Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed
below, to place fill material in 15,000 square feet of wetlands and dredging 21,000 square
feet of open water for the purpose of conducting maintenance dredging of an existing boat
basin and across channel at Jones Island Club as described in your application dated
November 10, 2000 and modified on March 16, 2001 (received March 12, 2001). After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3274. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed
regulations. This approval will expire when the accompanying 404 or CAMA permit
expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your
application except as modified below. If you change your project, you must notify us and you
may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and
(7). For this approval to be valid, you must follow the conditions listed in the attached
certification and any additional conditions listed below.
1. The extent of dredging and disposal area shall be as modified in the March 6, 2001 letter
from Bob Chiles to Bill Biddlecome, US Army Corps of Engineers.
2. DWQ shall receive a copy of the proposed mitigation plan once the Corps of Engineers
approve it.
3. Upon completion of the project, the applicant shall complete and return the enclosed
"Certification of Completion Form" to notify DWQ that all the work included in the 401
Certification has been completed. The responsible party shall complete the attached
form and return it to the 401/Wetlands Unit of the Division of Water Quality.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 60 days of the date that you receive this letter.
To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless
you ask for a hearing.

8. PROJECT SUMMARY: Applicant proposes the maintenance excavation of its existing boat basin and
access channel. The basin and channel flow into the Atlantic Intracoastal Waterway approximately one
mile south of the Hobucken Bridge in Pamlico County.
9. NARRATIVE DESCRIPTION:
Project Setting
The applicant's property, known as Jones Island Club, is located east of NC Hwy. 304 approximately one mile
south of the Hobucken Bridge on the Atlantic Intracoastal Waterway (AIWW) in Pamlico County. There is a 15
acre tract on the mainland side and a 1,240 acre tract located on Jones Island.
Currently there is a marina basin, access channel, and boat ramp on the mainland tract and waterfowl
impoundments, barge / landing basin, piers, and hunting lodges on Jones Island. The Club is currently operated
and managed as a private hunting preserve. The applicant proposes to maintenance dredge the boat basin and
access channel located on the mainland side of the property via this permit application.
The boat basin and access channel are not individually listed in the NC Division of Water Quality Classification
Schedule for the Neuse River Basin. As a result the manmade system is incorporated by reference to the
downstream portion of the AIWW which is classified SA NSW. The basin and adjoining AIWW are not
designated Primary Nursery Areas as defined by the NC Division of Marine Fisheries. Additionally, the area is
closed to the taking of shellfish for consumption. The substrate in the project area is a mixture of sand, silt, and
organic material.
High ground at this location was initially created from spoil generated by the excavation of the AIWW. In 1980
CAMA Major Permit No. 39-80 authorized the excavation of a barge slip at this site. Spoil generated from the
project was placed over the existing spoil and graded. The result was an equipment storage / parking area
adjacent to the barge slip. In 1987 CAMA Major Permit No. 223-87 authorized excavation of the existing boat
basin and access channel from adjacent 404 wetlands. This permit also authorized the existing marina dock /
finger piers and boat ramp. Spoil from this project was used to raise the previously filled site approximately one
foot. The construction of the marina, boat ramp, and equipment storage / parking area created a mainland
activity base for the Club. With the completion of the marina basin there was no longer a need for the barge slip.
So in 1993 CAMA Major Permit No. 121-93 authorized the filling of the barge slip and shoreline stabilization
work. The fill created an additional 4000 sq ft. of parking area adjacent to the marina. Several general permits
have been issued over the years for minor maintenance excavation and shoreline stabilization as well.

Project Description
The applicant proposes to perform maintenance excavation of the access channel and marina basin. The propose
channel dimensions will be 150 ft. in length and 80 ft. wide. The proposed basin dimensions are 300 ft. in leng
and 50 ft. wide. Current soundings within the project area indicate a depth of -2.5 ft. below NWL. TI
proposed project depth will be -5.0 ft. below NWL. This depth does not exceed original project specificatioi
authorized in 1987. Excavation will be accomplished via a clam shell or other mechanical excavation techniqu
A large portion of the work is reachable from the existing parking area. The excavation will genera
approximately 2000 yds.' of spoil material.
Spoil material will be off loaded from a staging barge or simply placed by the excavator on the spoil dispos
area. The disposal area is located on the other side of the existing basin opposite the parking area. The dispos
site has been delineated as a 404 wetland and consists of mixed myrtle, maple, gum, and other species indicati,
of these wetlands. The applicant is proposing to install a silt ditch and fence around the disposal area to preve
any runoff to adjacent wetlands or surface waters. The silt ditch will not have a discharge point (see Jones Islas
Club, Inc. - Erosion Control Details Plan). The disposal site covers 61,500 ft.' and is sized for three to fo
subsequent dredging events.
Anticipated Impacts
The proposed excavation will require the removal of ±2000 cubic yards of previously disturbed bottom substrz
from the existing marina basin. The clam shell, barge or bucket type excavation method of removal will like
cause some short term turbidity impacts. The spoil is to be deposited on an adjacent wetland disposal sil

