APPROVAL OF 401Quality Certification and ADDITIONAL CONDITIONS and Neuse River Buffer Rules

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to impact
0.04 acres of wetlands, 20 linear feet of streams and 0.45 acres of stream buffers to construct the
Tealbrook Subdivision at Narwell Road, as you described in your application dated January 16, 2001.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Numbers 3288 and 3287. These certifications allow you to use Nationwide Permit Numbers
12 and 39 when the Corps of Engineers issues them. This approval is also valid for the Neuse River
buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits
before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when
the accompanying 404 or CAMA permit expires unless otherwise specified In the General
Certification.
This approval is only valid for the purpose and design that you described in your application except
as modified below. If you change your project, you must notify us and you may be required to send us a
new application.. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as described in
15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide
Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you
must follow the conditions listed in the attached certification and any additional conditions listed below.
1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and
waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance
for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the
date of this letter or the issuance of the 404 Permit (whichever is later).
2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream
buffers.
3. Impacts to the stream buffers to lots 9, 10, 11, 12 and 14 and 22 are not allowed. If these lots cannot be
constructed without buffer impacts, additional written DWQ approval is needed.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.

Enclosed is a Nationwide Permit 12 and 39 application for the Tealbrook Subdivision. Stream crossings and some wetland impacts
will be necessary to construct a proposed roadway and sewer. However, care was taken with the layout of the roadway and sewer to
minimize impacts to these areas.
The attachments listed at the bottom of this page should provide the necessary information for proper evaluation of this project. A
request for an Authorization Certificate for Ncuse Buffer impacts is also included in this package. Steve Mitchell has already visited
the site and the Ncuse Buffer map is based on his site decisions for the applicability of the Ncuse Buffer Rules. Please do not hesitate

Dear Mr. Dorney,
BLUE: Land, Water, Infrastructure, PA (BLWI) has been contracted by DAMY, Inc. to provide permitting and certification services
in support of proposed construction activities on a 20 acre site off of Barwcll Road in Raleigh, NC. The proposed activities that will
impact buffer areas include the construction of a road and a sewer line needed for a residential development. Engineering drawings,
prepared by Bass, Nixon, & Kennedy, Inc., Consulting Engineers, showing the proposed construction and resulting impacts have
been included in this package.
The buffer impacts of this project include:
a total of 0.31 acres temporary impact for one road and one sever line crossing
0.08 acres permanent impact for the road crossing
- 0.07 acres temporary zone 2 impact for a sever line
0.45 acres total buffer impacts
There are a total of five (5) buffer impact areas for the project:
Impact area #1 is a stream crossing associated with the main road for the development. This stream was designates as non
significant by the US Army Corps of Engineers. The total buffer impact for the crossing is 138 feet. The total size of this impact is
0.23 acres, however, as most of this area will merely be graded and revegetated, only 0.08 acres will permanently impact the buffer.
As per Item 6 of the Ncuse Buffer Rules, this impact is designated as allowable as a road crossing impact of greater than forty (40)
feet but less than 150 feet and one-third of an acre.
Impact area 42 is a small (0.02 acres) area in zone 2 that will be graded and revegetated. This type of impact is designated as
exempt in the Item 6 (Table of Uses) of the Ncuse Buffer Rules.
Impact area #3 is a 0.07 acre temporary impact in zone 2 associated with the installation of a sewer line. This section of the sewer
line has been positioned to limit buffer impact to zone 2 only. This impact is designated as allowable, under the Item 6 Table of
Uses, as a non-electric utility line impact, other than perpendicular crossings, in zone 2 only. As much of the impact area as
possible will be revegetated when construction is complete. However, a small portion of this section of the sewer line crosses a non
significant jurisdictional stream passing through the buffer (sce Wetlands Impacts Map). The steep slope and incision of this stream
will require some rip rap to ensure the stability of the crossing and the banks. As this stream extends to the property boundary, this
crossing and associated impacts will be necessary to connect the sc%vcr line to the planned residential area.

Impact areas 44 and 45 are a combined impact associated with a stream crossing for the sewver line. The sewver line crosses the
stream at a 77 degree angle to the centerline of the stream. Impact area #5 is labeled separately only to make it clear that this
portion of the crossing is off of the property and confined to an adjacent sewer casement. This extension is required to connect to an
existing pump station. When installation of the sewer line is complete, the area will be restored and revegetated to the maximum
extent possible. This impact is designated in the Item 6 Table of Uses as exempt as a non-electric utility line crossing that is
perpendicular and disturbs less than 40 linear feet of buffer with a maintenance corridor of 10 feet or less. The total size of this
crossing is 0.13 acres.
In summary, considerable effort has been taken to limit buffer impacts for this project to the extent possible. As a result, all required
buffer impacts for this project are designated as exempt or allowable in the Item 6 Table of Uses in the Neuse Buffer Rules. All
"allowable" impacts have been designed to ensure that reconfiguration could not further minimize disturbances or impact to aquatic
habitat and water quality without compromising the basic purpose of the project. Sediment and Erosion Control and Storniwater
Management Plans, utilizing such best management practices as temporary sediment basins and stormwater dissipators, are also
being developed to assure that associated NCDWQ requirements are met.
As per the descriptions above and the attached drawings, BLWI would like to request that an Authorization Certificate for Neuse
