Project Number 98-4082 APPROVAL of Neuse River Buffer Rules AUTHORIZATION CERTIFICATE Dear Ms. Burdette, You have our approval, in accordance with the attached conditions, to impact the protected riparian buffers for the purpose of constructing the proposed greenway trail associated with the subject property as described within your application and proposed site plans (Figure 3) dated 3/9/01. In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control and Non-Discharge. This approval is only valid for the purpose and design that you described in your application and attached site plans dated 3/9/01 and initialed by me on 5/18/01. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below as well as any other conditions identified within 15A NCAC 2B .0233. 1. Diffuse flow of all stormwater at non-erosive velocities shall be obtained prior to entering the protected stream buffers as identified within 15A NCAC 2B .0233(5). 2. Deed notifications or similar mechanisms shall be placed on all retained buffers to notify the State in order to assure compliance for any future buffer impacts. These mechanisms shall be put in place within 60 days of the date of this letter. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Project #: 98-4082 DWQ Project #: 001062 Dr. Mr. Dorney: On behalf of the property owner and developer, George Jordan, III, S&EC requests written concurrence (authorization certificate) from the NC Division of Water Quality for a revised, proposed greenway easement (Alternative #3) through the proposed Buckhurst West Subdivision. Please refer to Figure 1 for the location of the proposed subdivision on a USGS topographic map. The Town of Cary requires Mr. Jordan to dedicate an acceptable easement for future construction of a greenway that connects Northwoods Elementary and its surrounding neighborhoods to Godbold Park. The Town of Cary plans to develop a skateboard facility in association with Godbold Park and seeks to provide good neighborhood access to the proposed facility. Cary will construct the future greenway trail in accordance with the standards established by the NC Office of Bicycle & Pedestrian Transportation. As you know from our February 20th request, Mr. Jordan has already evaluated two alternative alignments for the proposed greenway. These proposed greenway alignments are shown on the attached Figure 2. Mr. Jordan and the Town of Cary are pleased to submit a third alternative alignment that we all feel is the most practical alternative for construction of the proposed greenway. It is depicted on the attached Figure 3. All three of the alternatives are identical from the southeast corner of Mr. Jordan's property north along an intermittent tributary to the crossing of a perennial stream downstream of the confluence of the two streams. Attached is a letter prepared by Mr. Jordan's engineer, Daniel W. Blackburn, which explains the constraints involved in designing the trail within the first two alternatives. Essentially, Mr. Blackburn attempted to locate as much of the trail as possible outside the 50-foot buffer. However, locating the easement outside the buffer in some areas would place the trail too close to proposed homes and decks. In those areas Mr. Jordan proposes to locate the 20-foot-wide greenway easement in the outermost portion of Zone 2 of the buffer and establish an additional 10 feet of buffer upslope of the trail. This will provide a screen of forested vegetation between the trail and homes and decks while maintaining a total of 50 feet of riparian buffer adjacent to the stream. The 10-foot-wide, paved trail will be centered within the 20-foot-wide easement. Utilizing the previously permitted Northwoods Drive crossing of the buffered channel also minimized impacts along this portion of the trail. The trail perpendicularly crosses an unnamed tributary of Lake Crabtree along the northeast boundary of the proposed subdivision to avoid a steep slope. If the trail were routed south around this slope, it would place this portion of the trail next to a cul-de-sac outside the natural area characteristic of greenways and eliminate two entire lots. This crossing is also required to provide a future connection point with a proposed greenway that will run east along the unnamed tributary to Lake Crabtree. All three alternatives involve the next section of the trail that runs northwest along the perennial stream to Godbold Park. The first alternative evaluated consists of utilizing the existing sanitary sewer (SS) easement for the location of the proposed greenway. Unfortunately, the SS easement crosses five existing residences between the homes and the perennial stream and portions run parallel within Zone 1 of the riparian buffer. In two places along the SS easement there is inadequate space to construct the greenway due to two meanders that bring the outside, unstable stream bank within approximately 8 feet of the south side of the SS easement. Using the north side of the SS easement would place the trail in the backyards of three existing homes that already have limited space. Please refer to Photographs 1 - 6 for examples of the limited space available at lot numbers 1 through 3 and the proximity of the SS easement to these existing homes. This alternative would then cross the perennial stream that separates Mr. Jordan's property from Godbold Park. Based on the constraints explained above, we believe that alternative I is not a practical alternative. Alternative 2 consists of crossing the unnamed tributary of Lake Crabtree in two places to avoid the SS easement within Zone 1 and the constraints of the existing homes on lots 1 - 3. However, this proposed alignment