Since the Tar-Pamlico Buffer rules do not have a "grandfathering" provision within them, a property or development is only " grandfathered" when it can establish in court that it has acquired a "vested right" to continue development as planned. Although this determination can only be made by the courts, the Division of Water Quality (DWQ) can inform you of its position with respect to the question of "vested rights". It is the determination of this office that you would have a "vested right" to complete your plans to build a single family residential home and garage as indicated within your September 27, 2000 request for "grandfathering" with additional information provided by RHF&P and dated December 6, 2000. The property was purchased by the Powell's in 1994 with plans for `?, ,,construction of a retirement home. The subject lot was platted early in the 1980s. `q The property was connected to water and sewer in the town of Belhaven in 1996. A CAMA Minor Development Permit was issued for construction of the dwelling ??t in 1997. A USACOE wetland jurisdictional determination was performed in 1997. The property was bulkheaded prior to 1994 (see photos) under a CAMA General Permit. This office is of the opinion that the proposed development on t e nropertv maybe considered as vested. All purchases, plans, and permits were prior to the effective date ofthe rules, 1/l/00. Please review the information submitted as soon as possible. The owners of the property would like to start construction of the dwelling prior to the expiration of the CAMA permit on 12/31 /00. Please notify this office as soon as possible of the decision. I am happy to forward to you the documentation I have in my file so that a determination concerning vested rights can be made by the Attorney General's office. Mr. Powell has previously sent you documentation which you may find in your file also. As you know Mr. & Mrs. Powell have been trying to get a determination as to their lot in Belhaven for some time now, particularly since they received the clipping of the article appearing in the Washington Daily News concerning the buffer rules. They live and work in California but want to return "home" to retire. They bought this lot in 1994 with that in mind and received their Minor Permit in September of 1997 (see permit which follows). You and I along with Ms. Wheeler of CAMA viewed the lot on November 15`h. Except for one dead tree and grass there is no vegetation on the lot. It is bounded by a small canal and bulkhead on two sides, a driveway/utility easement and East Street on the other sides. Dec 06 00 11:33a Jen Ms. Deborah A. Sawyer December 6, 2000 Page 2 252-946-3125 p.2 i think you agree that moving the proposed dwelling landward (North and East) 30 feet or more will place it substantially behind the Clark's dwelling and at a minimum will result in a loss of view of the Pungo River. The Powells have spent a great deal of time, effort and money preparing for their construction and are at present awaiting clearance so that the pilings can be placed on the lot, hopefully between now and the end of the year. Their architectural plans are also ready. I am enclosing Mr. & Mrs. Powell's letter of September 27`n to you which gives detail as to the things that have been done to the lot. On the Powell's behalf, I am requesting a determination that the Powells have vested rights and that they be granted permission to proceed with their construction in accordance with their CAMA permit which expires December 31. In addition to the items mentioned above, I am including the U.S. Army Corps of Engineers' determination that there are no wetlands on the property and a copy of the latest proposed site plan for the dwelling. Should there be something further in this regard, do not hesitate to advise. We would really appreciate an expedited determination if that is possible. Steve Trowell of CAMA referred me to you because of recent changes in the permitting process. Enclosed is a copy of our existing permit along with some background information and the original land survey. A little history may be of help. I was born in Belhaven NC and most of my relatives remain in that area. My wife and I purchased the lot in 1994 with the expectation of retiring there within 5 years. In 1997 we secured a permit from CAMA to construct a small home within the 75 foot AEC area. We cleared and filled the lot (photos enclosed), had the water and sewer hooked up and turned on. In February of this year we moved forward on a set of building plans. We are working with an architect in California for the overall design and Leonard Van Staalduinen in Greenville for compliance with the local building codes and hurricane requirements. I meet with Tim Johnson, the Belhaven town manager, in late August about securing a building permit, indicating we had a permit from LAMA. He mentioned changes in the regulations and referred us to Mr. Steve Trowell - who in turn referred us to you. After speaking to you, our question is - where do we go from here. Because of the utility easement, the lot is essentially unbuildable without constructing the home within the 75-foot AEC. The permit drafted maximizes the view while minimizing encroachment on the Pungo River frontage. We would appreciate your reviewing the enclosed material and your ideas on how we may proceed.
