Box 237 Edenton, NC, 27932 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Swanson: You have our approval, in accordance with the attached conditions, to dredge and fill in 0.25 acre of shallow water habitat and to shade or disturb 1.11 acres of non-vegetated wetlands and shallow water habitate in order to create a basin and construct a breakwater, boat slips, access platform, bulkhead, boatramp and travel lift on your property in Chowan County, as described in your application received by the Division of Water. Quality on January 24, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other'federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: Excavate 3 500 cubic yards of material to create a 16,180 sq. ft. basin, construct 210' of breakwater, 7 additional boat slips (for a total of 10 boat slips), a 212' access platform, 216 linear feet of steel concrete bulkhead, an 18' wide boatramp and 2 1' wide travel lift. Waff Contracting, Incorporated Field Investigation Report Page Two Project Setting Waff Contracting, Incorporated owns a 1.9 acre parcel located on the south side of Midway Drive (SR 1119) off Country Club Drive (SR 1129) near Edenton in Chowan County, adjacent to the Albemarle Sound. Elevation of this 210' wide x 500' deep parcel ranges 1'-9' above mean sea level. No vegetation was noted on the site with the exception of volunteer grasses. Man-made features on this site consist of a 65' x 85' boathouse containing 3 boat slips, a 130' x 135' boat basin with a 40' wide opening to Albemarle Sound. Approximately 240' linear feet of wooden breakwater has been constructed around the basin which has been excavated to a depth of 8' below NWL. During World War II the site was used by the US Navy. Since the late 1940's the site has been used by various boat manufacturing firms. Minor CAMA Permit #2000-004, which was issued on July 26, 2000. authorized a landward expansion of the boathouse to an overall dimension of 85' x 95' and the construction of a 30' wide "L"-shaped concrete pad on the west side of the boathouse. As of this date the work authorized by Minor Permit #2000-004 has not been started. The waters of the Albemarle Sound in the vicinity of the project are classified as SB by the NC Division of Environmental Management. These waters are classified as Coastal Fishing Waters by the NC Marine Fisheries Commission and NC Wildlife Resources Commission. Water depths in the project area (out to 100' in the sound) measure 1'-6' below NWL. The presence of submerged aquatic vegetation was not noted in the vicinity of the project. Review of available information suggest that there are no known archeological sites or geological formations associated with the applicant's property. Protect Description The applicant requests authorization to undertake the following development: - Construct 210 linear feet of new concrete breakwater to enlarge the existing basin. The breakwater would extend 117' from the southwest corner of the existing breakwater in the same direction, then turn 90° and continue for 95' until it intersects the existing shoreline. Remove 40 linear feet of the existing wooden breakwater in order to provide access into the basin. - Excavate with crane and clamshell the 9800 square feet of new basin within the 210 linear feet of new breakwater and the 6,380 square feet of highground located immediately landward of NWL. Within the 9800 sq. ft. open water area the average starting depth is 2' Waff Contracting, Incorporated Field Investigation Report Page Three below normal level and proposed finished depth is 8' below NWL resulting in the removal of 2,163 cubic yards of material. Within the 6,380 square-foot highground area the average elevation is 2' above NWL and the proposed finished depth is 8' below NWL resulting in the removal of 2,386 cubic yards, in stages, of material.. The applicant proposes to dry the 4,549 cubic yards of material by placing it within an 8,000 square-foot diked and silt fenced highground area located approximately 80' from the sound. The dry material would be spread over a 100' x 400' highground area located within and landward of the drying area. Construct 7 boat slips (4slips with dimensions of 20' x 35', 2 slips at 22' x 35' deep and 1 slip 21' wide and 38' deep) and construct four 2' x 12' long finger piers. - Construct an 8' wide x 212' long concrete access platform on the west side of the project. The platform would parallel the breakwater proposed along the western side of the basin and would lie approximately 12' from the common riparian line. The adjacent riparian owner, Edenton-Chowan Development Corporation, has agreed to waive the minimum setback of 15' . - Construct 216 linear feet of steel pile/concrete panel bulkhead around the portion of basin created out of highground. Construct within the northwest corner of the new basin an 18' wide boatramp extending 56' beyond NWL by using square concrete piles and 18' wide concrete panels placed on the piles. Construct a 21' wide travel lift designed to run on 38 linear feet of the aforementioned west bulkhead and a proposed 5' wide x 38' long concrete pier. Anticipated Impacts - The placement of breakwater around the new basin would enclose 16,180 square feet of Public Trust Area. - The construction of the access platform, finger piers and travel lift will shade 2,126 square feet of Estuarine/Public Trust Waters. - The placement of the 18' wide x 56' long concrete