Dear Mr. Biddlecome:
This letter bearing Action ID number 200110122 addresses the proposed maintenance dredging
and discharge of dredge spoil into a 60,000 square foot wetland disposal site adjacent to the marina at
Jones Island Club. It includes your agency's request for information regarding any other alternatives to the
disposal site, justification that the selected plan is the least damaging to water or wetland areas, and any
modification of plans and proposed construction techniques to minimize adverse impacts. The letter also
requests the proposed mitigation plan for the projected loss of wetlands.
A letter from Mrs. Kristie Corson of the NC DENR Division of Coastal Management transmitted by
facsimile on December 8, 2000 lists potential high ground disposal options that she and Mr. Scott Jones of
D.C.M. identified during a December 6 site visit, and requests that they be considered. The letter identifies
the parking lot, access road, highground across the Intracoastal Waterway and suitable local agricultural
land.
During a recent telephone conversation, you also identified removal by truck as the method used
during construction of the marina and questioned why a similar method was not proposed for the
maintenance dredging.
Jones Island Club has successfully established and currently maintains a solid, stable travel
surface on their access road and parking lot. The discharge of saturated silts, sands and marine deposits
onto these areas will create a surface that the Club has worked to eliminate. Additionally, the discharged
material will pose a sedimentation risk to the adjacent marina and waterway if discharged onto the parking
lot.

Highground across the Intracoastal Waterway is not being considered in order to prevent the
possible discharge of dredge spoil into the Intracoastal Waterway. Loading the spoil onto a barge, or barge
mounted truck for transport across the waterway and subsequent unloading presents a sedimentation and
spillage hazard that is preferably avoided.
Local agricultural land is not considered a viable alternative owing to the nature of the dredge spoil.
The spoil will be comprised of sands and silts removed from a salt water environment. Salinity and
accompanying infertility are undesirable traits of a material being considered for application onto
agricultural land. Additionally, Jones Island Club does not own any agricultural land.
Direct removal of the saturated spoil by truck is not being considered because of the anticipated
loss of material during transport. The saturated material and water will spill from a dump truck along most
of the travel path. Trucks were used to haul off the soil removed during the initial marina excavation, but
that material was excavated from the landward end toward the water and was primarily dry consolidated
soils.
As the enclosed drawings indicate, the size of the proposed disposal site has been reduced from
approximately 60,000 square feet to approximately 15,000 square feet. Using the revised dimensions and
the proposed erosion and sedimentation control measures, the disposal site will now only accommodate
the amount of material generated by one dredging operation.
The proposed use of the disposal site is also changed to a temporary nature. Dredge spoil will only
remain within the site until it has consolidated and dried. Once the material is dry, it will be transported
offsite and the disposal site restored to its original grade in preparation for use during future dredging
operations.
The public notice issued by your agency reports that the dredging will be done by a track mounted
hydraulic shovel or moved by a staging barge into the disposal area, and that a large portion of the work is
reachable from the existing parking lot.
As reported in Block 22 of the COE application pertaining to this project, a track mounted hydraulic
shovel will be used to remove the sediment from the marina and place it into the disposal site. To clarify,
the proposed method involves walking the shovel onto the property adjacent to the landward sides, west
and north, between the marina and access channel and the proposed temporary disposal site. The shovel
reportedly has a 60 foot reach, and from that landward position will be able to remove and deposit sediment
all within the circumference of its reach. This method will limit the movement of the shovel theoretically to
one pass onto and a return pass off of the adjacent property, and the majority of the dredging operation to a
swinging motion of the shovel's boom. Working from the landward side as opposed to the parking lot side
will place the shovel in a better position to avoid obstacles created by fuel storage tanks, the boat ramp and
docks, and eliminates having to walk to and from the disposal site with each shovel full of spoil.
As mentioned earlier, we have revised the proposed use of the disposal site to a temporary nature,
and once the dredge spoil has consolidated and dried, it will be removed and the site restored to its original
grade in preparation for use during future dredging operations. None the less, a mitigation plan is still
present. We only request that restoration of the disposal site be considered when determining the amount
of mitigation required for this project.
The wetland mitigation plan for the project consists of expanding a 4,000 sq. ft. mitigation site
created as a condition of CRC permit number 223-87. The mitigation site is located in an uplands area on
Jones Island proper directly across the Intracoastal Waterway. Any area added to the mitigation site will be
excavated to an elevation below that of the existing adjacent wetlands, filled back to adjacent wetland
elevations using organic material, allowed to naturally re-vegetate and permanently retained as a vegetated
wetland area. Native wetland trees and shrubs will be planted to assist re-vegetation as stipulated in the
original permit (ref. (b)).

The letter bearing Action ID number 200110123 addresses the proposed internal dike extensions
within two of Jones Island Club's impounded areas. With the exception of the action id number and the
introductory paragraph, this letter matches the letter regarding the marina project verbatim.
Obviously, there are no upland alternatives to extending an existing internal dike within an
impoundment. However, the total impacted area can be reduced by using the alternate construction
method presented with the original application. For ease of construction and the ability of the soil to sustain
the desired vegetative cover, the published method is preferred. Soil from the areas immediately adjacent
to the proposed dike alignment are, in effect, re-graded to generate a four foot high dike with adjacent
swales. As reported in the public notice, this method includes the excavation of 124,582 square feet and
placement of the excavated material within 98,466 square feet of DA jurisdictional wetlands.
Regardless of the method utilized for this project, the mitigation plan remains the same as stated
earlier in this letter.
We request however, that if the published method is permitted, please consider the fact that the
disturbance to the 124,582 square feet is fundamentally a re-grading of that area, and the impact to it will
only be temporary, when deciding upon the amount of mitigation required for the project.
