APPROVAL of 401 Water Quality Certification and Tar-Pamlico Buffer Authorization Certificate with ADDITIONAL
CONDITIONS
Dear Mr. Taylor,
You have our approval, in accordance with the attached conditions, to place fill within 33.5 linear feet of jurisdictional waters
for the purpose of constructing the proposed road crossing, as described within your application dated 10/20/00 and supportive
information provided with your letter dated 2/26/01. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3106. This Certification allows you to use Nationwide Permit Number 18 when issued by
the US Army Corps of Engineers (USACE). This letter shall, also, act as your Authorization Certificate for impacts to the protected
riparian buffers as identified within the Tar-Pamlico Riparian Area Protection Rules (15A NCAC 2B .0259). In addition, you should get
any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application and supportive information. If you
change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills
for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream or one acre of wetlands, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) and 15A NCAC 2B .0259. For this approval to be valid, you must
follow the conditions listed in the attached certification and any additional conditions listed below.
? All concentrated runoff associated with the development of this project must be converted to diffuse flow at non-erosive velocities
prior to entering the protected buffers. The direct discharge of stormwater through the protected buffers is prohibited.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Dear Mr. Dornev:
I am writing in response to your letter dated 02-02-01 pertaining to additional
information needed for approval of DWQ Project #00-1560. Attached is a copy of your
letter.
1. Reducing the width to 25 ft. would not be feasible for the following reasons. We
want the maximum height of the driveway to be 6 ft. to allow passage (for emergency
reasons) during unusually high water. Two of the recent hurricanes have risen
approximately 9 ft. The requested 33.5 ft. allows for a grassed slope of
approximately 1:2 that would provide filtration for the run off from the road crest.
With this slope, the grass can be mowed. The 33.5 ft. width (and 130 ft. length)
meets Nationwide 18 permit criteria.
2. No road side ditch will be necessary.
3. The US Corps of Engineers Project Manager (William Biddiecome in the
Washington, NC field office) stated that a single culvert would be adequate since
there is no flow across this old existing logging path at usual tides and the natural
drainage is independent on both sides of the road way.

Dear Mr. Taylor:
On December 18, 2000, the NC Division of Water Quality (DWQ) received your application
for a 401 Water Quality Certification for a 30-plus foot driveway across 130 feet of wetlands in
Beaufort County. In accordance with 15A NCAC 213 .0233, a thorough inspection of the site has
been conducted by staff of the DWQ Washington Regional Office. Please provide the following
information so that we can complete our review of your application:
1. Can you reduce the width of the crossing to 25 feet?
2. Will a roadside ditch be installed? If so, have you calculated the effects of the drain on
adjacent wetlands?
3. The installation of a single culvert will restrict water passage to a single point along this
road. Can you install three culverts equally distributed along the road to allow better
passage of water?
Until the information requested in this letter is provided, I will request (by copy of this letter)
that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for
our processing due to incomplete information (15A NCAC 21-1 .0507(h)). Thank you for your

Dear Mr. Taylor:
On December 18, 2000, the NC Division of Water Quality (DWQ) received your application
for a 401 Water Quality Certification for a 30-plus foot driveway across 130 feet of wetlands in
Beaufort County. In accordance with 15A NCAC 2B .0233, a thorough inspection of the site has
been conducted by staff of the DWQ Washington Regional Office. Please provide the following
information so that we can complete our review of your application:
1. Can you reduce the width of the crossing to 25 feet?
2. Will a roadside ditch be installed? If so, have you calculated the effects of the drain on
adjacent wetlands?
3. The installation of a single culvert will restrict water passage to a single point along this
road. Can you install three culverts equally distributed along the road to allow better
passage of water?
Until the information requested in this letter is provided, I will request (by copy of this letter)
that the Corps of Engineers place this project on hold. Also, this project will be placed on hold for
our processing due to incomplete information (15A NCAC 2H.0507(h)). Thank you for your

Dear Mr. Gibbs:
The North Carolina Division of Coastal Management has reviewed the above
referenced application for a Nationwide Permit dated 20 October 2000 pursuant to
Section 307 of the Coastal Zone Management Act of 1972 as amended. Based upon
our review, we have determined that the proposed activity is not within any
designated Area of Environmental Concern and you should therefore comply with the
following conditions:
1. The activity described in the above application qualifies to receive
one of the Nationwide Permits described in 33 CRF Part 330 with the
exception of Numbers 17, 21, 24 and 34 which were found inconsistent
with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from
the North Carolina Division of Environmental Management.

other State authorization and/or permit requirements are met prior to
