Smith Blvd. Greenville, NC 27835 �&_ NORTH CAROLINA &t0tOt mertfal oudifty February 13, 2020 Subject: Proposed improvements to the NC 43 Connector in Craven County, TIP R-4463A Dear Ms. Workman -Maurer: The Division of Water Resources has reviewed your submittal for a 401 Water Quality Certification and Neuse Buffer Authorization for the aforementioned project. Review of your application revealed it lacking necessary information required for making an informed permit decision. The permit application was deficient in the following areas: • The jurisdictional stream and wetland shown at Site 6 was outside the project limits in the 2014 and 2019 PJD packages and was therefore not reviewed in the field. Please submit an amendment to the PJD package that includes these areas along with the necessary forms and documentation. A follow up field visit may be required. • The portion of the stream south of Highway 17 that is shown at Site 5, and depicted as SA in the PJD package, was determined to be subject to the Neuse Riparian Buffer Rules (15A NCAC 2B .0233) during a field verification on August 19, 2014. Riparian buffers are not shown at this site in the application. Please revise the drawings and impacts to include buffers at this site. • There are several drainage swales shown tying into the buffered streams at Site 5 and Site 6. New ditches are required to provide treatment prior to discharging through the riparian buffer. The information needed to make this determination was lacking in the application. Please provide the swale page of the SMP with the necessary information. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned. Furthermore, until the information is received by the NC Division of Water Resources, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold.
