On behalf of the applicant, please see the below and attached applicant responses to your requests for
information. Please let me know if you need anything additional. Thanks.
USACE Comment 1) The proposed project includes fill in a stream and wetland areas at the southern margins of the tract
due to a hammerhead turnaround for emergency vehicle use. The need for such access is not disputed, however you
have not demonstrated avoidance and minimization to the maximum extent practicable as required by NWP General
Conditions 23(a) and (b). For example, it appears that all impacts to wetlands and streams could be avoided if the
hammerhead turnaround were shifted to the north by eliminating between 2 and 4 residential units. It is not clear that
project viability is dependent on the inclusion of these 2-4 units, when the overall development proposes 104. Further,
retaining walls could also be used, possibly in combination with eliminating 2 units, to avoid and minimize impacts.
Please provide additional information to this effect, including updates to the PCN/plans as necessary.
NCDWR Comment 1) To document avoidance and minimization, please provide an analysis of reducing the last
townhome units such that the emergency lane would not require fill within the stream or wetlands. Please also provide
an analysis of use of a headwall to avoid or minimize stream and/or wetland impacts. If your analysis includes financial
considerations, please be sure to include the buffer mitigation costs within your analysis as the buffer
impacts would be likely be considered "other than a road crossing" and require mitigation.
Applicant Response: The initial design included a total of 114 units and would have included the additional impact to 90
linear feet of stream and 0.027 acres of wetlands as a result of development stormwater treatment requirements (see
Exhibit 1, attached). In efforts to avoid and minimize the above impact to streams and wetlands, the applicant reduced
the number of units from 114 to 106 such that the stormwater pond would be re -designed to be constructed in high
ground. Based on the above documentation, it is our opinion that the applicant has fulfilled avoidance and minimization
of streams and wetlands to the maximum extent practicable and in accordance with NWP GC 23 (a) and (b).
USACE Comment 2) Based on the project plans, approximately 30% of the drainage area for downstream portions of
Stream SIB would be rerouted to a stormwater pond due to grading. How will this stream retain hydrology to remain
jurisdictional/functional?
Applicant Response: The applicant prefers to not treat stormwater and utilize the upland areas proposed with the
stormwater pond for additional townhome units and in doing so, not direct portions of upland drainage areas from
Stream SB. However, State and Local stormwater regulations require stormwater treatment. Therefore, a
limited portion of Stream SB's upland drainage area must be routed to the stormwater pond. As you have commented
above, the majority of the upland drainage area will still be directed to down -gradient, un-impacted portions of Stream
SB. Furthermore, Stream SB originates at an approximate 15' or more head cut that has intercepted the groundwater
table and will continue to intercept the groundwater table following construction of the proposed project, thus,
providing hydrology to un-impacted portions of Stream SB. Therefore, it is my opinion that the stream will continue to
function as an intermittent stream that will continue to have seasonal fluctuations in hydrology regardless of re-routing
a limited portion of the upland drainage area to a stormwater pond.

Thank you for your PCN and attached information, dated and received 1/14/2020, for the above referenced project. I
have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit 29
(http://saw-reg.usace.army.mil/NWP2017/2017NWP29.pdf). Please submit the requested information below (via e-mail
is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide
Permit or consider your application withdrawn and close the file:
