It is issued to City of Greensboro resulting in 684 linear feet of stream impact in County pursuant to an application filed on the 13th day of March, 2001 to culvert a stream for the Overbrook Drive project. The application provides adequate assurance that the discharge of fill material into the waters of North Buffalo Creek in conjunction with the proposed development will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate the applicable portions of Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. This approval is only valid for the purpose and design that you submitted in your application, as described in the Public Notice. If you change your project, you must notify us and send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre or total perennial stream impact exceeds 150 feet, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed below. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion control, Coastal Stormwater, Non-discharge and Water Supply watershed regulations. Condition(s) of Certification: Appropriate sediment and erosion control practices which equal or exceed those outlined in the most recent version of two manuals, either the "North Carolina Sediment and Erosion Control Planning and Design Manual" or the "North Carolina Surface Mining Manual" (available from the Division of Land Resources in the DEHNR Regional or Central Offices). The control practices shall be utilized to prevent exceedances of the appropriate turbidity water quality standard (50 NTUs in all fresh water streams and rivers not designated as trout waters; 25 NTUs in all lakes and reservoirs, and all saltwater classes; and 10 NTUs in trout waters); 2. All sediment and erosion control measures placed in wetlands or waters shall be removed and the natural grade restored after the Division of Land Resources has released the project; 3. Measures shall betaken to prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 4. We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate for these impacts to wetlands and/or streams. In accordance with 15A NCAC 2R .0402, this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2H .0506(h). According to 15A NCAC 2H .0506(h), 1,179 feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check (made payable to: DENR - Wetland Restoration Program), wetland or stream fill shall not occur. An on-site investigation of the project area was conducted on 14 June 2000. Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The City of Greensboro, Storm Water Services, has altered the mitigation plan to mitigate for impacts at a 2:1 ratio rather than the 1:1 ratio originally proposed. Mitigation is offered for impacts to 684 linear feet of an unnamed tributary to North Buffalo Creek in Guilford Hills Subdivision located in northwest Greensboro. We will concur with the project based on the revised mitigation plan. However, we remain concerned about the impacts created by stream piping, as stated in our previous comments (McBride, 9 October 2000). Without more proactive measures, the City will continue to experience channel degradation and the loss of aquatic and wildlife habitat. We encourage the City to consider protecting a minimum 100-foot, forested riparian buffer for all perennial streams and a minimum 50-foot buffer for intermittent streams and wetlands, and avoiding future proposals to pipe streams. As urbanization continues in Guilford County, wildlife habitat is rapidly disappearing. These buffers would provide travel corridors and habitat areas for wildlife displaced by secondary development, in addition to protecting water quality, stabilizing stream banks, and providing habitat for aquatic and fisheries resources. The stated purpose of this project is to eliminate safety hazards associated with the open channel and to provide residents with full access to their property. The stream has been previously channelized, and is of degraded quality. However, in most areas the stream banks are well vegetated and shaded by trees, shrubs, and vines. Both the upstream and downstream portions of this stream were piped during original construction of the community in the 1950's. We hesitate to concur with the piping of any stream due to the potential negative impacts to downstream areas and the elimination of fish and wildlife habitat. Stream piping reduces the infiltration of storm water and associated pollutants, as well as the dissipation of stream energy. The channel degradation witnessed by these residents is directly related to the piping of all upstream channels. In addition, we are concerned about the cumulative impacts associated with the loss of urban aquatic and wildlife habitats. Although currently degraded, urban songbirds and other wildlife as well as pollution-tolerant aquatic species will typically use these relatively low- quality urban streams. However, culverting a stream and placing it underground obviously removes both aquatic and terrestrial habitat. Existing uses by urban wildlife are lost and future opportunities to improve aquatic diversity, even if water quality improves, are precluded. High, flashy flows during storm events are characteristic of Greensboro's urban streams due to excessive piping, curb and gutter, and impervious surfaces. The storm sewer extension proposed in this project could exacerbate these problems. We do not believe that this project is acceptable for the following reasons. 