March 23, 2001 Brunswick County DWQ Project # 001482 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Gregory Taylor Town of Ocean Isle Beach 3 West Third Street Ocean Isle, NC 28469 Dear Mr. Taylor: You have our approval, in accordance with the attached conditions and those listed below, to dredge up to 625,000 square feet of bottoms for the purpose of performing maintenance dredging in canals along the AIWW in Ocean Isle as described in your application dated November 27, 2000 as revised on March 6, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3274. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Dredging shall be done as modified in the March 6, 2001 letter from Criser and Troutman Consulting Engineers. 2. Upon completion of the project, the party in question shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. AMA bF R Michael F. We have spoken with the Town concerning the proposed width of 40' for canal #21 and propose to change the canal width from 40' to 25' feet as an alternative dredge design width with the eastern edge of the dredge cut remaining in the same location. We feel that this revised width will protect against taking any of the wetlands during dredging and would also be a minimum width that the Town could live with. We have also indicated that the dredge limits would shift accordingly where the canal necks- down in order to prevent disturbing of wetlands. We also propose to stabilize the existing 12" diameter CMP stormwater pipe located at the head of Canal #21 by requiring installation rip-rap in order to prevent further erosion around the pipe. The base of the rip-rap would terminate at the end of the pipe and would taper back to meet existing grade. See details on attached drawing. Please let me know if additional drawings are required for your further review or if you need additional information, as the Town desires to actively pursue this project. Otherwise, we trust that you have sufficient information stating our clarifications to the permit application. P.O. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you narrow the proposed dredging of canal #21 in order to protect the wetlands found in this area? Also the head of the canal will need to be stabilized to prevent erosion from the stormwater pipe. Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. Please respond within three weeks of the date of this letter by sending a copy of this information.to me and Ms. Joanne Steenhuis, of the Wilmington Regional Office at (910) 395-3900. If we do not hear from you in three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. In order to protect juvenile fish populations, no excavation or filling will be permitted between the dates of April I and September 30 of any year without the prior approval of the North Carolina Division of Coastal Management. 2. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. 3. All excavated materials will be confined landward of the mean high water (MHW) elevation contour within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 4. The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. 5. A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. No excavated or fill materials will be placed at any time in any vegetated wetlands or waters. 7. No vegetated wetlands will be excavated or filled. 8. Excavation will not exceed -6 feet below the elevation of mean low water (MLW). 9. The temporary placement or double handling of excavated or till materials within waters or vegetated wetlands is not authorized. 10. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United States in the public interest. 11. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of the United States. 12, The permittee shall comply with the attached list of United States Coast Guard Regulations. 13. No excavated or fill material will be placed in any location or in any manner so as to impair surface water flow into or out of any wetland area. 14. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 15. This Department of the Army permit does not obviate the need to obtain other Federal, State or local authorizations required by law. 16. PROJECT DESCRIPTION The Town of Ocean Isle Beach is proposing maintenance dredging of six man-made, "natural" canals and the connecting channels into the Atlantic Intracoastal Waterway. The canals are located between Causeway Drive and Concord Street on the island of Ocean Isle, Brunswick County. In addition, the Town proposes maintenance dredging of two entrance channels into the concrete canal system between Concord and Lee Street (labeled as entrance canal number 8 and 3). These canals were originally constricted prior to 1978. Previous maintenance dredging permits have been issued for all areas with the possible exception of the upper end of Canal #21 near the head of Laurinburg Street. This area was previously separated from the rest of the canal system by a plug. The plug has been mostly removed, but the connection remains narrow and transitions into a natural shoreline with a marsh fringe on both sides of the water body. It is unlikely that this area can be dredged to 40' wide without excavating wetlands. These man-made canals border narrow residential lots developed with single family residences. The "Commercial Canal", # 22, borders Causeway Drive and various businesses. The canals vary in width from 80' - 110' (except as noted above on Canal #21). The shorelines along the canals are almost all stabilized by bulkhead structures. Some lots have Spartina alte iflora marsh between their bulkhead and the open water. These marsh fringes range in width from 0-20'. No disturbance of these marsh fringes is proposed. The applicant is proposing to dredge a channel 40' wide by 6' deep down the center of the canals and out to the deep water connection to the Atlantic Intracoastal Waterway. A typical cross-section of the proposed work is shown on Sheet 3 of 5 of the plans. The proposed dredging would be widened to a flared expansion at the Waterway connection of 80' wide. This 80' flared feature has been requested in previous applications, but subsequently limited to the 40' width due to potential impacts to shellfish resources. An