Dear Mr. Garvey:
Staff from the Department of Environment and Natural Resources conducted a stormwater compliance
inspection on August 18, 2015 for permit no. NCG020088 as part of a multimedia inspection of your
facility. We appreciate the assistance you and Mr. Donald Lane provided during the inspection. Please
reference the attached inspection report checklist and summary in addition to this letter.
The facility's stormwater management program appeared to be effective and generally compliant with all
permit requirements at the time of inspection. Please be sure to remove all petroleum product drums from
the former maintenance shop, repair noted rill erosion toward wetland areas, and revise the site plan to
indicate the former mine dewatering outfall location and make sure the SWPPP site plan is up to date.

Inspection Summary:
A multi -media pilot program inspection was conducted by staff from the Division of Water Resources on August 18, 2015 to
evaluate compliance with NPDPS stormwater and mining permits issued to the facility. The stormwater inspection results
for NCG020088 are presented below.
The stormwater pollution prevention plan (SPPP) was reviewed and contained all essential components, and has been
updated or reviewed for accuracy annually, The site plan must be updated to indicate all SDO locations, including the
inactive outfall location and former discharge points (subject to monitoring during industrial activity).
The mine is inactive and does not dewater the pit, which is now owned or leased by the City of Durham as a water supply.
Aggregate stockpiles located on the northern portion of the property are surrounded by a perimeter gravel berm and do not
appear to have concentrated discharge points such that no outfall location was observed. Stormwater primarily remains
onsite and infiltrates or sheet flows, Piles are not wetted, only stored for sale in the area. Some erosion was noted on the
eastern end of the staging area and should be addressed to prevent sedimentation in adjacent wetlands. Oil/grease/fuel
drums located in former maintenance shop should be promptly removed offsite.
Overall the site is clean and well -kept and operated by knowledgeable staff. No significant compliance issues were
identified.

which shall provide that the usefulness, productivity and scenic values of
all lands and waters affected by this mining operation will receive the
greatest practical degree of protection and restoration.

In accordance with the application for this mining permit, which is hereby approved by the
Department of Environment and Natural Resources hereinafter referred to as the Department,
and in conformity with the approved Reclamation Plan attached to and incorporated as part of
this permit, provisions must be made for the protection of the surrounding environment and for
reclamation of the land and water affected by the permitted mining operation. This permit is
expressly conditioned upon compliance with all the requirements of the approved Reclamation
Plan. However, completed performance of the approved Reclamation Plan is a separable
obligation, secured by the bond or other security on file with the Department, and may survive
the expiration, revocation or suspension of this permit.
This permit is not transferable by the permittee with the following exception: If another
operator succeeds to the interest of the permittee in the permitted mining operation, by virtue
of a sale, lease, assignment or otherwise, the Department may release the permittee from the
duties imposed upon him by the conditions of his permit and by the Mining Act with reference
to the permitted operation, and transfer the permit to the successor operator, provided that
both operators have complied with the requirements of the Mining Act and that the successor
operator agrees to assume the duties of the permittee with reference to reclamation of the
affected land and posts a suitable bond or other security.
In the event that the Department determines that the permittee or permittee's successor is not
complying with the Reclamation Plan or other terms and conditions of this permit, or is failing
to achieve the purposes and requirements of the Mining Act,, the Department may give the
operator written notice of its intent to modify, revoke or suspend the permit, or its intent to
modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a
hearing at a designated time and place on any proposed modification, revocation or
suspension by the Department. Alternatively and in addition to the above, the Department
may institute other enforcement procedures authorized by law.
Definitions
Wherever used or referred to in this permit, unless the context clearly indicates otherwise,
terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49.
Modifications
November 20, 1989: This permit has been modified to allow the construction and stabilization
of the wetland mitigation areas as per the Preliminary Wetland Mitigation Plan dated January
9, 1989.
January 19, 1993: This permit has been modified to include the revised reclamation plan and
sediment and erosion control measures on the Reclamation Maps, Sheets R-lthrough R-3,
dated March 1992 and revised August 1992 and the additional information dated November
25, 1992 from McKim and Creed Engineers.
May_24, 1994. This permit has been modified to allow on -site disposal of petroleum
contaminated soils in the 6.5 acre land application area as per the revised plans received by
the Land Quality Section on April 5, 1994.

