Good Afternoon Sue,
Following the delineation, the applicant evaluated numerous designs in attempts to avoid and minimize impacts to
streams and wetlands for the proposed residential sub -division. The initial design included a total of 36 residential lots
and proposed a road crossing to access/develop lots on the northern portion of the site. This would have resulted in the
additional proposed impact to 273 linear feet of stream channel and 0.087 acres of wetlands (see Exhibit 1,
attached). In attempts to avoid and minimize impacts to WoUS, the applicant reduced the overall proposed residential
sub -division from 36 to 30 residential lots by eliminating the road crossing that provided access to the 6 residential lots
on the northern portion of the site. This design proposed 153 linear feet of stream channel and 0.013 acres of wetlands
due to the alignment of the roads, road intersection and residential lots near the vicinity of residential lot 5 (see Exhibit
2, attached). In further attempts by the applicant to avoid and minimize impacts to WoUS, the applicant re -aligned the
roads, road intersection and residential lots to minimize Impact Area #1 to 42.8 linear feet of stream impact and 0.006
acres of wetland impact. Based on the above documentation, it is our opinion that the applicant has fulfilled avoidance
and minimization of streams and wetlands to the maximum extent practicable.

To further document avoidance and minimization to the maximum extent practical, please provide a discussion of
realigning the road intersection at Impact #1 further to the south, towards lot Number 5. If your analysis includes
financial considerations, please be sure to determine if the local government will require buffer mitigation for any
portion of the buffer impacts and incorporate that into your analysis.