would require crossing the same perennial stream three times before crossing the remaining perennial stream to connect to Godbold Park. We understand from discussions with Mr. Bob Zarzecki of the NC Division of Water Quality that this many crossings within such a short span would not be acceptable. Alternative 3 also crosses back over the perennial stream. However, this alignment stays on the south side of the stream and for the most part is located outside of the riparian buffer. It includes a perpendicular crossing of an intermittent stream and encroachment into Zone 2 within a previously approved SS easement before perpendicularly crossing the remaining perennial stream to connect to Godbold Park. Alternative alignment 3 March 9, 2001 S & EC Project #: 98-4082 Page 3 of 3 provides the natural setting characteristic of greenways, access to recreational areas within the proposed Buckhurst West Subdivision, and access to Godbold Park and avoids the existing structures and topographic constraints presented by the project while minimizing impacts to natural resources. In order to satisfy the Town of Cary's requirements for the proposed Buckhurst West Subdivision plan, Mr. Jordan needs written concurrence from the NC DWQ indicating that no practical alternative exists to alternative 3 of the proposed greenway alignment. Basically, the Town of Cary is requiring Mr. Jordan to dedicate an easement that complies with the requirements of the Neuse River Basin Riparian Buffer Rules. It is important to note that Mr. Jordan has already received 404 and 401 approval for the proposed Northwoods Drive stream and buffer crossing. The Town's standard greenway is a 10' paved trail within a 20' easement. The horizontal alignment requires 95' minimum radius on all curves. The attached plan shows the proposed location of the greenway within the project. The trail begins at the southeast corner of the property and runs adjacent and parallel to the property to the extension of Northwoods Drive. A portion of the width of the trail will encroach into zone 2 of the stream buffer. This encroachment consists of 495 square feet of paved trail. To prevent this encroachment, the trail would need to move onto the Masino property, which is not within the control of Mr. Jordan. The Northwoods Drive buffer crossing has previously been approved. To prevent a stream crossing with the greenway trail, Northwoods Drive will be used as part of the trail. On the north side of Northwoods Drive the trail is located in zone 2 along the back of lots 46, 47, and 48. An additional 10 feet of width has been added to the stream buffer in this area. The trail width is 10 feet. Thus, there will be 50 feet of natural buffer preserved. The trail is proposed to provide for pedestrian traffic in natural greenway settings. The proposal shown in this area will provide a full 50 feet of buffer and will allow the trail to be in a natural area. It is not desirable for the trail to be immediately adjacent to homes and decks. This proposal will provide some minimal distance from any decks. This same condition also exists along the back of lot 44 and part of 43. The trail then crosses the stream buffer behind lot 42, This crossing is at or near perpendicular to the stream. This crossing is required for two reasons. The topography on the south side of the stream buffer is too steep to accommodate the trail. Also, the trail from the east needs to connect to this trail. Thus, a crossing will be required to connect the trails. After this crossing and intersection of the two trails, the greenway trail continues northwest. Two locations are being reserved. The first location shows the trail leaving Buckhurst West and going onto property owned by Daniel Katsion. This location will require that the Town obtain easements from several property owners to continue on the north side of the stream. To provide for flexibility in the future so the Town will be guaranteed some continuation of the trail, an alternative location is shown. It will require two stream crossings. These crossings are shown at or near perpendicular to the stream. All curves are shown to meet the Town's trail standards. Please coordinate the approval of this project. I would recommend changing the Certification to read: "We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for impacts to the protected riparian buffers. In accordance with 15A NCAC 2B .0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233(10). Until the Wetland Restoration Program receives and clears your check (made payable to: DENR - Wetlands Restoration Program), buffer impacts shall not occur. A Pre-construction Notification (PCN) Application is attached, which includes an agent authorization form. The proposed Buckhurst Subdivision is located in Cary, North Carolina. It is bounded to the north by Maynard Road (SR 1747) and to the east by North Harrison Avenue (SR 1652) (approximately 2000 feet west of Harrison). The southern portion of the property is bounded by NC 54 and lies just north of Northwoods School. See site vicinity map for a detailed depiction of the subject property (Figure 1). Impacts to waters of the US resulting from the project consist of two perpendicular sewer line crossings and one perpendicular road crossing. The sanitary sewer line will be constructed in a 20-foot-wide corridor resulting in 0.007 acre of temporary stream channel impacts (Impacts B & F). Approximately 0.013 acre of stream channel will be permanently impacted by construction of the proposed road (Impact G). Wetlands will not be impacted by the proposed project. The impacts are shown on the Impact Map attached (Figure 2). The USACE's current