APPROVAL of Tar-Pamlico River Buffer Rules
Dear Mr. Cooper:
You have our approval to impact 53 linear feet of stream channel and associated protected stream
buffers to develop a agricultural road crossing at the Creekside Farms, Rocky Mount in Buncombe
County, as described in your application received on January 19, 2001, and in additional
correspondence received on March 21, 2001. This approval is valid for the Tar-Pamlico River Buffer
Rules (15A NCAC 2B .0259). In addition, you should get any other federal, state or local permits before
you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application for a new
approval or 401 Certification. If the property is sold, the new owner must be given a copy of this
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h).
If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Buffer

Dear Mr. Dorney,
As requested in your letter dated February 16t", 2001, here is additional information
justifying the width of the proposed road crossing of White Oak Swamp for Creekside
Farms in Edgecombe County, NC. Enclosed is a list of farm equipment width
specifications being used at the farm, and a letter from the project engineer discussing the
width of the road crossing and associated riprap.
As shown from the equipment width specification table, if the maximum equipment
width is 21 ft., with a creek bank depth of at least 5 ft., and a 2:1 side slope (3:1 would be
preferred), the minimum width of the crossing (not including riprap) would be 41 ft. (51
fl. width a 3:1 side slope). The engineer recommends maintaining the suggested 13 ft. of
riprap outlet protection, which, according to his specifications, would total a complete
crossing width of 53 ft. Therefore, there is no practical way to construct the road
crossing less than 40 ft. wide in a safe and stable manner.
As indicated in the initial buffer compliance request dated January 17t1i, 2001,
construction of the road will impact only the jurisdictional channel; no jurisdictional
wetlands will be impacted. This road will impact 53 linear feet (40' culvert + 13' rip-rap)
of stream channel, which is subject to the Tar-Pamlico River Basin Buffer Rules.
According to engineers' specifications, approximately 4,000 square feet (0.09 ac.) of
riparian buffer (Zone 1, 2400 sq. ft./Zone 2, 1600 sq. ft.) will be impacted by the

Response to DWQ Letter of 2/16/01
Dear Mr. Martin:
The subject letter from DWQ makes reference to the proposed road being 53 feet wide. The 53
feet mentioned includes 13 feet of rip rap outlet protection. The actual distance from end of FIS
to end of FIS is 40 feet.
Due to the low velocities that will be experienced through and in the vicinity of this structure (see
calculations), we have no problem with the outlet protection pad being eliminated. We would
prefer that it remain to insure that the energy even from low flows is dampened; nonetheless,
we are willing to "defer" to the State if this pad is viewed as unacceptable.

On January 19, 2001, the Division of Water Quality (DWQ) received your request for a No Practical Alternatives determination
and Authorization Certificate to impact 53 linear feet of stream channel and associated protected riparian buffers. Insufficient evidence
is present in our files to conclude that your project must be built as planned in waters and/or protected riparian buffers in accordance
with 15A NCAC 2B .0233. Therefore, unless modifications of the proposal are made as described below, we will have to move toward
denial of your Authorization Certificate as required by 15A NCAC 2B .0233(8) and will place this project on hold as incomplete until
we receive this additional information.
Please provide us with information supporting your position that states your project must be constructed as planned and that you
have no practicable alternative to placing fill in these waters or protected riparian buffers. Specifically;
• Provide addition justification as to why the proposed agriculture road needs to be 53 feet wide (20 feet of road surface).
Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful
in our review of your 401 Certification and Buffer Authorization Certificate.
Please respond within three weeks of the date of this letter by sending a copy of this information to me and to Mr. Steve Mitchell,
Raleigh Regional Office at (919) 571-4700. If we do not hear from you in three weeks, we will assume that you no longer want to

NC-DWQ's current policy does not require mitigation for wetland and stream channel
impacts below 1 acre and 150 linear feet. Because the proposed impacts resulting from
this project do not exceed the aforementioned thresholds, S&EC believes that wetland or
stream channel mitigation should not be required. The US Army Corps of Engineers and
NRCS previously approved the use of an agricultural !exemption for this project.

