Subject: DWR 20190089 Vulcan Materials Company Lenoir Quarry - Additional Information
Request
The Division of Water Resources (Division) has performed a preliminary review of a 401 Water Quality Certification
application submitted for the above referenced project dated July 12, 2019 and received on September 4, 2019. The
Division has determined that your application is incomplete and cannot be processed. The application is on -hold until
all of the following information is received:
1. Please provide a site plan showing the boundary of the proposed overburden in relation to Impact S1. [15A
NCAC 02H .0502(g)]
2. Please locate all wetlands, streams, and other waters of the State as overlays on the site plan. [15A NCAC 02B
(b)]
3. Please provide more details regarding avoidance and minimization of the proposed 122 linear feet of
intermittent stream impacts for this project. [15A NCAC 02H .0506(f) and (g)]
• This Office believes that the proposed overburden can be moved or reconfigured to avoid and minimize
the impacts to the intermittent stream. Please revise the plans to minimize the impacts or provide a
detailed explanation of why this plan for the activity cannot be practically accomplished, reduced or
reconfigured to better minimize disturbance to the intermittent stream.
• This should include alternative designs and layouts for the disposal of overburden.
4. Please provide a site plan with details regarding the proposal to create 53 linear feet of new stream channel to
redirect perennial waters (UT to Lower Creek) away from the sediment basin and into Lower Creek. Please
provide written verification that US Army Corps of Engineers is not requiring a permit for this work, and whether
project activities to create 53 linear feet of new stream channel is considered exempt or non -notifying by
USACE.
Pursuant to Title 15A NCAC 02H .0502, the applicant shall furnish all of the above requested information for the proper
consideration of the application. If all of the requested information is not received within 45 calendar days of receipt of
this email, the DWR will be unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the DWR for approval, including a complete application package and the appropriate fee.
