Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material
in 447 linear feet of streams for the purpose of constructing the James Farm subdivision as described in your
application dated February 28, 2000 and revised on December 14, 2000. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3108. This certification allows you to use
Nationwide Permit Number 26 when the Corps of Engineers issues it. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified
below. If you change your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible
for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be
valid, you must follow the conditions listed in the attached certification and any additional conditions listed below.
Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to
notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be
put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later).
2. The rock dam near crossing #4 shall be removed and replaced with a culvert if a road crossing is needed.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms
to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447,
Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act_ If you

Unfortunately
the I redell County zoning Office has a connectivity requirement for subdivisions that

require roads to "flo w" through the development and not be hindered by cul-de-sacs. While this
approach is comme ndable
it will result in unnecessary impacts to mitigatable channels that neither
the developer nor Q ,
W0 favors. Considering the quality of the streams to be impacted- this Office
believes that it is im portant enough to advise the applicant of DWOs desire to avoid these channels by
not installing the ro ad crossings, It may be necessary to provide written direction to the applicant so
that he can advise t he local gov .rnment of DWO concerns. Approval of this 401 request should be
withheld until such time as the applicant has resolved this issue with the local government. It should
also be pointed out that the significance of all the crossings in this request is 149 feet in length (one
foot less than the m itigatable threshold). Considering the totopography on this site, it may be difficult
maintaining 149 fee t of impact on each channel crossing. Follow-up compliance inspections will be
necessary to ascert ain whether the applicant has been able to limit the impacts to 149 feet or less.

Jolltl and Cyndi,
These are the MRO comments for the James Farm Subdivision revision off
Simonto Road in Iredell County. All streams that are to be impacted are
small perennial channels with aquatic life and will require mitigation
if they exceed the 150 ft threshold. The applicant has removed two
crossing from the original development plans as shown on the revised
11/22/00 site plan.
Crossing #2 will be the second crossing of this stream as there is a
crossing for the existing subdivision that the proposed development will
connect to. This crossing provide another access point to the
development from Simonton Road. Crossings #3 and 4 provide access to
the east side of the property.
The MRO does not object to the revised project with the following
cortd i t ions:
-The reamai.ni.g streams and wetlands on the property shall be protected
from future development with deed restrictions.
-The rock dam across the stream near crossing number 4 saall be removed
and replaced with a culvert if needed. Staff found that approximately
15 feet of channale had been impacted by the dumping of rock in the
stream to provide access to the sewer line.

Dear Mr. Dorney:
The purpose of this letter is to request authorization for revised wetland impacts under
Nationwide Permit 26 and its general 401 Water Quality Certifications for the project
known as James Farm Subdivision, Iredell County, North Carolina. The project was
placed on hold by your office per letter dated April 24, 2000. Significant effort and
measures have been taken in order to minimize impacts through the removal of road
crossings 1 and 5 as proposed in the original application.
The revised project will impact approximately 447 linear feet or less of Waters of the US
in the form of channels for the installation of road crossings 2, 3, and 4 as noted in the
original application for the purpose of access to the site development. The elimination
of road crossing #1 (the largest road crossing) and utilization of cul-de-sacs as
suggested in your letter should eliminate your concerns of individual crossing impacts
exceeding the 150 linear feet threshold.
No mitigation for impacts is proposed as impacts per separate drainage will not equal or
exceed 150 linear feet.
Additionally, please note that Wetland and Natural Resource Consultants, Inc. did not
receive a copy of the April 14, 2000 401 WQC Denial letter although we were "cc:" on
the original letter. We do not consider the project withdrawn, but "on hold" by your
office at this ' W*Ae .

The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.30
-.cres of wetlands and 645 linear feet of streams located in Iredell County for residential development
(James Farm Inc.) as described in your application dated March 7, 2000. Insufficient evidence is present in
our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with
15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will
have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place
this project on hold as incomplete until we receive this additional information, we are requesting (by copy
of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you construct cul-de-sacs and thereby eliminate crossings number 3 and 4?
Finally we are concerned that the planned road crossings and-any immediate downstream stabilization
exceed (50 feet). Please be advised that if future compliance inspections reveal that more than 150 feet of
stream have been impacted, that after-the-Pact compensatory stream mitigation will be required. Any
documentation such as maps and narrative that you can supply to address alternative designs for your
project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and to the Mike Parker, Mooresville Regional Office at (704) 663-6040. If we do not hear from you in
three weeks, we will assume that you no longer want to pursue this project and we will consider the project

Carolina. The property proposed for development surrounds an existing subdivision.
Additional residential communities exist along four of the outer bounds. A thirty foot
vegetated buffer will surround the outer boundaries of the majority of the property.
Three jurisdictional channels cross through the project boundary. There is an estimated
8,300 linear feet of channel and an estimated 0.30 acres of wetlands on site.
The project, as proposed, impacts 745 linear feet of Waters of the US in the form of
channels. The project proposes permanent impacts associated with road crossings of
447 linear feet of important, perennial channel; permanent impacts associated with road
crossings of 149 linear feet of important, intermittent channel; and permanent impacts
associated with road crossings of 149 linear feet of non-important, intermittent channel.
Impacts are shown on the attached site plans. The proposed activity is located in Iredell
County and is within lands owned by William Brewster Company. The attached USGS
topographical map shows the location of the project.
Road crossing #1 on an unnamed tributary to Fourth Creek, utilizing NW 14, consists of
a box culvert with baffle walls. The unnamed tributary to Fourth Creek is considered to
be perennial and important in aquatic function. The permanent channel impacts for this
road crossing total 149 linear feet.
Road crossings #2 and #4 on unnamed tributaries to Fourth Creek, utilizing NW 26, and
consists of pipe and rip-rap. The unnamed tributary to Fourth Creek is considered to be
perennial and important in aquatic function. Permanent channel impacts for these road
crossings total 298 linear feet.

Road crossing #3 is also on an unnamed tributary to Fourth Creek, utilizing NW 26, and

and important in aquatic function. The permanent channel impacts for this road
crossing totals 149 linear feet.
Road crossing #5, permitted also under NW 26, is on an unnamed tributary to Fourth
Creek that is considered to be intermittent and non-important in aquatic function. The
permanent channel impacts for this road crossing totals 149 linear feet.
Lot fill utilizing NW 26 is proposed for impacts to 0.30 acres of vegetated wetlands.
Total impacts to important channel for this project include 596 linear feet. Impacts to
vegetated wetlands total 0.30 acres. Channel mitigation for the loss of 298 linear feet of
important channel within the same drainage is proposed at a 1 to i ratio on site. There
are areas of channel degradation and lack of sinuosity within the property bounds that
are offered as mitigation sites. Mitigation will significantly enhance the habitat for
aquatic and terrestrial wildlife. As required, the mitigation plan will be monitored for five
years once in place. We understand that if the permit is issued conditional an accepted
mitigation plan that we cannot proceed with the lot and pad fill until we have agency
approval. A mitigation plan, utilizing Rosgen's Principles, will be submitted if the current
mitigation proposed is accepted. No mitigation for vegetated wetland impacts is
proposed.

Avoidance and Minimization:
Impacts to channels have been avoided to the extent practicable that gains compliance
with the local zoning regulations pertaining to road safety and access. For reasons of
safety and traffic flows the City of Statesville, NC requires the construction of road
crossings 3 and 4. The developer, however, opposes constructing these crossings
because they result in incurred costs that do not produce a suitable financial gain.
Specifically, the development could proceed with savings from not building the roads
and from not mitigating impacts associated with road crossing 4. Without crossing 4
crossing 3 would not be constructed either because the small acreage of high ground
that it would accesses could not be sold at a price that would make the crossing
equitable. Considerable monetary savings would result from not building the roads even
with the loss of high ground not developed.
To the extent practicable, the proposed road configuration follows existing roads;
crossings are perpendicular and the minimal to achieve approval. Road surface are 60
feet wide, side slopes are 2:1 and fill heights are all approximately 18 to 20 feet tall.
These dimensions result in a toe of slope to toe of slope footprint of 132 to 140 linear
feet; channel meanders boost impacts into the 150 linear foot range.
The developer is in a quandary over the predicament he is now faced with. Do the cost
associated with the two above required crossings reduce the profit of the development
to a point where the project cannot proceed? Since the developer has not been able to
secure a final determination by the zoning board he has opted to attempt to permit the
crossing and mitigate the impacts on the same drainage down stream of crossing 1.
Mitigation:
Down stream of the impact areas the channel is degraded with bank failure evident in
many segments. We propose to stabilize banks with vegetative plantings to prevent
sedimentation. Buffers will be re-established during the mitigation effort.

Comments:
Under NWP No. 26, the applicant has proposed to impact 596 linear feet of perennial, mi 'gatable
channel- 149 linear feet of intermittent, non-mitigatable channel, and 0.30 acre of headwater
wetlands. Under NWP 14, the applicant has proposed 149 linear feet of impact to a perennial,
mitigatable channel. The impacts are necessary for the construction of a road to access a proposed
residential subdivision. Crossings, No. 1, 2, 3, & 4 are on channels that have high quality riparian
wetlands associated with them. These wetlands are located adjacent to the stream channel and are
providing emportant aquatic functions, (one issue in particular that should be resolved prior to the
issuance of the 401 is the need for crossings 3 & 4. Apparently, the developer does not want to
construct these crossing since they will open Imo, if any, additional area for home construction;
however. they are significant to the developer from a financial standpoint in that they are
considerably more expensive to install with little financial gain.

Unfortunately, the Iredell County zoning Office has a connectivity r?uirement for subdivisions that
r,,ire roads to "flow" through the development and not be hindered by cul-de-sacs. While this
approach is commendable, it will result in unnecessary impacts to mitigatable channels that neither
the developer nor DWQ favors. Considering the quality of the streams to be impacted. this Office
believes that it is important enough to advise the applicant of DWQs desire to avoid these channels
by not installing the road crossings. It may be necessary to provide written direction to the ap Iil?-
so that he can advise the local government of DWQ concerns. Approval of this 401 request should
he withheld until such time as the applicant has resolved this issue with the local government. It
should also be pointed out that the sianificance of all the crossings in this request is 149 feet in length
(one foot less than the mitigatable threshold). Considering the topography on this site, it may be
difficult maintainina 149 feet of impact on each channel crossing- Follow-up compliance inspections
will be necessary to ascertain whether the applicant has been able to limit the impacts to 149 feet or
less,
