After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROTECT DESC TP'i o The project site is located at 229 Gazebo Court, in the Inlet Point Subdivision, off Carolina Beach Rd. (US Hwy 421), adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWR), in New Hanover County. The 1.10 acre property consists of Lots 35 and 36. The property borders the south side of the entrance channel of the Inlet Point Community Boat Basin and the Atlantic Intracoastal Waterway (AIWA) to the east. This property is part of an area that was used as a spoil disposal site for the excavation and expansion of the adjacent channel and boat basin, and has been utilized as a dredge spoils site, in subsequent maintenance projects. Currently, the applicant has constructed and lives in his residence on Lot 35,.and Lot 36 is maintained as a lawn. Both lots are bulkheaded and a retaining wall was installed along the length of the south side of the property to stabilize the higher elevation of the applicant's property (approx. 12' MSL) to that of the adjacent property to the south (approx.6' MSL). Vegetation waterward of the bulkhead, adjacent to the eastern shoreline of the property, consists of Salt Meadow Grass (S ap rtina 12atens) and small shrubs; Wax Myrtle - yrica cerifera), Marsh-elder (Iya fru s e S), and Grounsel-bush Bacc anus h limifclia). Waterward, there is a border of coastal wetlands, approximately 130 feet wide, which is predominately Smooth Cordgrass (Spartina al iflora), but becomes intermixed with high coastal marsh species at the transition to highground. Species include: Black Needle Rush (Juncus roem rianus), Sea Lavender (Limo ium, spp.), and Saltwort (51ho uia, spp.), Spike Grass (Distic lit i ata), and Sea- Oxeye (Borrichia fnrtescens). The Inlet Point basin and channel are closed to shellfish harvest, however, outside of closure area for the marina, adjacent waters are open for shellfish harvest. This area of Myrtle Grove Sound is a designated primary nursery area (PNA), by the NC Division of Marine Fisheries. In the project area, the waters of the are classified as SA, by the NC Division of Water Quality The applicant has existing floating docks in the Inlet Point entrance channel, adjacent to both, Lot 35 and Lot 36. He proposes to install a floating dock, 23 feet long and 6 feet wide, to connect the two existing docks and afford a more convenient access to his boat docking facilities. To provide fishing and crabbing access to Myrtle Grove Sound, the applicant proposes to construct a separate fixed pier off the eastern side of the property. No boat slips would be associated with this structure..' The access portion of the pier would measure 6 feet in width and would extend approximately 265 feet into the sound. At the waterward end of the pier, the applicant is proposing a 20' X 20' T-head platform. The platform would include a roof,. handrails and benches. 10. ANTICIPATED EUPA .TS - The proposed floating dock would incorporate approximately 138 sq. ft. of Public Trust Area. The proposed fixed pier would result in the shading of approximately 120 sq. ft. of mixed high marsh vegetation and approximately 660 sq. ft. of Smooth Cordgrass (Sp rtina ltemiflora). The remaining pier and T-head platform would incorporate approximately 2,332 sq. ft. of Public Trust Area. The project would not extend more than 1/4 the width of the water body and would not exceed the established pier length along the same shoreline or encroach into the required setback from the federal channel. PROTECT DESCRIPTION The project site is located at 229 Gazebo Court, in the Inlet Point Subdivision, off Carolina Beach Rd. (US Hwy 421), adjacent to Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW), in New Hanover County. The 1.10 acre property consists of Lots 35 and 36. The property borders the south side of the entrance channel of the Inlet Point Community Boat Basin and the Atlantic Intracoastal Waterway (AIWA) to the east. This property is part of an area that was used as a spoil disposal site for the excavation and expansion of the adjacent channel and boat basin, and has been utilized as a dredge spoils site, in subsequent maintenance projects. Currently, the applicant has constructed and lives in his residence on Lot 35, and Lot 36 is maintained as a lawn. Both lots are bulkheaded and a retaining wall was installed along the length of the south side of the property to stabilize the higher elevation of the applicant's property (approx. 12' MSL) to that of the adjacent property to the south (approx.6' MSL). Vegetation waterward of the bulkhead, adjacent to the eastern shoreline of the property, consists of Salt Meadow Grass (Spartina patens) and small shrubs; Wax Myrtle (,?yrica cerifera), Marsh-elder (iya fait==), and Grounsel-bush ' ). Waterward, there is a border of coastal wetlands, approximately 130 feet wide, which is predominately Smooth Cordgrass (S,partina altemiflom), but becomes intermixed with high coastal marsh species at the transition to highground. Species include: Black Needle Rush Uuncus roemarianua), Sea Lavender (Limmium, spp.), and Saltwort (Salicornia, spp.), Spike Grass Wistichlis spicata), and Sea- Oxeye (Borrichia frutescens). The Inlet Point basin and channel are closed to shellfish harvest, however, outside of closure area for the marina, adjacent waters are open for shellfish harvest. This area of Myrtle Grove Sound is a designated primary nursery area (PNA), by the NC Division of Marine Fisheries. In the project area, the waters of the are classified as SA, by the NC Division of Water Quality The applicant has existing floating docks in the Inlet Point entrance channel, adjacent to both, Lot 35 and Lot 36. He proposes to install a floating dock, 23 feet long and 6 feet wide, to connect the two existing docks and afford a more convenient access to his boat docking facilities. To provide fishing and crabbing access to Myrtle Grove Sound, the applicant proposes to construct a separate fixed pier off the eastern side of the property. No boat slips would be associated with this structure. ` The access portion of the pier would measure 6 feet in width and would extend approximately 265 feet into the sound. At the waterward end of the pier, the applicant is proposing a 20' X 20' T-head platform. The platform would include a roof, handrails and benches. 10. ANTICIPATED Il"ACTS The proposed floating dock would incorporate approximately 138 sq. ft. of Public Trust Area. The proposed fixed pier would result in the shading of approximately 120 sq. ft. of mixed high marsh vegetation and approximately 660 sq. ft. of Smooth Cordgiass (Spa l ina alterniflora). The remaining pier and T-head platform would incorporate approximately 2,332 sq. ft. of Public Trust Area. The project would not extend more than 1/4 the width of the water body and would not exceed the established pier length along the same shoreline or encroach into the required setback from the federal channel.