estimate of 16,300 linear feet of canal is to be dredged to a width of 40'. The average existing water depth is -2.3 at low tide. The applicant is requesting to dredge to a depth of -6' at low tide. The consulting engineer estimates that there will be 76,000 cubic yards of spoil material to be excavated to reach the desired -6' low tide depth. The dredging would be accomplished by hydraulic dredge. The Town has permission to pump the spoil material into an existing diked spoil disposal area accessed off of the end of Lee Street. The spoil island has been divided into thirds with an earthen dam separating the western 1/3 that is to be used in this project. This one third portion of the spoil island designated for use is approximately 6.8 acres in size. See Sheet 3 of 5 of the plans for the location of the disposal area and Sheet 4 of 5 for the plan view and cross sections. The project engineer has submitted plans for excavating some of the existing spoil material out of the basin and onto the dam - thereby increasing the height of the dam while creating more storage room for new spoil. Supporting calculations have been submitted for review. The waters of the man-made canals have been classified as SA by the Division of Water Quality. They are closed to the taking of shellfish and are not a designated Primary Nursery Area. However, the adjoining waters of the Atlantic Intracoastal Water are open to the taking of shellfish as determined by the Shellfish Sanitation Section. TOWN OF OCEAN ISLE BEACH Page 3 10. ANTICIPATED EVIPACTS Approximately 652,000 square feet of shallow bottom would be dredged as a result of this proposal. The dredging will result in temporary increased turbidity in the project area. Of the 652, 000 square feet to be dredged, approximately 24,000 square feet has no history of maintenance dredging (although it is a man-made canal). If the dredging of this 24,000 square feet is allowed, the proposed width may need to be significantly reduced to lessen impacts to coastal marsh fringes. Provided the work is done in the Winter during a lower biological activity period, no other long term adverse impacts are expected. Approximately 296,208 square feet of high ground will be filled for the spoil disposal. Sediment Control devices will be necessary around the spoil disposal area until disturbed soil on the dam has been stabilized with vegetation sufficient to restrain erosion. Janet M. These tides have deposited material, thereby resulting in inadequate draft depths in areas along these canals. It is proposed to accomplish maintenance dredging in these canals in the approximate footprint of previous CAMA permits. Project Description It is proposed to use a hydraulic pipeline dredge to remove spoil from these "natural' canals and entrance canals as shown on the maps contained in this application package. All materials excavated will be pumped to the western third of the existing dredge spoil -disposal island located at the end of Lee Street which was also utilized during the previous dredging event in 1996. Pipeline corridors willbe established to ensure that no marsh areas or sensitive vegetation will be crossed in any } case during the .operation. All dredging will be done during the winter season when biological life in the surrounding waters willbe at a minimum. Environmental hnPacts Since the dredging will be performed during minimal activities of biological life, it is our belief that environmental.impacts resulting from the dredging activities proposed in this projectin general will be relatively minimal. The first step in this process is to submit a grain size analysis report on the material to be dredged. The results of the grain size analysis will, in part, determine the need for any additional chemical testing. At least one composite sample, consisting of at least five grab samples, shall be taken at each major shoaling location at the rate of one composite sample per 10,000 cubic yards of material to be dredged. If the project is maintenance, surface grabs are sufficient. If the project involves new work, grabs for the composite sample must consist of full dredging depth cores. .The grain size analysis consists of a minimum of 6 U. S. Standard Sieve Sizes (4,10,40,60,100,and 200) with a gradation plotted for each composite sample (sample included as (Exhibit 3). If the grain size analysis indicates that the average amount of the samples passing the 1200 sieve (i.e. sediment --ner than sand) is 10 percent or less, no additional analysis is required. If greater than 10 percent, an evaluation must be completed to provide an initial determination of the probability or contamination of the material to be dredged (Exhibit -^_) identifies typical considerations. The Grantee will need to contract with qualifed firms for both the grain size analysis and the evalutation for the potential contamination. g. The Grantee shall be responsible for any repairs required to the dike, spillway and/or spillway effluent pipe located within the disposal site as a result of its activities. Repairs shall be completed to the satisfaction of the Wilmington District. h.. The Grantee shall make payment to the Finance and Accounting Officer, U. S. Army Engineer District, Wilmington for disposal material placed on the licensed premises. Payment at shall be shade at the current disposal fee rate of $1..50 per cubic yard. Payment for disposal shall be based on contractor payment invoices or actual before and after dredge surveys and shall be made within 30 calendar days of completing dredging operations. Under certain conditions the disposal fee can be partially offset or waived entirely. If the dikes or spillway requires substantial repairs in order for the disposal area to be usable the Grantee may submit invoices reflecting these costs and receive credit against the disposal fee. Credit will not be given for any repairs to the dikes or spillway required as a result of the Grantees dredging operation. Also, 'if any or all of the dredged material can be removed within 180 calendar days of the completion of the dredging operation, credit will be given at the rate of $1.50 per cubic yard for the amount removed.
