Junker 360 Blaise Church Road Mocksville, NC, 27028 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Junker: You have our approval, in accordance with the attached conditions and the condition listed below, to place fill in 149 linear feet of streams in order to construct a road crossing for the Theodore Drive Extension project in Davie County, as you described in your application received by the Division of Water Quality on September 26, 2000 and in revised plans received April 10, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289 or 3287. This Certification allows you to use Nationwide Permit Number 14 or 39 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below. 1. Placement of the culvert must be below the elevation of the streambed to allow for low flow passage of water and aquatic life. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Junker 360 Blaise Church Road Mocksville, NC 27028 SUBJECT: Request for Additional Information Theodore Drive Extension DWQ Project #00 1240 Davie County Dear Mr. Junker: The Division of Water Quality has reviewed your plans for the discharge of fill material into approximately 200 linear feet of an Unnamed Tributary to Bear Creek, Class C waters, Yadkin-Pee Dee River Basin, in Davie County for the purpose of commercial development. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0506. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until we receive this additional information. We are requesting (by copy of this letter) that the U. S. Army Corps of Engineers place your project on administrative hold. (1) Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Documentation such as maps, narratives, economic analyses, that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification request. (2) Please provide documentation detailing your position that the project has been designed such that adverse impacts to surface waters have been minimized and existing uses have been protected to the best of your ability. l William Junker Page 2 (3) The project will also require compensatory mitigation as described in 15A NCAC 2H.0506(h). Your mitigation proposal is insufficient since none was proposed. If it were possible to construct the road crossing with less than 150 linear feet of impact, compensatory mitigation would not be required. (4) A Division-approved stormwater management plan may be necessary for this project. Project Description Mr. William Junker owns and is developing Davie Industrial Park located in Mocksville, NC. The park is located along the right of way of 1-40 just west of its intersection with US Hwy 601 in Davie County. Further development of the park requires the extension of Theodore Drive over an unnamed tributary to Bear Creek in the South Yadkin Drainage basin. See attached copy from USGS Quad " Mocksville". The stream channel may be jurisdictional. However, other wetlands are not immediately obvious. The drainage area above the culvert is approximately 320 acres. The 78" culvert itself is planned to be 150 feet long with inlet protection consisting of rip-rap over fabric 12 feet long. Outlet protection consists of gabions over fabric 14' long. The total impacted length is approximately 200'. Anti-seepage collars will be installed around the culvert and the culvert invert will be set 16" below the existing stream invert per the Culvert Profile attached.