Teer Company to Benchmark Carolina Aggregates Inc.
May 21, 1999: This permit has been modified to change the corporate name from Benchmark

Aggregates Carolina Inc. to Hanson Aggregates Southeast Inc.
October 26, 2009: This permit has been modified to change the corporate name from Hanson
Aggregates Southeast Inc. to Hanson Aggregates Southeast LLC.
Expiration Date
This permit shall be effective from the date of its issuance until March 21, 2023.
Conditions
This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and
to the following conditions and limitations:
OPERATING CONDITIONS:
Wastewater and Quarry Dewatering
A. Any wastewater processing or mine dewatering shall be in accordance with the
permitting requirements and rules promulgated by the N.C. Environmental
Management Commission.
B. Any storm water runoff from the affected areas at the site shall be in accordance
with any applicable permit requirements and regulations promulgated by the .
Environmental Protection Agency and enforced by the N.C.. Environmental
Management Commission. It shall be the permittee`s responsibility to contact
the Division of Water Quality to secure any necessary storm water permits or
other approval documents.
2. Air Quality and Dust Control
A. Any mining related process producing air contaminant emissions including
fugitive dust shall be subject to the requirements and rules promulgated by the
N.C. Environmental Management Commission and enforced by the Division of
Air Quality.
B. During processing operation, water trucks or other means that may be necessary
shall be utilized to prevent dust from leaving the permitted area.

3. Buffer Zones
A. Any mining activity affecting waters of the State, waters. of the U. S., or wetlands
shall be in accordance with the requirements and regulations promulgated and
enforced by the N. C. Environmental Management Commission.
B. Sufficient buffer shall be maintained between any affected land and any
adjoining waterway or wetland to prevent sedimentation of that waterway or
wetland from erosion of the affected land and to preserve the integrity of the
natural watercourse or wetland.
C. All buffer zones shown on the Permit Renewal Maps dated February 2013 shall
be maintained to protect adjoining property. These buffer zones, with the
exception of the installation of required sediment control measures and approved
earthen berms, shall remain undisturbed.
4. Erosion and Sediment Control
A. Adequate mechanical barriers including, but not limited to diversions, earthen
dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be
provided in the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or into any lake, wetland
or natural watercourse in proximity to the affected land.
B. All mining activities, including the installation and maintenance of all erosion and
sedimentation control measures, shall be conducted as indicated on the Permit
Renewal Maps dated February 2013 and the supplemental information received
by the Land Quality Section on February 19, 2013.
C. An erosion and sediment control plan(s) shall be submitted to the Department for
approval prior to any land disturbing activities not indicated on the revised
erosion control plan or mine maps submitted with the approved application for a
mining permit and any approved revisions to it. Such areas include, but are not
limited to, expansion outside of the approved pit area, creek crossings, or
expansion of overburden or waste disposal areas.
5. Groundwater Protection
Groundwater monitoring wells shall be installed and monitored as deemed appropriate
by the Department.

6. Graded Slopes and Fills
A. The angle for graded slopes and fills shall be no greater than the angle which
can be retained by vegetative cover or other adequate erosion control measure,
structure, or device. In any event, exposed slopes or any excavated channels,
the erosion of which may cause off -site damage because of siltation, shall be
planted or otherwise provided with groundcover, devices or structures sufficient
to restrain such erosion.
B. Overburden cut slopes along the perimeter of any pit expansion conducted after
January 19, 1993 shall be graded to a minimum 2 horizontal to 1 vertical or
flatter and shall be stabilized within 60 days of completion. Furthermore, a
minimum ten (10) foot wide horizontal safety bench shall be provided at the top
of the rock and at the toe of any overburden slope constructed after January 19,
1993.
7, Surface Drainage
The affected land shall be graded so as to prevent collection of pools of water that are,
or likely to become, noxious or foul. Necessary structures such as drainage ditches or
conduits shall be constructed or installed when required to prevent such conditions.
8. Blastinq
The operator shall monitor each blast with a seismograph located at a distance
no farther than the closest off site regularly occupied structure not owned or
leased by the operator. A seismographic record in peak particle.velocity, air
overpressure, and vibration frequency levels shall be kept for each blast (except as
provided under Operating Condition Nos. 8B and 8D of this permit). The following
blasting conditions shall be observed by the mine operator to prevent hazard to persons
and adjacent property from surface blasting:
A. Ground Vibration With Monitoring:
In all blasting operations, the maximum peak particle velocity of any component
of ground motion shall not exceed Figure 1 (below) at the immediate location of
any regularly occupied building outside of the permitted area such as a dwelling
house, church, school, or public, commercial or institutional building.

