I received your letter regarding Mr. bowen's property on December 28th, 2000. I had filed a permit on November 8, 2000 for 401 Water Quality Certification to fill 0.42 acres of wetlands on the above mentioned site. Due to incomplete information you requested that the Corps of Engineers put this project on hold. I beleve that I have all of the data you need for the permit that was missing including: aerial photograph of property and stream, Stormwater plan with details of placement of the pipe in the channel and rip rap, and a detailed subdivision map noting fill areas. In accordance with 15A NCAC 2H.0506, a thorough inspection of the site has been conducted by Ms. Joanne Steenhuis of the DWQ Wilmington ]regional Office. Ms. Steenhuis reports that there is a stream on the property that is not mentioned in the PCN form or other materials included with your application. If impacts to this stream are Iroposed, you should specify the linear distance of stream impact, including tiny length of pipe into which you propose the bury the stream as well as rip-rap. Please provide detailed maps ilustrating and quantifying all stream impacts proposed for this project. We suggest that you use tae appropriate NRCS soil surveys, USGS topo maps, or other types of maps to illustrate all stream tend wetlands impacts in sufficient detail, and clearly indicate all property lines and plats within the subdivision. If there are no impacts proposed for the stream on this property, please state so. J'urthermore, please discuss how you intend to treat stormwater on the site. Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Stevens Division of Water Quality March 7, 2001 New Hanover County DWQ Project # 001419 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Tom Bowden #4 Par Court Garsonville, MD 21638-9664 Dear Mr. Bowden: You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.1 acres of wetlands for the purpose of constructing road crossings at Tom Bowden's Land at Edgewater Club Drive and Oyster Point Drive as described in your application dated November 8, 2000 and revised on January 11, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control. Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Wetland fill is not allowed on lots 3, 4, 11 and 12. The purchases of these lots must be given a copy of this certification so they are aware of this restriction. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611- 7447. This certification and its conditions are final and binding unless you ask for a hearing. I received your letter regarding Mr. Bowen's property on December 28th, 2000. I had filed a permit on November 8, 2000 for 401 Water Quality Certification to fill 0.42 acres of wetlands on the above mentioned site. Due to incomplete information you requested that the Corps of Engineers put this project on hold. On January 10, 20011 mailed to you all additional information you require for this permit. As of today, February 26, 2001 we would like to resubmit the permit for this site after learning the wetland impacts necessary for subdivision development can be reduced. After site inspection for placement of septic systems we feel it is no longer necessary to fill in any of the lots containing wetland areas. However, we still need to fill .10 acres of wetlands associated with the road crossing, including placement of pipe in the channel.
