin the 24" pipe encasement when NC DOT has finished resetting the ditches. Note:
These encased pipes will not be utilized under Phase 1, however, the encroachment
agreement with NCDOT will expire on May 21, 2009 if the pipes are not put in place by
this date. (Option — Do not place at this time — acquire a new encroachment agreement
when the new plant phase is approved.)
7) Place road gallery and conveyor #3 when foundation work is completed.
8) Seed slopes and ditches as required. (See erosion control plan)
Phase V of Stage (1)
1) Stake out final protective berm (north-east and west of the newly constructed pit area)
and 5' high temporary berm at the Stage 2 limits. (Just south of the newly established pit
area)
2) When rock level in the new pit area has been reached (in the area where the primary
crusher will be placed) begin placing the protective berm around the newly opened pit
area to its final elevation on the north, east and west sides only. Also, place a 5' high
temporary berm near the stage 2 limit as shown on the plan sheet. (South side of pit)
Begin foundation work for the existing jaw crusher and conveyors #1 and #2.
3) See Phase III of Stage (1) items 1-14 for work to be completed on the plant side of the
river. (To be constructed simultaneously with west side construction)
4) Continue stripping in the pit area and place it into waste area 3 and 5A.
5) Construct Station No. 1 and place conveyors #1 and #2.
Phase VI of Stage (1)
1) Seed the newly constructed visual barrier berm and begin any planting of trees where
required - waste area #4, #3 and along the visual barrier berm. (See erosion control
plans)
2) When conveyor construction is complete, begin placing the 6' chain link fence at
designated locations as shown on the plans. NOTE: Utilize the existing staging area
fence by resetting at designated areas as directed by the project manager.
3) Dress up and reseed all disturbed areas.
4) The stabilization at the staging areas may be scarified if deemed necessary and
reseeded as required on the erosion control plans.
NOTE. All material under structures must render a minimum of 3,000 lbs PSF soil bearing
density.
Stage (2) will begin after the new pit is protected and the old pit inlet and outlet berm has
been removed, or when additional stripping is required.
STAGE (2)
Phase I of Stage (2)
1) Begin moving dirt from pit area 56 and place it in waste are #56,
2) Maintain all erosion control items as stated on the erosion control plans.
3) Seed all disturbed areas and plant trees at waste area #5 when 56 pit removal is
complete and placed at waste area #5. The bench at the proposed elevation of 96' will
have been established and made ready for the tree planting.
NOTE: Stage 3 and 4 will follow using the same criteria when additional pit development is
required.
Rocky Mount - Simultaneous Plant Side Construction Including Existing Berm Removal
STAGE (1)
Phase I (Existing Plant Area) of Stage (1)
1) The following areas to be staked by Hanson: (See plans)
a) Three locations along the existing berm adjacent to the existing pit east of the Tar
River (Inlet, Outlet and Island Area)
b) Conveyor center line (east of the Tar River) Rough in only — To be used for lay down
of stabilization
c) All clearing limits (plant side of river)
d) Location silt fence and all erosion control items
e) East side river staging area (See detail)
f) Grade stakes to establish 89' elevation at conveyor crossing on existing berm
g) Try to establish variable undercut limits at Sta. #2 and at the old silt pond area
Phase II of Stage (1)
1) Install silt fence and all erosion control items listed on plans at the following locations:
a) Adjacent to the river at the existing berm
b) Adjacent to NC 97 at waste area
2) Begin required clearing at areas designated by the project engineer
Phase I I I of Stage (1)
1) After clearing has been completed, develop access to RP19 (Elev. 70'+/-) by shaping
a trough area around RP19 (4132 & 463) large enough to allow a pile driver, workers
and a concrete truck to safely access this temporary work area. (See plan and profile
and any details for an approximate picture of what would be required at this
location.)
NOTE: The pile driving cannot proceed until the area west of the river and SR 1250 are made
ready for the pile driver to begin his operation. (See pit area construction Phase IV of Stage 1