Dear Mr. Dorney,
On behalf of Creekside Properties (property owner), we hereby request written
concurrence from the NC Division of Water Quality (NC-DWQ) that this proposed road
crossing at Creekside Farms (on White Oak Swamp) complies with the Tar-Pamlico
River Basin buffer rules. Since this project qualifies for an agricultural exemption, it
does not require a Nationwide Permit with the US Army Corps of Engineers. A Pre-
construction Notification Application (PCN) is attached, as well as a letter from
Creekside Properties giving S&EC permission to act on its behalf.
In summer 2000, the proposed road crossing area was walked with the US Army Corps of
Engineerrs (Jean Manuele and Todd Tugwell) to determine the site(s) along White Oak
Swamp with the least jurisdictional wetland areas in order to avoid and minimize
impacts. An area was with no jurisdictional wetlands, other than the stream channel
itself, was determined, and the proposed road crossing will cross the stream
perpendicularly at tlus location.
Since Creekside Farm is bisected by White Oak Swamp, workers at the east side of the
property must travel approximately 7-8 miles on State Highways and Roads with heavy
farm machinery to access the west side of the property, and vice-versa. The proposed
road crossing in the middle of the property would obviously be safer for the workers,

more economical for the farming operations, and would likely help alleviate traffic on
neighboring roads (including NC Highway 44).
Construction of the road will impact only the jurisdictional channel; no jurisdictional
wetlands will be impacted. This road will impact 53 linear feet (40' culvert + 13' rip-rap)
of stream channel, which is subject to the Tar-Pamlico River Basin Buffer Rules.
According to engineers' specifications, approximately 4,000 square feet (0.09 ac.) of
riparian buffer (Zone 1, 2400 sq. ft./Zone 2, 1600 sq. ft.) will be impacted by the
proposed road. It is important to note that no wetlands will be impacted at this road
crossing.
NC-DWQ's current policy does not require mitigation for wetland and stream channel
impacts below 1 acre and 150 linear feet. Because the proposed impacts resulting from
this project do not exceed the aforementioned thresholds, S&EC believes that wetland or
stream channel mitigation should not be required.

Oak Swamp to the other. This is necessary because without this road crossing, farm
workers must travel approximately 7-8 miles on State Highways and Roads (often with
tractors and other heavy farming machinery) to access one side of the property from the
other. This is warranted from an economic and safety standpoint.
14. State reasons why it is believed that this activity must be carried out in wetlands
(include any measures taken to minimize wetland impacts): The applicant requested
a thorough investigation of the proposed road crossing project in order to avoid and
minimize impacts to jurisdictional waters of the U.S. and wetland impacts. Channel
impacts as a result of the roadway crossing were necessary in order to provide access of one
side of the site with the other over White Oak Swamp. All other wetlands areas on the
property were avoided.

1. In Eastern Piedmont add 25 lb/acre Pensacola Bahiagrass or 10lb/acre

2. After Aug. 15 use unscarified sericea seed.
3. Where a neat appearance is.dosired, omit sericea and substitute 40
lb/acre Bahiagrass or 15 Ib/acro Bermudagrass.
4. To extend spring seeding dates into June, add 15 lb/acre hulled Ber-
mudagrass. However, it is preferable to seed temporary cover and seed
fescue in Sept.
Nurse plants
Between May 1 and Aug. 15, add 10 lb/acre German millet or 15 lb/acre
Sudangrass. Prior to May 1 or after Aug. 15, add 40 lb/acre rye (grain).

Soil amendments
Apply lime and fertilizer according to soil tests, or apply 4,000 lb/acre
ground agricultural limestone and 1,000 Ib/acre 10-10-10 fertilizer.
Mulch
Apply 4,000-5,000 lb/acre grain straw, or equivalent cover of another
suitable mulching material. Anchor mulch by tacking with asphalt, roving,
or netting. Netting is the preferred anchoring method on steep slopes.
Maintenance
Refertilize in the second year unless growth is fully adequate. May be
mowed once or twice a year, but mowing is not necessary. Reseed, fertil-
ize, and mulch damaged areas immediately.
