Easley, Governor Sherri Evans-Stanton, Acting Secretary Susan Hatchell Landscape Architecture & Park Design 743 West Johnson Street, Suite E Raleigh, NC 27603 January 9, 2001 DWQ Project # 01-0019 Wake County Re: Neuse River Riparian Buffer Confirmation Boat Rental Facility Relocation, Lake Benson Park, Garner, Wake County Swift Creek (Lake Benson) [03-04-02; 27-43-(5.5); WS-III NSW CA] Dear Ms. Hatchell, On January 4, 2001, the Division Staff attended a site meeting on the subject property to determine the applicability of the Neuse River Riparian Buffer Protection Regulations (15A NCAC 2B .0233) and to provide you with information on how the regulations would potentially effect the Boat Rental Facility Relocation Project. The Division has determined based on this meeting that Lake Benson (including the "lagoon" areas identified on both "Scheme A & B" provided during the site meeting) is subject to the protected riparian buffers. The protected riparian buffers begin at the most landward limit of the normal water level and extend landward a distance of 50 feet. Two plans, Scheme A and B, were presented during the meeting. Impacts associated with Scheme A include the pedestrian trail / walkway to the dock facility. Impacts associated with Scheme B include the pedestrian trail /walkway and boat storage area. These impacts would require written authorization from the Division per 15A NCAC 2B .0233(8) prior to construction. Buffer mitigation would most likely not be required for these activities. Any vegetation management (including pruning) will need to comply with the use identified within 15A NCAC 2B .0233(6). If compliance can be achieved, then written authorization is not required for the vegetation management. This office recommends that any know vegetation management plan be included within the request for written authorization for the pedestrian trails. This letter only addresses the applicability of 15A NCAC 2B .0233(3) and does not authorize any activity within the protected buffers. Nor does this letter address any other Federal, State or Local regulations including the 404 /401 Wetland Permit and Water Quality Certifications.
