Box 3136 Greensboro, NC, 27402-3136 APPROVAL of 401 Water Quality Certification Dear Mr. Wyatt: You have our approval, in accordance with the attached conditions, to place fill in 90 linear feet of Buffalo Creek in order to construct proposed storm drainage improvements to the Merritt Drive culverts in Guilford County, as described in your application received by the Division of Water Quality on December 18, 2001, and in additional correspondence received June 8, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289 which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. They have re-designed such that the additional culvert that they have applied for is now to be installed above baseflow (there are 3 existing box culverts carrying baseflow). They have also done away with the excessive rip rap. I put on the staff report that the impacts are for 90 if (the culvert impacts) and did not include the up- and down-streambank stabilization, since it is supposed to be vegetation. I was not quite sure if this was the correct assessment of the impacts. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until we receive this additional information. We are requesting (by copy of this letter) that the U. S. Army Corps of Engineers place your project on administrative hold. (1) Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Documentation such as maps, narratives, economic analyses, that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification request. (2) Please provide documentation detailing your position that the project has been designed such that adverse impacts to surface waters have been minimized and existing uses have been protected to the best of your ability. Merritt Drive Page 2 (3) Additional information is also needed regarding the proposed 84" culvert. Specifically, will this culvert be installed at the same elevation as the existing box culverts and conveying base flow or at a higher elevation to capture only stormwater flow? Is it possible to reduce the linear footage of impact associated with streambank stabilization by utilizing bioengineering methods instead of rip- rap? (4) Since your proposed impacts are greater than 150 linear feet, the project will also require compensatory mitigation as described in 15A NCAC 2H.0506(h). Your mitigation proposal is insufficient since none was proposed. If impacts (culvert plus rip-rap) were reduced to less than 150 linear feet, compensatory mitigation would not be required by the Division of Water Quality. Please respond, in writing, both to this Office and to John Dorney, 2321 Crabtree Blvd., Raleigh, NC 27604-2260 within three weeks of receipt of this letter outlining your intent to proceed with this project or withdraw your application. Does this project involve replacement of an existing bridge with a culvert, or is it a new crossing? This is an existing crossing over Buffalo Creek along Merritt Drive. In recent years, the cross-section of Merritt Drive has been raised, thereby, raising the base flood elevation. The purpose of this project is to get the base flood level back to its original elevation. Currently there is a triple box culvert in place in Buffalo Creek. We are proposing to add an 84-inch RCP culvert to lower the flood elevation. 2. Please provide information and calculations used to determine the culvert diameter and length chosen. Have you determined whether or not this culvert will destabilize upstream or downstream portions of Buffalo Creek? Please find enclosed the flood study output files for your information. The calculations show the velocity downstream of the culvert will increase from 4.3 fps to 5.4 fps following the culvert installation. We feel the protection of the channel will be provided by the rip-rap lining specified. 3. Please provide information on any proposed armoring upstream and downstream of the proposed culvert. In the areas where the stream is to be widened, thereby, disturbing the existing banks, we are proposing to line the proposed banks with class Mr. John Dorney NCDENR May 7, 2001 Page 2 II rip-rap. The grading on the upstream side of the culvert has been reduced to minimize stream impacts. The revised sheet is attached. 4. Please list the total linear distance of stream impact proposed, including the linear feet of stream to be filled by the culvert (not simply the culvert length) as well as rip-rap or other armoring techniques. The total length of stream to be directly impacted by this project is 300 linear feet and does not include the culvert length. See No. 1. We have enclosed additional information as outlined in the responses to each of the comments included in your letter. Comment 1: Please submit Form 7, entitled "Bridge/Culvert Form" (one form per new/revised bridge/culvert). Response 1: We have enclosed a completed "Bridge/Culvert Form" for the "Corrected Effective Model ; the "Existing/Pre-Project Model" and the "Revised/Project Model'% Comment 2: Please submit certified topographic mapping of the 1 % (100-year) and 0.26/o (500- year) annual chance floodplains and floodway for South Buffalo Creek, representing existing and proposed conditions. This mapping should include the locations and alignments of cross sections used in the HEC-2 models. Response 2: We have enclosed topographic mapping of the 1% (100 year) and 0.2% (500-year) annual chance floodplains and floodway for South Buffalo Creek. We have enclosed one map, showing the corrected effective and post project 100-year-- and 500-year floodplains. The locations of our surveyed cross-sections are also shown on the maps. Comment 3: The submitted HEC-2 hydraulic models for South Buffalo Creek should extend upstream of the project area until the revised Base (1% annual chance) Flood Elevation (BFE) coincide with those shown in the effective HEC-2 model within 0.5 foot. Please submit both disk and paper copies of the extended hydraulic modeling. The difference at this section between the "corrective effective" base- flood levels and the "Existing/Pre-Project" flood levels is 0.2 vertical feet. Comment 4: The submitted information on Exhibit No. 1 indicates that the culvert invert elevation A, 771.3 feet, which does not agree with the invert elevation of 770.81 feet used in the pre-project and post-project HEC-2 models. A note on Exhibit No. 1 states that the City of Greensboro vertical datum is 0.77 foot higher than NGVD; nevertheless, a mismatch exists between the map and HEC-2 modeling. Please Investigate this discrepancy and revise and resubmit the HEC-2 models and/or supporting data as appropriate. Response 4: We have field verified the Invert elevations and each model has been revised accordingly. The invert elevations of each of the box culverts varied slightly. Since HEC-2 does not provide a location to Input various Inverts the average elevation of each of the three barrels was used In the hydraulic models. Comment 5: The HEC-2 models indicate that the proposed Merritt Drive culvert addition will cause BFE increases for South Buffalo Creek. Therefore, please submit the following items to comply with NFIP regulations Paragraph 65-12(a): a. an evaluation of alternatives that would not result in any BFE increases, demonstrating why these alternatives are not feasible; b. documentation of individual legal notice to all impacted property owners, explaining the effects of the project on their property; and c. certification that no structures will be Impacted by the increased BFEs due to the proposed culvert addition. Response 5: The addition of the proposed culvert will correct the potential for Increased base flood levels resulting from Improvements to Merritt Drive. Merritt Drive was widened to alleviate congestion and improve the safety of the traveling public. To properly design the road the existing superelevation was extended causing an Increase In the controlling elevation of the road profile. The culvert addition will return the base flood elevations to the original "Corrected Effective Elevations" shown in the attached documentation. As shown on the mapping a structure adjacent to Section 94000 has a finished floor below base flood levels calculated in the "Effective and Corrected Effective" models. The proposed additional culvert at Merritt Drive will maintain the same base flood levels calculated In the "Corrected Effective Model". With the additional culvert no Increases in the base flood levels will occur and notification to property owners would occur only to inform them of a correction In the base flood elevations. Comment 6: Please submit water-surface profiles, annotated mapping, and any other supporting data to reflect any changes due to the concerns listed above.