B. Ground Vibration Without Monitoring.
In the event of seismograph malfunction or other condition which prevents
monitoring, blasting shall be conducted in accordance with the following
formulas:

Air blast With Monitoring
Air blast overpressure resulting from surface blasting shall not exceed 129
decibels linear (dBL) as measured at the immediate location of any regularly
occupied building not owned or leased by the operator outside of the permitted
area such as a dwelling house, church, school, or public, commercial or
institutional building, unless an alternate level based on the sensitivity of the
seismograph microphone as specified below is being used:

monitoring, blasting shall be conducted in accordance with the following

The air blast/overpressure shall not exceed 129 decibels, for the purposes of this .
Section.
E. Record Keeping:
The operator shall maintain records on each individual blast describing: the total
number of holes; pattern of holes and delay of intervals; depth and size of holes;
type and total pounds of explosives; maximum pounds per delay interval; amount
of stemming and burden for each hole; blast location; distance from blast to
closest offsite regularly occupied structure; and weather conditions at the time of
the blast. Records shall be maintained at the permittee's mine office and copies
shall be provided to the Department upon request.
F. Excessive Ground Vibration/Air blast Reporting1
If ground vibration or Air blast limits are exceeded, the operator will immediately
report the event with causes and corrective actions to the Department. Use of
explosives at the blast site that produced the excessive reading shall cease until
corrective actions approved by the Department are taken. However, blasting
may occur in other approved areas within the permitted boundary. Authorization
to blast at the blast site may be granted at the time of the verbal reporting of the
high ground vibration or high air blast reading if the circumstances justify verbal
approval. Failure to report will constitute a permit violation.
G. Flyrock Prevention:
The operator shall take all reasonable precautions to ensure that flyrock is not
thrown beyond areas where the access is temporarily or permanently guarded by
the operator. Failure to take corrective measures to prevent flyrock and
repeated instances of flyrock shall be considered a violation of the Mining Permit.
H. Fyyrock Reporting;
Should flyrock occur beyond the permitted and guarded areas, the operator shall
immediately report the incident to the Department. Further use of explosives on
the mine site shall be suspended until the following actions have been taken:
1. A thorough investigation as to the cause(s) of the incident shall be
conducted.
2. A report detailing the investigation shall be provided to the Department
within 10 days of the incident. The report shall, at a minimum, document
the cause(s) of the incident along with technical and management actions
that will be taken to prevent further incidents. The report shall meet with
the approval of the Department before blasting may resume at the mine
site.

Studies:
The operator shall provide to the Department a copy of the findings of any
seismic studies conducted at the mine site in response to an exceedence of a
level allowed by these blasting conditions. The operator shall make every
reasonable effort to incorporate the studies' recommendations into the
production blasting program.
J. Notice:
The operator shall, when requested by the Department, give 24-hour advance
notice to the Land Quality Section Regional Office prior to any blast during a
period for which notice is requested.
9. High Wall Barrier
A physical barrier consisting of large boulders placed end -to -end or fencing shall be
maintained at all times along the perimeter of any highwall to prevent inadvertent public
access. In addition, a minimum 25 foot wide horizontal safety bench shall be provided
at the junction between the top of rock and the toe of any overburden cut slope
constructed after January 19, 1993.
10. Visual Screening
A. Existing vegetation shall be maintained between the mine and public
thoroughfares to screen the operation from the public. Additional screening
methods, such as constructing earthen berms, shall be employed as deemed
appropriate by the Department.
B. Vegetated earthen berms shall be located and constructed as shown on the
Permit Renewal Maps dated February 2013. In addition to grasses, long leaf
and/or Virginia pines or other acceptable evergreen species shall be planted as
deemed appropriate by the Department to improve visual and noise buffering.
11. Plan Modification
The operator shall notify the Department in writing of the desire to delete, modify or
otherwise change any part of the mining, reclamation, or erosion/sediment control plan
contained in the approved application for a mining permit and any approved revisions to
it. Approval to implement such changes must be obtained from the Department prior to
on -site implementation of the revisions.