Item 3)
2) Begin undercutting Sta. #2 and backfill. As the work proceeds in constructing Sta.
#2, make sure that none of the required operations would interfere with the
operations listed below (Items 3-10).
3) Once the work at RP19 (4132 UB3) is complete, the area from 25' east of the rivers
edge for the entire face of the proposed conveyor support island should be stabilized
with Class 2 Rip Rap or Shot Rock to Elev. 78'+/- (which stabilizes the entire island
area to withstand high water up to a 500-year event) and should be temporarily
capped with Surge Stone to create a safe crane pad working area. (See detail)
4) Concurrently begin excavating a portion of the existing island berm area and all of
the inlet berm area (Shown in green) down to Elev. 87'+/-. A ramp will be required
from Elev. 89'+/- up to the existing outlet berm elevation and used as a haul ramp.
Haul to waste area adjacent to NC 97. When excavation is completed to Elev. 87'+/-,
stabilize the island work pad area as shown on detail which will allow the river gallery
to be constructed and put in place.
5) Construct half the river gallery, prepare the crane pads and set the cranes. Place the
river gallery and remove the cranes when work is complete. (See pit development
construction Phase IV of Stage 1 Item #5.)
6) Once the cranes have been removed begin excavating the inlet area again. A haul
ramp will be required as the material is excavated down to Elev. 72.5+/- from the
island 89' elevation. Place and compact a portion of this inlet material over the rock
that was placed to Elev. 78'+/- in Item 3 above. Bring the entire island area up to a
finished elevation of 89'. Haul the remaining excavation to the waste area. Place
fabric and Class 2 Rip Rap to finished 74.5' elevation as shown on detail for inlet
floodway. Remove the temporary haul ramp.
7) Once the inlet area is complete and the ramp is removed, complete the foundation
work and pier construction for 4B2 and 4B3. Also, begin 4B4 — 4B12 and place
conveyors.
NOTE: Temporary conveyors #10T and #11T maybe placed at this time.
8) Once the conveyor system is mostly completed in the above specified areas, begin
the undercut along the conveyor alignment adjacent to the outlet floodway at the old
silt pond location and backfill. (See detail) If any undercut is required at RP 6 and
RP7, complete the necessary work at this time.
9) When the berm area around the new pit is nearing completion, begin removing the
material from the outlet berm (See detail — Orange Area), using the newly stabilized
conveyor alignment as a haul route. Tie to the existing road. Backfll and compact
the area near RP6 (Transfer 9T and 10T) if not already completed. (See temporary
conveyor profile.) As the material is removed from the outlet berm to Elev.72.5'+/-, a
ramp at a suitable grade must be developed from Elev. 74.5' back up to the
remaining island 89' elevation. To be used for final belting operations and future
maintenance. Place fabric and Class 2 Rip Rap to the 74.5' finished elevation along
the floor of the outlet floodway.
10) When the outlet berm construction is complete, begin completing the conveyor
system from 4813 to Sta. #2. Develop a maintenance road across the Class 2 Rip
Rap and construct a suitable ramp from Elev. 74.5' up to the existing berm area
south of Sta. #2. Construct a connector road from the existing tire storage area to
the existing road between the first two settling ponds. (See dashed yellow line) This
newly constructed access will remain as a permanent access to the east side gallery
area.
11) Place temporary conveyors 8T and 9T.
12) Reseed any disturbed areas including the existing waste area adjacent to NC 97.
13) Stabilize the area along the conveyor alignment east of the Tar River as directed by
the Project Engineer.
14) Maintain all erosion control measures installed on the east side of the river.
NOTE: All material under structures must render a minimum of 3,000 Ibs/PSF soil bearing
density.

Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:

* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on this permit which outlines permit components and
addresses frequently asked questions
* A Certificate of Coverage for your facility

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.
