APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules with Additional Condition
Dear Mr. Powell:
You have our approval, in accordance with the attached conditions, to place fill in 0.19 acre of wetlands in Zone 1 and 0.21 acres of
wetlands in Zone 2 of Manlers Creek in order to construct a sewer line in Wake County, as described in your revised application received
by the Division of Water Quality on April 6, 2001. Furthermore, we have received your correspondence dated June 4, 2001, in which you
demonstrated that the project had been re-designed to avoid impacts to Zone 1 of the Neuse Buffers, so that buffer mitigation will not be
required. Your project must be built as described in your revised submittal. After reviewing your application, we have decided that this
work is covered by General Water Quality Certification Number 3289, which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetiands . This Certification allows to use Nationwide Permit Number 14 when the Corps of Engineers
issues it. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 2B .0233). In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge, State Stormwater and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 permit expires unless otherwise specified in the General Certification. This Certification replaces the one issued to
you on April 17, 2001.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you must
notify us in writing and you may bp. required to send us a new application for a new certification. If the property is sold, the new owner
must be given a copy of the Certiflcation and approval letter and is thereby responsible for complying with all conditions. If total wetland
fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed
below:
1. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through the protected stream
buffers.
2. Unless the utility line is moved south to avoid impact to Zone 1, compensatory mitigation will be required. DWQ must be copied
on a written decision regarding this matter before impacts occur.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days
of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1508 of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.

Project consists of construction of a gravity collection system for the subdivision as well as 3,500 feet of
Sewer outfall line along the Mahlers Creek Basin. A pump station will possibly be constructed to pump the
wastewater into a nearby sewer collector. The decision rests upon whether the Mahlers Creek r€ avity
outfall line is lengthened to serve more of the downstream basin. The construction will be achieved using
backhoes and excavators. Some blasting will be required to lay the lines through rock outcroppings.
13. PURPOSE OF PROPOSED WORK: The proposed project will satisfy state law requiring that annexed
areas be provided public utilities. Project completion date is Jan. 30, 2002.

Enclosed are seven (7) revised copies of a Pre-construction Notification Application
for Nationwide Permit #12 to install utility lines in the Neuse River buffer zone of
Mahlers Creek in Garner. The revised application reflects changes in the method of
construction. The original application called for borings at creek crossings.
The project to install a gravity sewer outfall line along Mahiers Creek consists of two
open cut tributary crossings and an aerial crossing over Mahlers Creek. The
tributaries flow intermittently but are depicted on the USDA Soil Survey maps. All
but a small portion of the remainder of the project is outside of the 50 foot buffer
zone. The project now affects 0.19 acres in the 0-30 foot buffer zone and 0.21 acres
in the 30-50 foot buffer zone. The construction is adjacent to 120 linear feet of
stream bank on Mahlers Creek and the two intermittent flow streams.
A check for $200.00 is enclosed to pay the fees incurred for the review process.

Dear Mr. Powell:
You have our approval, in accordance -with the attached conditions, to place temporary fill
material in less than 0.1 acres of wetlands or waters for the purpose of constructing a sewer line at
Bainbridge subdivision New Rand Road as you described in your application dated January 31, 2001.
After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3288 This Certification allows you to use Nationwide Permit Number 12 when the
Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC
2B .0233). In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater,
Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. This approval shall expire when the corresponding Nationwide Permit
expires or as otherwise provided in the General Certification. If total wetland fills for this project (now
or in the future) exceed one acre, compensatory mitigation may be required as described in 15A
NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

the project referenced above. Mr. Powell forwarded a copy of your letter dated
January 25, 2001 to our office. In response to your comments, seven copies of the
section of the sewer line between stations 28+00 and 29+00 are enclosed. Seven
copies of the area in question are enlarged to better see the text.
Due to the mitigation requirements necessary when intruding into the 50-foot buffer
zone, the 8" sewer line will be dry bored from outside Zone 2. This method of
construction will eliminate impacts into the Neuse Buffer.

On January 17, 2001, the NC Division of Water Quality (DWQ) received your application for
a 101 Water Quality Certification and Neuse Buffer Approval for the proposed Town of Garner
wastewater improvements adjacent to Mahler's Creek in Wake County. In accordance with 15A
NCAC 2B .0233, a thorough inspection of the site has been conducted by staff of the DWQ Central
Office. Based upon our review, we have determined that parallel impacts are proposed within
Zone 1 between Stations 28+00 and 29+00. Please review your plans and move the parallel
impacts outside of Zone 1, and provide us revised drawings showing that no impacts will occur