boatramp will result in the loss of 1,008 square feet of shallow water habitat. - The dredging of sandy material proposed within the open waters of Albemarle Sound will result in the loss of 9,800 square feet of shallow water habitat. Waff Contracting, Incorporated Field Investigation Report Page Four - The expansion of the basin landward of NWL will result in the disturbance of 6,030 square feet within the Estuarine Shoreline AEC. - The excavation landward of NWL, and the drying of excavated material, and the filling which is proposed will disturb 40,350 square feet of highground located outside the Estuarine Shoreline AEC. - Temporarily, localized turbidity will occur as a result of the construction of the breakwater, bulkheads, access platform, finger piers and travel lift. - Introduction of seven additional boats to the area with associated antifouling, painting, potential fuel leaks and pump-out needs. As discussed in our previous conversations the following work is proposed: SCOPE OF WORK 1. Extend the existing breakwater approx. 210' to enlarge the existing boat basin. The breakwater will extend from the southwest corner of the existing breakwater and continue in the same direction approx. 117', then turn 90 degrees to the north and proceed approx. 93' until it intersects the existing shoreline. Breakwater will consist of W12X53 piles driven to approx 35' with concrete panels sandwiched between the flanges. Batter piles will be attached to the vertical piles for stability. 2. Remove approx. 40' of existing breakwater as shown in the enclosed work plats. 3. Excavate/dredge the basin created by the new breakwater (approx. 16000 sf): Approx. 3500 cy of material will be excavated using a. crane and clairushell. This inateiial will be deposited in tow areas on-site, then graded, seeded, fertilized and mulched. 4. Construct 10 boat slips. 7 slips are 20' wide, 35' deep; 2 are 17'X 30'; and 1 is 21' X 38'. It will be constructed with T thick concrete panels positioned on top of the new breakwater and two timber piles per panel. 6. Construct a bulkhead around the basin excavation (approx. 215'). Bulkhead will consist of steel piles and concrete panels similar to the breakwater Iona ffietion. Batter piles will be driven iiito the shore side and welded to the vertical piles to withstand backflll pressure. Bulkhead elevation will be approx 6' above NWL=: 7. Construct boat ramp (1$' wide). Ramp will have a 7 to 1 slope and consist of two 18" square concrete piles laid on each sine of the slope of the excavation with 18' X12'6" concrete panels resting on the piles. 8: Construct a boat travel lift (21' wide). One wheel of the travel lift will nun on the west bulkhead and the other side will i un along a 5' wide X 38' long concrete pier. The pier consists of timber pile bents 8' OC with steel beam caps, two 18" double I-beam girders and concrete deck panels. Adjacent riparian landowners have been given a copy of the project application package for review as well as a waiver for encroachment within their 15' riparian corridor (access platform is approx 11'9" from the property line). Instead of spreading the excavated material from the basin extension on-site, the material will be loaded on trucks, transported across Midway Drive to property owned by the Edenton-Chowan Development Corporation and used to fill an old drainage ditch and properly grade the property. The proposed use consistent with the scope of work for development of this parcel as,.approved in the erosion and sedimentation control plan dated February 11, 2000 - attached. A statement from the property owner granting permission to place the material on the site is included as well as the Corps of Engineers jurisdictional determination stating the site contains no wetlands. Wet excavated material will still be placed within the specified drying bed on-site until suitable for transport. Upon completion any residual excavated material will be spread on-site as shown on the attached drawing (approx. 12,500 sf), then fine graded, fertilized, seeded and mulched. It established a performance oriented program requiring a project owner or developer to protect adjoining natural resources and properties, both during and after construction, from the effects of accelerated erosion. It is YOUR RESPONSIBILITY to understand and comply with the following minimum requirements of the Act: -- an erosion and sedimentation control plan is only valid for 3 years following the date of initial approval, if no land-disturbing activity has been undertaken; -- a copy of the LATEST APPROVED soil erosion and sediment control plan must be on file at the job site; -- a buffer zone, sufficient to restrain visible sedimentation, must be provided and maintained between the land-disturbing activity and any adjacent property or watercourse; -- new or affected cut or filled slopes must be at an angle that can be retained by vegetative cover; -- new or affected barren slopes must be provided with a ground cover sufficient to restrain erosion within the shorter of 15 working or 30 calendar days of completion of any phase (rough or final) of t; radink (RYE GRASS IS NOT in the approved seeding specifications nor is it an ACCEPTABLE substitute for the providing of a temporary ground cover); -- unless a temporary, manufactured, lining material has been specified, a clean straw mulch must be applied, at the minimum rate of 2 tons/acre, to all seeded areas.
