On August 11, 2016, Samir Dumpor and Gary Novak of the Division of Energy, Mineral,
and Land Resources, Washington Regional Office, visited the Fountain Quarry facility and met
on site with you, to perform a compliance inspection of a NPDES General Stormwater permit
number NCG020084 issued to Martin Marietta Materials, Inc.. During the site visit and file
review, it was discovered that site is in very good order and that all required documents
including SPPP and all monitoring results were present. The monitoring results are all
performed in timely manner and are within the benchmark values.

Nuwan,
After reviewing your request and based on a similar situation back in July of 2011, 1 believe that the circumstances are
such that we can approve your request for a variance from the permit requirements.
Please continue to perform the monthly pit discharge sampling (as required by the NPDES NCG02 permit) for at least
three months, until the next scheduled quarterly pit discharge sampling. After that, you can continue under the
quarterly sampling as per permit schedule.
Please be advised that all requests for variances are considered on "case by case" basis and that this approval does not
cover any future incidents.

As you and I spoke earlier, our Fountain Quarry failed to collect their fourth quarter pit discharge sample due to
miscommunication between the plant manager and assistant plant manager. The plant manager at the time who had
been collecting the samples moved on to a different job, and unfortunately during this transition in management the
quarterly pit discharge sampling had been overlooked. Upon recognizing our error we implemented monthly pit
discharge sampling as required by the General NPDES Permit NCG020000. However, since the permit would require us
to monitor monthly for the entire period of the remaining term, we would kindly like to request for a variance. We
would like to move back to quarterly sampling after a three month period.

I spoke to my supervisor, Al Hodge and to Jennifer Jones of Central Office in Raleigh about this request. We all agreed
that circumstances are such that we will approve your request for a variance from permit requirements, under following
condition:
Continue to perform monthly pit discharge sampling as required by the NPDES permit NCG020000 until the next
scheduled quarterly pit discharge sampling. At that time you can continue under quarterly sampling as per permit
schedule.

In response to your renewal application for continued coverage under general permit NCG020000 the Division of Water
Quality (DWQ) is forwarding herewith the reissued stormwater general permit. Please review the new permit to familiarize
yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of
wastewater. You must meet the provisions of the permit for the types of discharges present at your facility. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater
• Five copies of Qualitative Monitoring Report Form
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

Subject: Flooding related to Hurricane Floyd
Fountain Quarry — General NPDES Permit #COC NCG020084
Dear Mr. Thorpe:
As you are aware, Hurricane Floyd caused extensive flooding across much of eastern North
Carolina earlier this month. Damage on this scale has never been seen before and in many cases
it may take months to recover. Martin Marietta Aggregates — Fountain Quarry, located in Pitt
County, experienced flooding from an adjacent creek, which overflowed, into the pit.
Based on language in the General Permit, this situation is classified as an "upset" since this
incident was unavoidable and beyond our control. In actuality, by accepting this volume of
water, the pit has acted as a flood control device. Water levels in the creek have now subsided
and it is time for us to begin the process of removing this water from the pit. The only feasible
alternative we have is to pump this water right back into the creek from which it came. We need
to resume normal operations as soon as possible to insure an adequate supply of stone for needed
road repairs.
At this time we are not sure how long this pumping operation will take but estimates are that it
may take several weeks. Your office will be notified if we encounter any problems.