1) The affected homes were constructed in the 1950's, the stream flowed through these properties when they were purchased, and there was never an agreement by the City of Greensboro or the developer to pipe this reach of stream. 2) The stream is at least 50-70 feet away from the homes and does not appear to pose a threat to any permanent structures. 3) Although the stream is currently degraded, the presence of riparian vegetation and canopy cover offers benefits to fish and wildlife habitat and water quality. We recommend denial of this project as proposed and suggest that the City of Greensboro further pursue Alternative 4.1 Purchase of Easement described in the Environmental Assessment. This alternative was disregarded on the basis that it would not reduce the citizens' concerns about safety hazards associated with open channel flow through their property. As noted in the on-site investigation, at least one of the properties currently has a fence separating the backyard from the stream. We suggest that as part of the City's agreement to purchase the easement surrounding this stream that they consider building a similar fence between the affected backyards and the stream. This should reduce or eliminate the citizens' concerns with safety issues. Although we do not concur with the project, if the Corps of Engineers does grant a 404 permit, we would prefer to see mitigation measures directed towards replacing lost water quality functions and aquatic habitat in the immediate impacted watershed. We do not believe that the proposed payments to a mitigation bank at a ratio of 1:1 is adequate to compensate for the direct and cumulative impacts to fish and wildlife resources and water quality. EPA does not believe that the answer to storm water drainage issues is the culverting of creeks. We understand that the City of Greensboro is proposing this work in the interest of protecting its inhabitants from flooding and safety hazards. We also understand the difficulty in addressing such issues in the urban context. However, EPA is dismayed by the proposed techniques and methods that the City of Greensboro has chosen to pursue. However, at this time, we will not object to authorization of the project, if appropriate compensatory mitigation is provided. At past meetings in Charlotte and Raleigh, North Carolina concerning the future Environmental Assessment (EA) for similar activities, EPA and the other resource agencies have discussed their intentions that stream stabilization projects become more effective and environmentally and geomorphologically appropriate. This project is in stark contrast with the resource agencies' wishes, by proposing to completely remove a stream and its valuable functions. Piping the channel will eliminate the beneficial functions of the stream which previously existed, such as reduction of water velocity and improvement of water quality. 2 Although the water quality and habitat functions of the stream may presently be minimal, they are certainly greater than the functions provided by a reinforced concrete pipe. Further, the piping of the channel will likely increase the velocity of water, transporting water downstream faster. We note that North Buffalo Creek is listed by the North Carolina Department of Environment and Natural Resources on the 1998 Clean Water Act Section 303(d) list as not supporting its designated use due to point and non-point sources, including surface runoff. EPA believes that the piping of channels upstream may contribute to the continued degradation of water quality, and prevent North Buffalo Creek from eventually supporting its designated uses. Conversely, the removal of culverts from streams and restoration of upstream reaches, floodplains, and wetlands may assist in the improvement of water quality in the listed reaches of North Buffalo Creek. EPA recognizes that the City of Greensboro already has greenways around several streams within the City limits. In the future, as an alternative to piping of channels, EPA recommends that the City of Greensboro consider the opportunity to expand this system of greenways and improve the functions of streams using more appropriate stream restoration/stabilization techniques, such as those proposed by Dave Rosgen (1992). Given adequate land availability adjacent to the stream, the restoration and maintenance of a meandering stream with an associated greenway would provide storm water benefits to the City and the receiving waters, along with aesthetic and societal benefits to the community. The central tendency of a stream is to meander, and a stream with sinuosity is more efficient to move sediment. Even if there is not sufficient buffer area to provide for a meandering stream, EPA believes that there are many more natural alternatives which will provide a larger capacity for water storage and transport, and streambank stabilization. EPA also encourages the City of Greensboro to incorporate such proposals for effective and geomorpho logical ly-appropri ate stream restoration, stabilization, and protection into their storm water plan and other land-use planning and management activities, to provide water quality, flood attenuation, habitat, and societal benefits to the City. The City should strive to avoid future scenarios where buildings are