12. Refuse Disposal
A. No on -site disposal of refuse or other solid waste that is generated outside of the
mining permit area shall be allowed within the boundaries of the mining permit
area unless authorization to conduct said disposal has first been obtained from
both the Division of Waste Management and the Land Quality Section,
Department of Environment and Natural Resources. The method of disposal
shall be consistent with the approved reclamation plan.
B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971
generated on -site and directly associated with the mining activity may be
disposed of in a designated refuse area. All other waste products must be
disposed of in a disposal facility approved by the Division of Waste
Management. No petroleum products, acids, solvents or their storage containers
or any other material that may be considered hazardous shall be disposed of
within the permitted area.
C. For the purposes of this permit, the Division of Energy, Mineral, and Land
Resources considers the following materials to be "mining refuse" (in addition to
those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971):
1. on -site generated land clearing debris
2. conveyor belts
3. wire cables
4. v-belts
5. steel reinforced air hoses
6. drill steel
D. If mining refuse is to be permanently disposed within the mining permit
boundary, the following information must be provided to and approved by the
Division of Energy, Mineral, and Land Resources prior to commencement of
such disposal:
1. the approximate boundaries and size of the refuse disposal area;
2. a list of refuse items to be disposed;
3. verification that a minimum of 4 feet of cover will be provided over the
refuse;
4. verification that the refuse will be disposed at least 4 feet above the
seasonally high water table; and
5. verification that a permanent vegetative groundcover will be established
E. Used, clean concrete shall only be allowed on permitted quarry sites that have
obtained a valid air permit and are allowed to operate crushing operations for the
purposes of recycling and reuse provided that the following conditions are met:

1. Appropriate quality control measures shall be taken when the used
concrete arrives onsite to ensure that all such concrete processed onsite
is clean, inert material.
2. Used, clean concrete shall be temporarily stockpiled and processed within
existing approved affected areas draining to existing approved erosion
and sedimentation control measures.
3. No used, clean concrete material shall be permanently disposed of onsite.
4. Any foreign material that may be found within the used concrete must be
separated from the concrete and properly recycled or disposed off -site.
13. Annual Reclamation Repo
An Annual Reclamation Report shall be submitted on a form supplied by the
Department by February 1 of each year until reclamation is completed and approved.
14. Bondinq
The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a
$500,000.00 blanket bond, is sufficient to cover the operation as indicated in the
approved application. This security must remain in force for this permit to be valid. The
total affected land shall not exceed the bonded acreage.
15. Archaeological Resources
Authorized representatives of the Division of Archives and History shall be granted
access to the site to determine the presence of significant archaeological resources.

APPROVED RECLAMATION PLAN
The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition
on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a
separable obligation of the permittee, which continues beyond the terms of the Mining Permit.
The approved plan provides:
Minimum Standards As Provided By G.S. 74-53
The final slopes in all excavations in soil, sand, gravel and other unconsolidated
materials shall be at such an angle as to minimize the possibility of slides and be
consistent with the future use of the land.
2. Provisions for safety to persons and to adjoining property must be provided in all
excavations in rock.
3. All overburden and spoil shall be left in a configuration which is in accordance with
accepted conservation practices and which is suitable.forthe proposed subsequent use
of the land.
4. No small pools of water shall be allowed to collect or remain on the mined area that are,
or are likely to become noxious, odious or foul.
5. The revegetation plan shall conform to accepted and recommended agronomic and
reforestation practices as established by the North Carolina Agricultural Experiment
Station and the North Carolina Forest Service.
'6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein
incorporated. These activities shall be conducted according to the time schedule
included in the plan, which shall to the extent feasible provide reclamation simultaneous
with mining operations and in any event, provide reclamation at the earliest practicable
time after completion or termination of mining on any segment of the permit area and
shall be completed within two years after completion or termination of mining.
RECLAMATION CONDITIONS:
1. Provided further, and subject to the Reclamation Schedule, the planned reclamation
shall be to allow the quarry excavation to fill with water, provide a permanent barricade
(fence) along the top of any high wall, and grade and revegetate any areas in
unconsolidated material.
2. The specifications for surface gradient restoration to a surface suitable for the planned
future use are as follows:

A. All areas of unconsolidated material such as overburden or waste piles shall, be
graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to
insure slope stability.
B. ' Any settling ponds and sediment control basins shall be backfilled, graded, and
stabilized or cleaned out and made into acceptable lake areas.
C. The processing, stockpile, and other disturbed areas neighboring the mine
excavation shall be leveled and smoothed.
D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before
revegetation.
E. No contaminants shall be permanently disposed of at the mine site. On -site
disposal of waste shall be in accordance with Operating Conditions Nos. 12.A_
through E.
F. The affected land shall be graded to prevent the collection of noxious or foul
water.
3. Reve__. et�on. Plan:
Disturbed areas shall be permanently revegetated according to the Seeding Schedule
and Seed Bed Preparation Plan on the Details Map dated 2013.
Whenever possible, disturbed areas should be vegetated with native warm season
grasses such as switch grass, Indian grass, bluestem and gamma grass.
In addition, the permittee shall consult with a professional wildlife biologist with the N.C.
Wildlife Resources Commission to enhance post -project wildlife habitat at the site.
4. Reclamation Plan:
Reclamation shall be conducted simultaneously with mining to the extent feasible. In
any event, reclamation shall be initiated as soon as feasible after completion or
termination of mining of any mine segment under permit. Final reclamation, including
revegetation, shall be completed within two years of completion or termination of
mining.

Mining or on -site processing at this site has not occurred since the mid nineties, and we are
currently using the site as a sales yard for materials imported from our Rougemont (North
Durham) Quarry. Shop use for equipment repairs have pretty much stopped as well. No
additional expansion of the Quarry is expected during the life of the permit. The pit was sold
to the City of Durham on April 4, 2007 for use as a fresh water source for the city's water
system.
Necessary erosion and sedimentation control structures, visual buffers, etc. are in place
where suitable reclamation has not been accomplished and/or adequate ground cover is not

2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. All aspects of the mine site must be clearly labeled on the
maps along with their corresponding (approximate) acreage. As a reminder, mining permits can
only be issued for up to 10 years; thus, all mine and reclamation neaps must only denote those
activities that are intended to be conducted during the life of the mining permit. All maps must be
of a scale sufficient (see minimum requirements listed below) to clearly illustrate the following, at a
minimum:
a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located
including easements and rights -of -way.
b. Existing or proposed permit boundaries.
c. Initial and ultimate limits of clearing and grading.
d. Outline and width of all buffer zones (both undisturbed and unexcavated).
e. Outline and acreage of all pits/excavations.
f. Outline and acreage of all stockpile areas.

In response to your renewal application for continued coverage under stormwater General Permit NCG020000
the Division of Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit
is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15,
2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG020000
• A copy of a Technical Bulletin for the General Permit
• Two copies of the Tier 2 / Exceedence Discharge Monitoring Report (DMR) Form for Stormwater
• One copy each of the Annual Summary DMR Forms for Stormwater and Wastewater
• Two copies of the Limit Violation DMR Form for Wastewater
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater and wastewater, and it specifies your obligations with
respect to discharge controls, management, monitoring, and record keeping. Please review the new permit to
familiarize yourself with all the changes in the reissued permit. It your Certificate of Coverage (COC) restricts
authorization to discharge stormwater only (or other limited terms) based on your original application, or
subsequent modifications to your COC, you must continue to meet these requirements or contact the Stormwater
Permitting Unit to request a modification of this renewal COC.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
Part II:
• Section B — Language referencing PAMS has been changed. Flocculants may now be used if evaluated
by the Division and administered in accordance with maximum application doses and other requirements.
Part III:
• Section A -- The permit now requires a Stormwater Pollution and Prevention Plan (SPPP) tailored to the
mining industry, in lieu of a Stormwater BMP Plan.
• Section A - Inactive mines may be inspected on a reduced schedule: at least once per month and after
0.5" (or more) of rain. To qualify, inactive mines must possess an "Inactive Renewal" from DLR or certify
to DWO the site has been stabilized. The permittee must notify the DWQ Regional Office of inactive
status. Discharges from inactive mines trust still be monitored on the same schedule as active mines.