policy requires mitigation for impacts that exceed the requirements for notification. The USACE's current policy does not require mitigation for temporary impacts to stream channels resulting from utility line installation. NC - DWQ's past policy did not require mitigation for impacts to waters of the US less than 1/3 of an acre or 150 linear feet. NC - DWQ's current certification states that mitigation may be required for impacts to streams and/or wetlands. Because the proposed cumulative impacts resulting from the project do not exceed the USACE threshold or NC - DWQ's past policy thresholds, S&EC believes that wetland or stream channel mitigation should not be required. However, if NC - DWQ determines that compensatory mitigation is required for the impacts described herein, the applicant proposes payment to the NC Wetlands Restoration Program (WRP). A copy of WRP's Preliminary Acceptance Determination Request Form that has been faxed to Mr. Ron Terrell of the WRP is attached in the unlikely event that DWQ requires mitigation. The stream channels to be crossed by the proposed road and sanitary sewer line are subject to the Neuse River Basin (NRB) riparian buffer rules. The roadway crossing is perpendicular to the stream and will result in 0.271 acres of buffer impact and 149 linear feet of stream channel (Impact G). The linear footage stated above is for the road crossing only and does not include the rip-rap to be placed at the downstream edge of the culvert. Approximately 43 linear feet of stream channel will be armored with rip-rap to satisfy current soil and erosion control requirements. This activity will impact the stream channel itself, but will not impact the riparian buffer. As stated in the "no practical alternatives letter" provided by Blackburn Consulting Engineering, this crossing is needed to satisfy the Town's transportation needs and is also required to comply with standards set by the Town of Cary (see attached letter). Current NC - DWQ policy allows road crossings without mitigation if the impacts are less than or equal to 150 linear- feet of stream channel or 1/3 of an acre of riparian buffer. Because the project impacts are within these thresholds, S & EC does not believe that riparian buffer mitigation should be required. In two cases the sanitary sewer line will cross the stream at a perpendicular angle (Impacts B and F). Impact B will result in 0.048 acres of buffer impact and impact F will disturb 0.07 acres of buffer and impact approximately 25 linear feet of stream channel. These sewer line crossings are exempt per the non-electric utility line provisions within NRB buffer guidelines. Parallel sewer encroachments are proposed in five locations within Zone 2 of the buffer (Impacts A, C, D, E, and F). These encroachments are not located within Zone 1 of the riparian buffer. The total acreage of the impact to Zone 2 is approximately 0.188 acres. As discussed in the attached letter, encroachments into Zone 2 of the buffer are necessary due to the adjacent topography of the landscape. It is important to note that these impacts are temporary and that the disturbed areas will be re-vegetated following completion of the project. The only impervious area will be the manhole structures, which will be minimai. August 81 2000 S & EC Project #: 98-4082 Page 3 of 3 A greenway easement was required by Cary to meet the Town's connectivity ordinance. A greenway was chosen over a road to reduce the impact to the stream. The greenway will be paved and will cross the buffer above the sewer line labeled Impact B. However, this crossing is to be accomplished via a timber bridge and will not directly impact the stream. The proposed greenway will impact 102 ft2 of Zone 1 and 250 ft of Zone 2 of the riparian buffer beyond the construction corridor of the proposed sanitary sewer line. In addition, according to the riparian buffer rules, greenway construction is an allowable activity within the riparian buffer that does not require mitigation. A greenway has also been proposed through the riparian buffer on the east side of the subdivision. However, this is a separate project that will be permitted by the Town of Cary at a later date. Encroachments into the buffer include the roadway crossing for Northwoods Drive, sewer crossings, parallel sewer encroachments and a greenway crossing, The roadway crossing of Northwoods Drive is perpendicular to the stream and disturbs 148 linear feet of stream. The roadway is an extension of the existing Northwoods Drive which presently ends approximately 120 feet east of the stream buffer. This is an important extension for the Town of Cary as Northwoods Drive is a parallel collector for North Harrison Avenue. It is not only needed to satisfy the Town's transportation needs but is required for Buckhurst to comply with Town standards. The maximum length of a cul-de-sac is 900 feet. This street would exceed the standard without the crossing, The two sewer crossings are perpendicular to the stream. The sewer easements are 20 feet wide. The disturbed width is to be limited to 20 feet. Parallel sewer encroachments are proposed in five locations. The encroachments are limited to zone 2 of the buffer. These encroachments are due to the topography adjacent to the buffer, Moving them further from the stream will result in excessive depth, In two of these locations the depth is already 18 feet deep. The greenway easement between lots 12/13 and 21/22 crosses the buffer. This path is to be paved with a timber bridge. This path was required to meet the Town's connectivity ordinance, A street was actually required; however, the Town agreed to the trail to protect the stream.
