The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. In order to protect juvenile shrimp, finfish, and crab populations, no excavation or filling will be permitted between the dates of April 1 and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management, in consultation with the Division of Marine Fisheries. 3. All excavated materials will be confined above mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. 4. All excavated materials will be confined landward of the *mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 5. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. 6. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 7. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. 8. Excavation will not exceed -8 feet below the elevation of mean low water (MLW). 9. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 10. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 11. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 12. The permittee shall comply with the attached list of United States Coast Guard Regulations. 13. No excavated or fill material will be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. 14. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 2 15. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required State/Federal coordination. 16. This Department of the Array permit does not obviate the need to obtain other Federal, State, or local authorizations required by law. 17. This permit does not grant any property rights or exclusive privileges. 18. This permit does not authorize interference with any existing or proposed Federal project. 19. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. PROJECT SUMMARY: The Homeowners Association wishes to obtain a permit for maintenance dredging of their existing boat basin and access channel. Masonboro Harbour Homeowners Assoc. Page Two 9. PROJECT DESCRIPTION The project site is the existing community marina for Masonboro Harbour subdivision, located at the end of Masonboro Harbour Drive, off of Old Myrtle Grove Sound Road, adjacent to Myrtle Grove Sound, in New Hanover County. The original marina basin and channel excavation was authorized in, 1988, under State Permit #7-88. The boating facility consists of a boat basin, approximately 265 feet long and 190 feet wide, and a canal/access channel, approximately 966 feet long and 30 feet wide. The majority of the basin and channel are stabilized by a verticle wooden seawall, except that the north side of the basin is stabilized by diagonal concrete. The seawall that stabilizes the entrance channel becomes free-standing as it intersects with open water of the Atlantic Intracoastal Waterway (AIWW). There are thirty-eight (38) boat slips arranged along floating docks and finger piers, within the community boat basin. In the project area, the waters of Myrtle Grove Sound are classified as SA-ORW, by the NC Division of Water Quality, and they are OPEN for the harvest of shellfish, except within 200 feet of the Masonboro Harbour docking facility. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The applicants are proposing maintenance dredging of their existing facility. The applicants would use a hydraulic pipeline dredge to complete maintenance excavation of the boat basin (265 ft. X 190 ft.) and the entrance channel (966 ft. X 30 ft.). The applicants are requesting a final project depth of -6 feet at mean low water QvILW). The project would generate approximately 7,000 cubic yards of spoil material. The spoils disposal area would be an existing spoils island, located on the adjacent property to the north of the project site. This spoils disposal site is currently authorized for use by Maurice Emmart, under State Permit #2481. The applicants have included in their application, permission from Mr. Emmart to utilize the site. The existing diked area is approximately 370 feet long by 160 feet wide. 10. ANTICIPATED IMPACTS The proposed project would result in the disturbance of 79,330 square feet of previously dredged shallow bottom. The deposition of excavated sediments would disturb 59,000 square feet of an existing highground spoils disposal area. The project would create approximately 7,000 cubic yards of spoils materials. There would be increased turbidity levels during project activity, however, if timed to avoid periods of peak biological activity, no long-term adverse impacts are anticipated. Masonboro Harbour Homeowners Assoc. Page Two 9. PROJECT DESCRIPTION The project site is the existing community marina for Masonboro Harbour subdivision, located at the end of Masonboro Harbour Drive, off of Old Myrtle Grove Sound Road, adjacent to Myrtle Grove Sound, in New Hanover County. The original marina basin and channel excavation was authorized in 1988, under State Permit #7-88. The boating facility consists of a boat basin, approximately 265 feet long and 190 feet wide, and a canal/access channel, approximately 966 feet long and 30 feet wide. The majority of the basin and channel are stabilized by a verticle wooden seawall, except that the north side of the basin is stabilized by diagonal concrete. The seawall that stabilizes the entrance channel becomes free-standing as it intersects with open water of the Atlantic Intracoastal Waterway (AIWW). There are thirty-eight (38) boat slips arranged along floating docks and finger piers, within the community boat basin. In the project area, the waters of Myrtle Grove Sound are classified as SA-ORW, by the NC Division of Water Quality, and they are OPEN for the harvest of shellfish, except within 200 feet of the Masonboro Harbour docking facility. These waters are designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The applicants are proposing maintenance dredging of their existing facility. The applicants would use a hydraulic pipeline dredge to complete maintenance excavation of the boat basin (265 ft. X 190 ft.) and the entrance channel (966 ft. X 30 ft.). The applicants are requesting a final project depth of -6 feet at mean low water (M1W). The project would generate approximately 7,000 cubic yards of spoil material. The spoils disposal area would be an existing spoils island, located on the adjacent property to the north of the project site. This spoils disposal site is currently authorized for use by Maurice Emmart, under State Permit #24-81. The applicants have included in their application, permission from Mr. Emmart to utilize the site. The existing diked area is approximately 370 feet long by 160 feet wide. 10. ANTICIPATED EMPACTS The proposed project would result in the disturbance of 79,330 square feet of previously dredged shallow bottom. The deposition of excavated sediments would disturb 59,000 square feet of an existing highground spoils disposal area. The project would create approximately 7,000 cubic yards of spoils materials. There would be increased turbidity levels during project activity, however, if timed to avoid periods of peak biological activity, no long-term adverse impacts are anticipated.