located adjacent to a channel or within the floodplain, and there is no available land for appropriate corrective measures. The streambed is heavily silted and most of the tributary's banks are part of maintained grass lawns. The surrounding development and the fact that it is isolated between two existing storm sewers has heavily. impacted this headwaters tributary. Total impacts for the proposed project include the excavation, culverting, and fill of approximately 684 linear feet (approximately 0.3 acre) of the jurisdictional waters of an unnamed tributary of North Buffalo Creek. No jurisdictional wetlands are to be impacted by this proposed project. The purpose of the storm sewer extension is to eliminate safety hazards associated with the tributary's open water, steep banks and erosion. Also, the storm sewer extension will give residents on Overbrook Drive full access and use of their backyard property. Evaluation of the probable impacts, which the proposed activity may have on the public interest, requires a.careful weighing of all those factors, which become relevant in each particular case. The benefits, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors, which may be relevant to the proposal, must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. Total impacts for the proposed project include the excavation, culverting, and fill of approximately 684 linear feet (approximately 0.3 acre) of the jurisdictional waters of an unnamed tributary of North Buffalo Creek. No jurisdictional wetlands are to be impacted by this proposed project. The purpose of the storm sewer extension is to eliminate safety hazards associated with the tributary's open water, steep banks and erosion. Also, the storm sewer extension will give residents on Overbrook Drive full access and use of their backyard property. The City of Greensboro proposes to mitigate for the 684 linear feet of jurisdictional stream impacts by buying into the North Carolina Wetland Restoration Program at a 1:1 ratio. Plans showing the work are included with this public notice. A copy of this public notice can be viewed on our web page at http://www.saw.usace.anny.mil. 2 The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has determined the applicability of a Water Quality Certificate as required by PL 92-500.' This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observation, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts, which the proposed activity may have on the public interest, requires a.careful weighing of all those factors, which become relevant in each particular case. The benefits, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors, which may be relevant to the proposal, must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by 3 such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDWQ for certification. IDOWU, CITY OF GREENSBORO, STORMWATER MANAGEMENT DIVISION, POST OFFICE 3136, GREENSBORO, NORTH CAROLINA 27402-3136 HAS REQUESTED A DEPARTMENT OF THE ARMY (DA) PERMIT TO AUTHORIZE THE DISCHARGE OF FILL INTO THE JURISDICTIONAL WATERS OF AN UNNAMED TRIBUTARY OF NORTH BUFFALO CREEK ASSOCIATED WITH THE PROPOSED EXTENSION OF EXISTING STORM SEWERS LOCATED OFF OF OVERBROOK DRIVE, IN GREENSBORO, GUILFORD COUNTY, NORTH CAROLINA. The following description of the work is taken from data provided by the applicant and from observations made during a site visit by a representative of the Corps of Engineers. Plans submitted with the application depict the excavation, culverting, and fill of approximately 684 linear feet of jurisdictional stream channel (approximately 0.3 acre) associated with an unnamed tributary of North Buffalo Creek. This tributary is located south of Overbrook Drive and north of Fernwood Drive in Guilford Hills Subdivision. The proposed work will begin at the outlet of an existing storm sewer that has a crossover east of Overbrook Drive and exits at the back of the residence located at 2513 Overbrook Drive. The tributary will be culverted and filled from this point west behind the residences on Overbrook Drive to the point that it presently enters a storm sewer behind the residence located at 2529 Overbrook Drive. The tributary is characterized as being deeply incised, between high ground banks, with a top width of approximately 18 feet apart. The streambed is heavily silted and most of the tributary's banks are part of maintained grass lawns. The surrounding development and the fact that it is isolated between two existing storm sewers has heavily impacted this headwaters tributary. Total impacts for the proposed project include the excavation, culverting, and fill of approximately 684 linear feet (approximately 0.3 acre) of the jurisdictional waters of an unnamed tributary of North Buffalo Creek. No jurisdictional wetlands are to be impacted by this proposed project. The purpose of the storm sewer extension is to eliminate safety hazards associated with the tributary's open water, steep banks and erosion. Also, the storm sewer extension will give residents on Overbrook Drive full access and use of their backyard property. The City of Greensboro proposes to mitigate for the 684 linear feet of jurisdictional stream impacts by buying into the North Carolina Wetland Restoration Program at a 1:1 ratio. A copy of this public notice can be viewed on our web page at htlp://www.saw.usace.anny.mil. 