Residential Structures on Existing Lots on Barrier Islands [15A NCAC 2B.0259(9)(b)] with ADDITIONAL CONDITIONS
Dear Mr. Esham,
You have our approval, in accordance with the conditions listed below, to impact ± 400 ft2 of Zone 1 and ± 1,000 ft2 of Zone 2
of the protected riparian buffers for the purpose of constructing the proposed single family residential dwelling. This letter shall act as
your approval for the use of the "Major Variance; From the Tar-Pamlico Riparian Buffer Rules for the Construction of Residential
Structures on Existing Lots on Barrier Islands" approved by the Environmental Management Commission (EMC) on April 13, 2000. In
addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited
to) Sediment and Erosion Control and CAMA permits.
This approval is only valid for the purpose and design that you described in your Major Variance Request dated 10/10/00 and
received by this office on 11/3/00 with additional supportive material received on 2/22/01 except as modified below. If you change your
project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must
be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must
follow the conditions listed below.
I. Additional woody vegetation (native shrubs and trees) shall be planted in all retained areas of the protected riparian
buffer on the property to the greatest extent practicable. (This additional planting may count towards your required
mitigation identified in conditions 4 and 5.)
2. No impacts are permitted within Zone 1 of the buffers except for the area immediately within the foot print of the
proposed house location as identified within the 10/10/00 variance request.
3. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identified
within 15A NCAC 2B .0259(5). Roof drainage from the house shall be directed to vegetated areas at non-erosive
velocities prior to entering the protected riparian buffers. Any additional stormwater located on the remainder of the
property shall be directed as diffuse flow at non-erosive velocities prior to entering the protected riparian buffers. No
new ditching or piping of stormwater through the protected buffers is allowed.
4. Riparian Buffer Mitigation must be provided per 15A NCAC 2B .0260 prior to construction as a condition of this
Major Variance and as required under 15A NCAC 2B .0259(9) for the proposed impacts associated with the house.
This mitigation will require a ratio of 3:1 for the 400 ft2 Zone I impact. Therefore, the required area of mitigation will
be 1,200 ft2.
5. One option to provide this mitigation is to restore (plant native woody vegetation at a density of at least 320
trees/shrubs per acre) on at least 1,200 ft2 of protected riparian area located on the property. If you choose this option,
a mitigation plan must be approved by this office prior to construction. This mitigation plan must include at a
minimum a planting plan indicating types of species to be used and their proposed locations, maps and dimensions
indicating the area that the planting will occur and a planting schedule.
6. If restoration is not an option, another option to provide this mitigation is to make a payment into the Riparian Buffer
Restoration Fund at a cost of $0.96/ft2.

If you decide to choose this option in accordance with 15A NCAC 2B .0260(7), this contribution will satisfy
our compensatory mitigation requirements under 15A NCAC 213 .0259(10). Until the Wetland Restoration Program
receives and clears your check (made payable to: DENR - Wetlands Restoration Program), buffer impacts shall not
occur. Mr. Ron Ferrell should be contacted at (919)733-5208 to make this contribution and if you have any questions
concerning the Wetland Restoration Program. You have one month from the date of this Certification to make this
payment. For accounting purposes, this Certification authorizes payment into the Riparian Buffer Restoration
Fund to compensate for 1,200 ft2 of required riparian buffer mitigation for impacts to 400 ft2 and 50 linear feet
of the protected riparian buffers; 03-03-07 river and subbasin.
If you do not accept any of the conditions of this certification, you may ask for and adjudicatory hearing. You must act within
60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, PO Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection Rules

on Lot 10, is I'd already purchased the blue pr is to construct a 50' x. 70'
dwelling before the variance went into effect. t Beings the sound faces the
front of the house and the canal is on one sidel this is the only way we can
situate this house on the lot. To change the house dimensions would
completely change the whole configuration O 'the house and rooflines. We
have no problem with the 50' set back from t sound, but the 30' set back
down the canal side of the property does pres t a problem.

