On 6/3/201 1, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG020016. In accordance with your request, Certificate of Coverage
Number NCG020016 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. it is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Carteret County
A site inspection at the Radford Mine facility was conducted on August 18, 2010. This mine pit discharged to Sikes Branch a class
SA, l-IQW (high quality water) water of the State. A file review indicates that the certificate of coverage (NCG020016) is expired.
During our phone conversation on August 18, 2010, you indicated this pit has been closed for some time. The site visit confirmed no
recent mining activities have been conducted at this site and it does not appear that the mine pit poses any threat to water quality. You
indicated an interest to have the NPDES permit rescinded as no further mining will be pursued at this site. It appears there are
wetlands in close proximity to the edges of this mine pit. Any further mining would pose a threat to wetlands toward the west side of
the pit and no further mining to the east appears possible due to the close proximity to the Croatan I-ligh School and a residential
development.
Enclosed'is a Rescission Request Form for your convenience. Please fill in the date the mine pit was closed. Sign and date the form
and send it to the address highlighted at the bottom of the form. The Wilmington Regional Office will support your rescission request
based upon the fact that the mine pit is closed. There did not appear to be an outlet from the pond. If there is an outlet, please contact
me at the number provided below.
Our records show you as the permiuee for another mine pit covered under certificate of coverage NCG020468 (also expired). This pit
discharges to Caleb Branch a Class SA, I IQW water of the State. Please contact me as soon as possible to discuss this pit. You can

In response to your renewal application for continued coverage under general permit NCG020000, the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater general permit. This permit is reissued
pursuant to the requirements of North Carolina General Statute 143-215A and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.
The following information is included with your permit package:
* A copy of general stormwater permit NCG020000
* Five copies of the Analytical Monitoring form and five copies of the Qualitative Monitoring form
* A copy of a Technical Bulletin on this permit which outlines permit components and
addresses frequently asked questions
* A Certificate of Coverage for your facility
* DWQ fee schedule
Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.

herewith the subject certificate of coverage to discharge under the subject state - NPDES general permit.
Issuance of this certificate of coverage supercedes the individual NPDES permit No. NCO082228. This permit
is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.

or other document files or required to be maintained under Article 21 or -regulations of the
Environmental. Management Commission implementing that Article, or who falsifies, tampers with,
or knowly renders inaccurate any recording or monitoring device or method. required to be
operated or maintained under Article 21 or regulations ofthe Environmental Management Commission
implementing that Article, shall be guilty of a misdemeanor pumishable by a fine not to exceed

PART IV - EVALUATION AND RECOMMENDATIONS
The mining operation is being carried out in an area
adjacent to Bogue Sound. The applicant has indicated that the
excavated basin is to be converted into an'upland marina. The
dewatering water is pumped to a settling basin. The overflow from
the basin enters a wetland pond and eventually discharges into
Sikes Creek. There was no evidence of adverse impact on the
surface waters at the time of the site visit.
It is recommended that a draft permit be prepared with
monitoring and reporting requirements as proposed for the general
permits (mine dewatering operations) and placed at public notice.
If no significant adverse public comment is received, it is
recommended that NPDES Permit No. NC0082228 be issued for a five
year period. .