2 The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Water Quality (NCDWQ) has determined the applicability of a Water Quality Certificate as required by PL 92-500.' This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this site is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer has determined, based on a review of data furnished by the applicant and onsite observation, that the activity will not affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts, which the proposed activity may have on the public interest, requires a.careful weighing of all those factors, which become relevant in each particular case. The benefits, which reasonably may be expected to accrue from the proposal, must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors, which may be relevant to the proposal, must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by I 3 such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this Department of the Army (DA) permit will not be made until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the Department of the Army (DA) permit serves as application to the NCDWQ for certification. Upstream and downstream of this 684 feet segment of the stream was enclosed during development in 1972. The proposed project is located in the Guilford Hills subdivision, a single family residential community located on the northwest side of Greensboro, North Carolina. 2.0 Purpose of Project The purpose of the proposed storm sewer extension is to eliminate safety hazards associated with the stream and to give the residents full access and use of their property. Due to the stream's close proximity to homes, there are concerns with the relatively steep banks, high flow rates during storm events, continual widening of the channel, and the nuisance of floating debris. Because the stream runs through the middle of the residents' back yards, piping the stream will allow the residents to gain full use and access to their property and eliminate the safety hazards associated with the stream. 3.0 Environmental Consequences 3.1 Existing Environment A perennial stream, which shows on the USGS quad sheet flows through this subdivision. A portion of this stream was piped in 1979 during the construction of the subdivision and another portion was upgraded in 1985 due to increase in upstream development. The length of open stream channel that crosses the properties along Overbrook Drive is approximately 684 feet with a drainage area of approximately 65 acres. All upstream conveyance systems in this basin are enclosed and the downstream conveyance system is also enclosed until it crosses Benjamin Parkway & Bryan boulevard where it discharges into a tributary of North Buffalo Creek. From there the stream flows approximately 2.46 miles before discharging to North Buffalo Creek. The open stream section, along Overbrook Drive is eroding and degrading with sizes ranging from approximately 3 feet to 5 feet in height. The vegetation on the stream banks and floodplain varies from grass, shrubs to canopy cover provided by some trees along the stream bank. The houses along Overbrook Drive are located approximately 50-70 feet away from the open stream channel. The pre-construction soil type at the project area as indicated by the Guilford County Soils Survey, is Vance sandy loam (10-15% slopes). The top layer soil type and the topography in this area may have been altered from the pre- developed condition. 3.2 Existing Permits and Certifications There were no permits or certifications obtained for the piping and channel modification of the stream during subdivision construction in 1972. 3.3 Project Impacts Changes in land use The proposed sewer extension project will enclose the only portion of the system that is still an open channel (684 feet of stream.) The stream will be excavated, the pipe and junction boxes will be placed and constructed, and then backfilled. By piping the stream, residents will gain full use of their back yards. Wetlands There are no jurisdictional wetlands other than the stream in the proposed project area. US Army Corps of Engineers will be invited for verification. Cost of mitigation will be paid into the state mitigation bank for the lost habitat. Prime or unique agricultural lands The project is located entirely within the Guilford Hills subdivision. There are no agricultural lands in this area. Public lands The project will take place on private property within the designated drainage maintenance and utility easement. Scenic or recreational areas There are no scenic or recreational areas located within or near the project area. The proposed project will provide more usable land for the landowners. Areas of archeological or historical value The NC Department of Cultural Resources, will be contacted for properties of architectural, historic, or archaeological significance that would be affected by the proposed project. Air quality Air quality will not be impacted due to piping of the stream. There will be no emissions as a result of this project. Groundwater quality The stream is a perennial stream therefore, groundwater maintains the base flow in the stream during dry conditions. But upstream and downstream of this section are piped, which reduces groundwater base flow. The piping will cause insignificant change to groundwater seepage and groundwater