• Section B — Revised provisions require that stormwater discharges be sampled twice per year (instead of
annually), and that the sampling results be compared to new benchmark values. (The previous cut-off
concentrations have been removed.)
• Section B — Revised provisions require the permittee to execute Tier One, Tier Two & Tier Three
response actions, based on the first benchmark exceedence (Tier One) and the second consecutive
benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring
(reported to the appropriate Regional Offices) instead of twice -per -year monitoring. Monthly monitoring
shall be done until three consecutive monitoring events show no benchmark exceedences.
• Section B — This part contains a new provision that four exceedences of any benchmark will trigger
increased DWQ involvement in the permittee's stormwater management and control actions. DWO may
direct the permittee to apply for an individual permit, institute specific monitoring, or may direct the
implementation or installation of specific stormwater control measures.
• Section B — The definition of "Representative Storm Event" (RSE) now allows 48 hours (instead of 72
hours) of little or no precipitation to precede an RSE.
• Section B — Stormwater discharges from a basin designed to contain the 10-year storm must now be
monitored.
• Sections B & C — Failure to monitor according to permit terms triggers monthly monitoring for the
remainder of the permit.
• Section C — Analytical monitoring for Total Petroleum Hydrocarbons (TPH) has replaced the Oil & Grease
parameter in the previous permit.
• Section D — Qualitative monitoring must now be conducted during the same representative storm event
as the analytical monitoring.
• Section D — The permittee is required to keep a written record of his response to problems identified by
his qualitative monitoring observations.
• Section D — If the permittee fails to respond effectively to problems identified by qualitative monitoring, the
permittee may be required by DWQ to perform corrective action.
Section D — Qualitative ROS: Representative Outfall Status may be granted for qualitative monitoring for
some Stormwater Discharge Outfalls (SDOs).
• Section D — if mines do not respond to problems seen in visual monitoring, DWO may now require that
mines change the monitoring frequency, apply for an individual permit, implement in -stream monitoring,
install or modify structural stormwater controls, or implement other controls.
• Sections B, C, & D — Inability to sample due to adverse weather must be reported in the SPPP and
recorded in the Annual Summary DMR.
• Section E — A lower TSS Wastewater limit for PNA waters is included in the permit.
• Section E — All mining operations are now required to monitor TSS in wastewater effluent discharges (not
only industrial sand mines). However, TSS limits only apply to industrial sand mining operations.
• Section E — Turbidity limits on effluent discharges have been removed; however, turbidity standards still
apply in the receiving waters.
• Section E — Approval of a Pumping O&M Plan may be required prior to coverage (for sites with
dewatering activities that have the potential to drain wetlands or other surface waters).
• Section E — ATC Requirements have been changed for clarity. These requirements are now outlined for
Mine Dewatering Wastewater, Process Wastewater, Overflow From Non -Closed -Loop Process Recycle
Wastewater Systems, and Overflow From A Closed -Loop Process Recycle (CLPR).
• Section E — Monitoring for Fecal coliforms in discharges to SA waters has been clarified. Fecal coliform
monitoring is now required for all process and mine dewatering wastewater discharges to SA waters.
Part IV:
• Section E -- Items 1. and 2. require submittal of a new reporting form: the Annual Summary DMR. This
annual summary of the analytical monitoring results should be submitted to the DWO Central Office by
March 1 of each year.
• Section E — Exceedences and violations must be sent to the appropriate DWQ Regional Office within 30
days of receipt from the lab.
• Section E — Results of "No Flow" or "No Discharge" must be recorded within 30 days from the sampling
period in the SPPP. "No flow" or "No Discharge" must also be reported on the Annual Summary DMR
form.

Staff from the Division of Water Quality, Surface Water Protection of the Raleigh
Regional Office conducted a site visit to Hanson Aggregates, Durham Quarry at
5013 Denfield Street. The assistance and cooperation of Mr. Thomas Thacker
was very helpful and appreciated.
The following observations were as follow:
1. The Hanson Quarry and its perimeter has been purchased by the City of
Durham to be used as a water source for the city.
2. The site is only being used as a stockpile for pre -cleaned crushed stone
inventory for sale. The stone is taken from the Hanson Mine in Rougemont
and brought to the Denfield Street site for sale. No mining operations are
being performed at the 5013 Denfield Street location.
3. This site was found to have stored diesel fuel. The diesel fuel had secondary
containment. In the event of any fuel spill, Noble Oil is used for clean up.
4. Stormwater on the site is being channeled via storm drain to an unnamed
tributary to Eno River. The only stormwater exposure is stone inventory and
old machinery placed throughout the site.
The Raleigh Regional Office, surface Water Protection recommend that Hanson
Aggregates submit a request for permit rescintion for the 5013 Denfield Street
location, If rescintion of your permit is granted, Hanson Aggregates must reapply for
a Certificate of Coverage as required by NCG020000, before any mining activity is
conducted at this location,.

