After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Since the cumulative wetland impacts associated with the Landfall Subdivision exceed one acre, compensatory mitigation is being required in accordance with 15A NCAN 2H .0506(h). To satisfy this requirement the Phillips' propose to create 515 square feet of wetlands to offset the loss of 330 square feet of impacted wetlands. Since DWQ received the application, Angie Pennock with the U.S. Army Corps of Engineers visited the site, and flagged the effected jurisdictional wetlands. Due to the limitation of allowable construction activities within New Hanover County's COD setback, this area had never been delineated. The previous delineation required for the construction of the Phillips' home, started 75' landward from the edge of significant conservation resources. After Ms. Pennock flagged this area, the wetland line was then surveyed, and signed off by Scott McLendon. Upon inspection of the survey, we moved the placement of the structure landward to further reduce the impacts to 0.008 acres. The enclosed plan depicts a proposed area that Joanne Steenhuis suggested for onsite mitigation. The Phillip's landscape contractor will grade the area to support the proper hydric soil conditions required to propagate "404" vegetation. PROTECT DESCR_TP M The project area is located within the existing development known as Landfall. Landfall is an ongoing large-scale project, which includes golf courses, both single-family and multi-family residential, and commercial development. Landfall is located on the mainland side of the Atlantic Intracoastal Waterway (AIWW), near Wrightsville Beach, north of Eastwood Road and east of Military Cutoff, in New Hanover County. The applicant's property is located at 1035 Ocean Ridge Drive (Lots 26R & 27R), as well as, joint ownership of Lot 28. The 1.15 acre tract is approximately 217 feet wide along the Atlantic Intracoastal Waterway (AIWW), and 220 feet in depth from Ocean Ridge Drive. The site includes a drainage easement through a natural drainage feature that runs through the property and functions as a stormwater outfall for an existing culvert at the street. Prior to constructing their residence in 1994, the applicants obtained a federal Nationwide Permit and 401 Water Quality Certification to fill a portion of this wetland drain to allow construction. The applicants have utilized the drainage feature in the house design and landscaping and have supplemented the vegetation with both native and ornamental wetland plant species. The residential design includes three structures; the main house, guest house, and a garage. All are inter-connected by walkways along the side-slopes and elevated over wetland areas. The wooded lot includes mature Live Oaks and Hickory trees. Adjacent to the AIWW shoreline there is a border of coastal wetlands and mud flats, approximately 700 feet wide. This marsh vegetation is predominantly Smooth Cordgrass (Spartina 1 P iflora). Other high coastal marsh plants intermix into the vegetation on the landward side of the marsh border. Species observed include: Black Needle Rush (Juncos rcm rianu?), Cat-tail (lypba =), and Bulrush (=), Saw Grass ( ldi m j m i nce), Spike Grass (,12istichlis Xicata), Sea Oxeye (Borric is fruescens), Salt Meadow Grass (S an rtina patens), and shrubs, Wax Myrtle (Myrica cPjkm), Marsh Elder (Iva frutescens), and Grounsel-Bush (Baccharus h imifo ia), along the side-slopes of the transition to highground. The AIWW is approximately 600 feet wide in the project area. It is classified as SA by the NC Division of Water Quality, and is CLOSED to the harvest of shellfish. The area is not a designated Primary Nursery Area (PNA) by the NC Division of Marine Fisheries. The applicant proposes to construct two (2) walls along the southeast (waterward) side of his property. A retaining wall is proposed along the southern-most side of the property to raise that section of the lot to the 100-year storm elevation (+12 ft. MSL). This wall would be 121 feet long and 3 -4 feet above existing grade. Its design would be typical marine construction consisting of pilings, whalers, and vertical V-groove sheathing. The retaining wall is proposed landward of all wetlands and would require approximately 190 cubic yards of backfill material. The second wall is depicted as a free-standing masonry storm wall to help protect the property from hurricane storm surge. A concrete foundation, 5 feet wide, 12 inches thick, and approximately 2 feet below grade would poured to support the wall. Two masonry walls, 4'8" apart, would be constructed on the foundation. The outer wall (south) would be constructed to elevation 13'4" MSL and the inner wall (north) would be constructed to elevation 10'4" MSL. Earthen fill material would be brought in to fill the void between the walls and capped with a concrete cap at the elevation of the lower wall. Wall design includes two (2) 24" outlet pipes, equipped with flapper gates that would allow the existing stormwater outfall to function while preventing in-flow from any storm surge. The top of the wall would be accessed by a concrete steps on the inside of the structure. The applicants also propose a third masonry wall to create a pool over a portion of the natural wetland substrate. The inside area of the pool would be planted with wetland plant species. The proposed alignment of the wall is well landward of the mean high water contour (MHW) and landward of all David& Ruth Ann Phillips Page 3 coastal wetlands. Approximately 150 ft. of the 235 ft. long wall would be located within the previously delineated non-tidal wetland drain. The wetland fill area would 150 feet in length and 5 feet in wide. 10. ANTICIPATED IMPACT The proposed wetland fill would incorporate 750 square feet of "404 type" wetlands. The installation of the wetland pool would create additional temporary disturbance and possibly alter the existing wetland function. There would be 1635 square feet of additional highground disturbance associated would the construction of two walls. This design was used because all associated back fill for this part of the project will not be placed in any wetland areas. The area of disturbance is located in a Conservation Overlay District. This local ordinance restricts impervious surfaces within the setback, minimizing associated degradational impacts to important natural resources. The project lies within the jurisdictional limits of the City of Wilmington. The City has recently adopted this ordinance and is currently relying on the interpretation of County officials. An onsite meeting was held with Debra Wilson, a New Hanover County Zoning Enforcement Officer and John W. Fullerton, a City of Wilmington's Zoning Inspector. A follow up meeting was also held with Ann Hines, Chief Zoning Enforcement Officer for New Hanover County. All officials concurred that the project was designed to minimize impacts to natural resources.