quality. Noise levels Variation in noise levels will only be experienced during the construction phase of the project as heavy machinery will be used to excavate, lay pipe, and backfill. The project will not cause any change in noise levels except during the short construction period. Water supplies The project is not located in a designated water-supply watershed. The subdivision residents are serviced drinking water by the City of Greensboro. The project will not have any impact on water supplies. Shellfish or fish and their habitats Although the stream maintains continual flow, the quality of the stream is considered by the City to be degraded. There is limited aquatic habitat in the stream (see Exhibit B for field assessment worksheet). Wildlife and their habitats (presence of threatened or endangered species) There is no evidence of wildlife habitat in the project area. The NC Natural Heritage Program will be contacted for records of rare species, high quality natural communities, state/federal of Significant Natural Heritage Areas at or within a one mile radius of the proposed project. Introduction of toxic substance There will not be any toxic substances introduced to the environment as a result of the proposed storm sewer extension. Surface water quality During construction, erosion protection measures will be implemented to reduce the amount of sediment transport to receiving surface waters. Immediately after construction, disturbed areas will be permanently stabilized with grass cover. There will be no increase in "nutrients" as a result of this project. Downstream flooding The piping project will not cause a significant change in downstream flooding amounts and/or frequency from what already exists. There are no structures immediately downstream of the proposed project that experience flooding problems. Stream scour protection This project will be end of pipe to end of pipe construction. Rip rap outlet protection is not needed. 4.0 Alternative Analysis The alternative option considered for this project was to (1) purchase easement so that City of Greensboro could have control of maintenance activities along 4 Overbrook Drive and (2) to maintain the stream channel in its current location and provide stabilization along the stream banks. 4.1 Purchase of easement One alternative the City considered was to purchase easement of the stream corridor so that City of Greensboro could have access toward maintenance of the stream corridor and to enable vegetation growth for stabilization. This option would have given the City of Greensboro the opportunity to assist citizens with managing this portion of their property, however, the residents noted that this would not reduce their concern for hazards associated with open channel flow through their property. 4.2 Maintain stream channel/provide stabilization The other alternative considered is to maintain the stream in its current condition and provide stabilization of sections of the stream where the banks where eroded. This alternative would prevent further disturbance of the stream. With this option, the City would offer to partner with the residents to plant trees and other vegetation along the stream to keep the banks as stable as possible. However, the residents expressed that this option will not address their concerns (safety hazards and inability to fully use their properties) and that the only option that would meet their needs would be to pipe the stream segment. First, the residents' main concern is the presence of the open flowing water that is present in their yards and close to their homes. They expressed concern for their children's safety when they play in their yards. They also note that during storm events the stream exhibits high water levels and velocity and that the size of the channel cross section has increased significantly since they bought their homes. The residents point out that stabilization of the banks will not relieve their main concern that open channel flow exists on their property. Also, a safety barrier such as a fence would be unacceptable by the residents and would not reduce their concern for the safety of their children playing in their yard. Secondly, the residents want the stream to be piped to give them more use of their yards. The lots along Overbrook Drive are fairly small (quarter acre) and the stream runs through the middle of their back yard. Although the residents are concerned with the areas along the stream where the banks are 5-6' high and nearly vertical and placing a safety barrier such as a fence would further reduce the use of their yard. Thirdly, the resident's point out that they do not want the dense vegetation associated with bank stabilization. The residents stated that dense vegetation provides a habitat for undesirable wildlife, such as snakes, and traps floatable litter from upstream properties. They also said with the stream so close to the homes, the dense vegetation makes their yard unattractive. For the reasons stated above, the alternatives were not considered feasible for implementation. 5.0 Mitigative Measures The City of Greensboro will pay for mitigation at a 1:1 ratio for the 684 feet of stream loss due to the storm sewer extension. 