The above subject variance request has been reviewed by this office. The site is
located adjacent to a canal on Oyster Creek on Ocracoke Island. The site has been
investigated by Division staff.
It is the recommendation of this office that the variance be issued to the applicant.
The applicant has proposed to mitigate the impacts to the buffer area by planting
trees as well as leaving trees not located in the buffer zones in place. It is the
opinion of this office that the applicant mitigate on a 3:1 ratio for the impacts to
zone 1 of the buffer. There is no recommendation for mitigation of the impacts to
zone 2 of the buffer.

MAJOR VARIANCE
From the Tar-Pamlico Riparian Buffer Rules for the Construction of Residential
Structures on Existing Lots on Barrier Islands
This major variance from the Tar-Pamlico River Riparian Area Rules (15A NCAC 2B
.0259) is hereby issued by the NC Environmental Management Commission to construct homes
and related structures such as garages, decks, porches, attached commercial structures and sheds
within Zone 1 or 2 of the riparian buffer on lots existing as of January 1, 2000 on barrier islands
in the Tar-Pamlico Basin of North Carolina as long as the conditions prescribed below are met.
The applicant must submit three copies of the appropriate application form to DWQ staff
that describes how the following conditions of this variance will be met. If these conditions can
not be met, an individual major variance from the Tar-Pamlico River Riparian Area Rules (15A
NCAC 2B .0259) may be sought from the NC Envirommental Management Commission. This
"Major Variance" shall expire on April 13, 2005 unless it is renewed before that time by the N.C.
Environmental Management Commission.
Conditions:
1. Applicants must show that they have met the requirements of 15A NCAC 213
.0259(9)(a)(i)-(iii).
2. The residential lot must have been platted and recorded on or before January 1, 2000.
3. Construction is for residential buildings and related structures such as garages, decks,
porches, attached commercial building and sheds.
4. Impact to Zone 1 [30 feet immediately adjacent to surface water as defined by 15A
NCAC 213 .0259(4)(a)] must be minimized to the maximum extent practical.
5. On-site stormwater management controls must be shown on the application and
stormwater runoff must be directed away from the adjacent surface water; on-site
measures such as sand filters, rain gardens, bio-retention areas, vegetative filter strips
and planting of trees or shrubs along bulkheads must be employed to maximize
pollutant removal. If the applicant is required to obtain a Sedimentation and Erosion
Control Permit or a CAMA Major Permit, then a Stormwater Permit may be required
from DWQ.
6. The lot must be buildable without wetland impact except for driveways and or utility
crossings and any impact on the buffer shall be minimized to the maximum extent
practical.
7. Any new on-site wastewater treatment must not be located within 50 feet of surface
water as specified in 15A NCAC 2B .0259(4)(a).
8. Compensatory mitigation must be done at a 3:1 ratio on a square foot basis for any
impacts to Zone 1. This mitigation may consist of payment at $0.96 per square feet
to the NC Wetlands Restoration Program, planting of an unbuffered area, or
additional planting of a partially buffered location on-site or nearby. Planting plans
must be approved in writing by DWQ.
9. The applicant must receive written approval from DWQ acknowledging that these
conditions have been met before any impacts to the riparian buffer shall occur.
10. The applicant must contact the N.C. Division of Coastal Management or Local
Permitting Officer for any requirements for CAMA Major or Minor Permits.

This permit, issued,on is subject to compliance with the application (where consistent
with the permit), all applicabl regal tions, special conditions and notes set forth below. Any violation of these terms may subject

(1) The bulkhead alignment will approximate the 'me-an high water level except
for the 125 linear feet indicated on the plat, which will not exceed 19
feet.. from the mean high water level.
(2) All 'backfill*material will be obtained from a highground source and confined
behind the permitted bulkhead, except that the spoil derived from the exca-
vation of the access channel may be used for backfill.
(3) The fill material to be placed below mean high water level will be confined
behind the permitted bulkhead.
(4) This permit does not authorize the excavation in front of the proposed
bulkhead'.
(5) No marsh grass will be excavated and/or filled.
(6) All excavated materials (with the exception of that allowed to dry and
then placed behind the bulkhead) will be confined above mean high water
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.
'All work must cease when the permit expires on
July 31, 1989 -
In issuing this permit, the State of North Carolina
agrees that your project is consistent with the North
Carolina Coastal Management Program.