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

This letter is being written in response to the above referenced permit conditions which require
reporting of this facility's stormwater and pit water discharge on an annual basis. This facility
has not experienced a discharge of pit water during 1994.
As of this date, there has not been a rainfall event of sufficient size and duration at a time when
personnel have been available to sample for stormwater runoff to comply with the stormwater
sampling requirements for this permit. 1 anticipate stormwater sampling being performed at this
site in 1995.

You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 19,403 square feet of Zone I Tar -Pamlico River basin protected riparian
buffers and 14,986 square feet of Zone 2 Tar -hi, ilico River basin protected iiparian buffers, as described
in your application dated January 23, 2009, ano.r`eceived by the Division of Water Quality (DWQ) on
January.23, 2009, to construct the proposed conveyor crossing at the site. This authorization certification
is for the purpose and design'that you described in your application. If you change your project, you must
notify us and you may be required to.send us a new application. If the property is sold, the new owner
must be given a copy•of thi"uthorization letter and is therebyresponsible for complying witif all
conditions. This authorization •requires you to follow the conditions listed beiow. This authorization
replaces the previous authorization issued by DWQ on February 4, 2009.
In addition, you should obtain or otherwise coinply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion.and Sediment Control,'Non-
discharge regulations.

2. No Waste, Spoil;.Solids, oe pill of Any Kind
No waste, spoil, solids, or•frll of any kind shall occur, in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in. the I Pre -Construction Notification. All construction
activities, including the design,installation; operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so, that no,violations of state water quality
standards, statutes, or rules occur.
3. - Erosion and sediment control practices': must be in full compliance with'all specifications governing
the proper design, installation and operation and maintenance of such Best Management Practices in
order to protect surface.waters standards:.
a. 'lice erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in'accordance with the most recent version of the North Carolina
Sediment and. Erosion Control Planning and Design Manual.
b. The design, installation; operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in,the most,
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all,construction sites, borrow.sites, and waste pile (spoil) projects,
including contractor -owned or leased borrow pits associated with the project.
c. sufficient materials required for stabilization and/or repair of erosion control measures and
stonnwater routing and treatment shall be on site at all times.
4. Sediment and Erosion'Control.Measures
Sediment and erosion control measures shall not be.placed in wetlands or,waters without prior
approval from the Division. If placement of sediment and erosion "control devices in wetlands and,
waters is unavoidable, design and placemeni of temporary', erosion control measures shall not be
conducted in a manner that may result in dis=equilibrium of wetlands or stream beds or banks;
adjacent to or upstream and down stream of the above structures. All sediinJent and erosion control
• devices shall be removed and the natural grade restored within two (2) months of the date that the
-Division of Land Resources or locally delegated program has released the project;
5. Diffuse Flow
All constructed stormwater conveyance outlets shall be directed and maintained as diffuse flow at
non -erosive velocities through`the`pratected stream buffers such that it will'n6t re -concentrate
before discharging into,a stream as identified within t $A NCAC.2B .0259,(5), if this is. not
possible, it may be necessary to provide storrhwater facilitiesre that aconsidered,to remove
nitrogen(and phosphorus if in the Tar -Pamlico Rive_ r Basin). This-mayrequire additional approval
from this Office:
6. Protective Fencing
The outside buffer, wetland or water'boundary and'along the construction corridor within these
boundaries approved under this authorization sha11 be clearly, marked with orange warning fencing
(or similar high visibility material) for the areas that have been approved to infringe within the
buffer, wetland or water prior to any land disturbing activities;.

Upon completion of all work approved within the..401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the;apolicant is required to reWrn the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service. Center,!Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may, result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification, shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with_the approved wetland or
'stream inipacts), you may ask for anadjudicatory hearing. You must act within 60 days of the date that
you. receive this lettei. To ask.for a`hearing, send a written petition, Which conforms to Chapter -150B of
the North Carolina General Stat►ites to the'Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, N.C: 27699-6714, This certification and its conditions are final and binding unless you ask 'for a
hearing.
Any disputes over determinations regarding this Authorization Certifimite (associated with the approved
buffer impacts) shall be referred in -writing to the Director�for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B.
This letter completes`the review of the Division of Water Quality under Section 401 of the Clean Water
Act and the Tar -Pamlico riparian buffer Protection rule as described within 15A NCAC 2B .0259. %if you