6.0 Conclusions The proposed storm sewer extension that will impact 684 linear feet of an unnamed tributary to North Buffalo Creek will not have a significant adverse effect on the quality of the environment because of the following reasons: 1. The stream is currently a degraded stream (Class C NSW) with very low aquatic habitat (see appendix B for stream quality assessment data). 2. The stream is not designated by the State as High Quality Waters, Outstanding Resource Waters, or Water-Supply Waters. The stream is Nutrient Sensitive Waters, however, the project will not increase nutrient levels. 3. The City will mitigate for the loss of stream at a 1:1 ratio by paying to the State mitigation bank. Upstream and downstream of this 684 feet segment of the stream was enclosed during development in 1972. The proposed project is located in the Guilford Hills subdivision, a single family residential community located on the northwest side of Greensboro, North Carolina. 2.0 Purpose of Project The purpose of the proposed storm sewer extension is to eliminate safety hazards associated with the stream and to give the residents full access and use of their property. Due to the stream's close proximity to homes, there are concerns with the relatively steep banks, high flow rates during storm events, continual widening of the channel, and the nuisance of floating debris. Because the stream runs through the middle of the residents' back yards, piping the stream will allow the residents to gain full use and access to their property and eliminate the safety hazards associated with the stream. 3.0 Environmental Consequences 3.1 Existing Environment A perennial stream, which shows on the USGS quad sheet flows through this subdivision. A portion of this stream was piped in 1979 during the construction of the subdivision and another portion was upgraded in 1985 due to increase in upstream development. The length of open stream channel that crosses the properties along Overbrook Drive is approximately 684 feet with a drainage area of approximately 65 acres. All upstream conveyance systems in this basin are enclosed and the downstream conveyance system is also enclosed until it crosses Benjamin Parkway & Bryan boulevard where it discharges into a tributary of North Buffalo Creek. From there the stream flows approximately 2.46 miles before discharging to North Buffalo Creek. The open stream section, along Overbrook Drive is eroding and degrading with sizes ranging from approximately 3 feet to 5 feet in height. The vegetation on the stream banks and floodplain varies from grass, shrubs to canopy cover provided by some trees along the stream bank. The houses along Overbrook Drive are located approximately 50-70 feet away from the open stream channel. The pre-construction soil type at the project area as indicated by the Guilford County Soils Survey, is Vance sandy loam (10-15% slopes). The top layer soil type and the topography in this area may have been altered from the pre- developed condition. 3.2 Existing Permits and Certifications There were no permits or certifications obtained for the piping and channel modification of the stream during subdivision construction in 1972. 3.3 Project Impacts Changes in land use The proposed sewer extension project will enclose the only portion of the system that is still an open channel (684 feet of stream.) The stream will be excavated, the pipe and junction boxes will be placed and constructed, and then backfilled. By piping the stream, residents will gain full use of their back yards. Wetlands There are no jurisdictional wetlands other than the stream in the proposed project area. US Army Corps of Engineers will be invited for verification. Cost of mitigation will be paid into the state mitigation bank for the lost habitat. Prime or unique agricultural lands The project is located entirely within the Guilford Hills subdivision. There are no agricultural lands in this area. Public lands The project will take place on private property within the designated drainage maintenance and utility easement. Scenic or recreational areas There are no scenic or recreational areas located within or near the project area. The proposed project will provide more usable land for the landowners. Areas of archeological or historical value The NC Department of Cultural Resources, will be contacted for properties of architectural, historic, or archaeological significance that would be affected by the proposed project. Air quality Air quality will not be impacted due to piping of the stream. There will be no emissions as a result of this project. Groundwater quality The stream is a perennial stream therefore, groundwater maintains the base flow in the stream during dry conditions. But upstream and downstream of this section are piped, which reduces groundwater base flow. The piping will cause insignificant change to groundwater seepage and groundwater quality. Noise levels Variation in noise levels will only be experienced during the construction phase of the project as heavy machinery will be used to excavate, lay pipe, and backfill. The project will not cause any change in noise levels except during the short construction period. Water supplies The project is not located in a designated water-supply watershed. The subdivision residents are serviced drinking water by the City of Greensboro. The project will not have any impact on water supplies. Shellfish or fish and their habitats Although the stream maintains continual flow, the quality of the stream is considered by the City to be degraded. There is limited aquatic habitat in the stream (see Exhibit B for field assessment worksheet). Wildlife and their habitats (presence of threatened or endangered species) There is no evidence of wildlife habitat in the project area. The NC Natural Heritage Program will be contacted for records of rare species, high quality natural communities, state/federal of Significant Natural Heritage Areas at or within a one mile radius of the proposed project. Introduction of toxic substance There will not be any toxic substances introduced to the environment as a result of the proposed storm sewer extension. Surface water quality During construction, erosion protection measures will be implemented to reduce the amount of sediment transport to receiving surface waters. Immediately after construction, disturbed areas will be permanently stabilized with grass cover. There will be no increase in "nutrients" as a result of this project. Downstream flooding The piping project will not cause a significant change in downstream flooding amounts and/or frequency from what already exists. There are no structures immediately downstream of the proposed project that experience flooding problems. Stream scour protection This project will be end of pipe to end of pipe construction. Rip rap outlet protection is not needed. 4.0 Alternative Analysis The alternative option considered for this project was to (1) purchase easement so that City of Greensboro could have control of maintenance activities along Overbrook Drive and (2) to maintain the stream channel in its current location and provide stabilization along the stream banks. 4.1 Purchase of easement One alternative the City considered was to purchase easement of the stream corridor so that City of Greensboro could have access toward maintenance of the stream corridor and to enable vegetation growth for stabilization. This option would have given the City of Greensboro the opportunity to assist citizens with managing this portion of their property, however, the residents noted that this would not reduce their concern for hazards associated with open channel flow through their property. 4.2 Maintain stream channel/provide stabilization The other alternative considered is to maintain the stream in its current condition and provide stabilization of sections of the stream where the banks where eroded. This alternative would prevent further disturbance of the stream. With this option, the City would offer to partner with the residents to plant trees and other vegetation along the stream to keep the banks as stable as possible. However, the residents expressed that this option will not address their concerns (safety hazards and inability to fully use their properties) and that the only option that would meet their needs would be to pipe the stream segment. First, the residents' main concern is the presence of the open flowing water that is present in their yards and close to their homes. They expressed concern for their children's safety when they play in their yards. They also note that during storm events the stream exhibits high water levels and velocity and that the size of the channel cross section has increased significantly since they bought their homes. The residents point out that stabilization of the banks will not relieve their main concern that open channel flow exists on their property. Also, a safety barrier such as a fence would be unacceptable by the residents and would not reduce their concern for the safety of their children playing in their yard. Secondly, the residents want the stream to be piped to give them more use of their yards. The lots along Overbrook Drive are fairly small (quarter acre) and the stream runs through the middle of their back yard. Although the residents are concerned with the areas along the stream where the banks are 5-6' high and nearly vertical and placing a safety barrier such as a fence would further reduce the use of their yard. Thirdly, the resident's point out that they do not want the dense vegetation associated with bank stabilization. The residents stated that dense vegetation provides a habitat for undesirable wildlife, such as snakes, and traps floatable litter from upstream properties. They also said with the stream so close to the homes, the dense vegetation makes their yard unattractive. For the reasons stated above, the alternatives were not considered feasible for implementation. 5.0 Mitigative Measures The City of Greensboro will pay for mitigation at a 1:1 ratio for the 684 feet of stream loss due to the storm sewer extension. 6.0 Conclusions The proposed storm sewer extension that will impact 684 linear feet of an unnamed tributary to North Buffalo Creek will not have a significant adverse effect on the quality of the environment because of the following reasons: 1. The stream is currently a degraded stream (Class C NSW) with very low aquatic habitat (see appendix B for stream quality assessment data). 2. The stream is not designated by the State as High Quality Waters, Outstanding Resource Waters, or Water-Supply Waters. The stream is Nutrient Sensitive Waters, however, the project will not increase nutrient levels. 3. The City will mitigate for the loss of stream at a 1:1 ratio by paying to the State mitigation bank.
