specifically depicted on the Plans.
Section 1.20 "Mortgage" shall mean and refer to a mortgage or deed of trust constituting a first
lien on a Unit.
Section 1.21 "Mortgagee" shall mean and refer to the owner and holder of a Mortgage that has
notified the Association in writing of its name and address, and that it holds a Mortgage on a Unit. Such
notice will be deemed to include a request that the Mortgagee be given the notices and other rights described
in Article XVI.
Section 1.22 "North Carolina Condominium Act" shall mean and refer to Chapter 47C of the
North Carolina General Statutes.
Section 1.23 "Owner" shall mean and refer to the record owner, whether one or more persons
or entities, of fee simple title to any Unit but shall exclude those persons or entities having an interest in
any Unit as merely security for the payment or performance of an obligation.
Section 1.24 "Parking Facility" shall refer to the one (1) story at grade parking garage to be
constructed under the Buildings which will generally be a Common Element (containing Limited Common
Element spaces, land perhaps garages and storage spacesl) the use of which shall be restricted as more
particularly described in Section 3.1 of this Declaration.
Section 1.25 "Plans" shall mean and refer ' to the Condominium plat and plans, prepared by
Wilbur and Associates, PA and recorded under the name of the Condominium in the Unit Ownership File
under the file number stamped or written on the first page of this Declaration in the Registry. The Plans are
hereby incorporated herein by reference as if the same were attached to this Declaration.
Section 1.26 "Pro e " shall mean and refer to the Land, the Buildings (including all Units and
Common Elements therein or comprising the same) and all other improvements and structures located on
the Land, and all easements, rights and appurtenances belonging or appertaining to the Land. [if not all
Property for all Buildings is added initially then the -remaining Property that may be added shall be
defined as the "Additional Property"1
Section 1.27 "Registry" shall mean and refer to the Office of the Register of Deeds of
Mecklenburg County, North Carolina.
Section 1.28 "Special Declarant Rights" shall mean has the meaning given in N.C.G.S.
§47C-1-103 .
Section 1.29 "Supplemental Declaration" shall mean any supplement or amendment to this
Declaration pursuant to which Declarant exercises any right of Declarant reserved herein to add construct
and add additional Buildings, Common Elements and Units to the Condominium, in conjunction with its
phasing of the Condominium.
Section 1.30 "Unit" shall mean and refer to a portion of the Property located within a Building
that is the subject of individual ownership by an Owner (as more particularly described in Article IV of this
Declaration). ;

Gentlemen:
On July 2, 1990, your office issued a renewal of NPDES Permit
No.. NCO062413 to the Linville Ridge Development Company for
discharge from a wastewater treatment plant serving their clubhouse
facilities. As a condition of the permit, it was required that an
engineering evaluation be conducted within 12 months to evaluate
non -discharge alternatives. The result of the evaluation was, -a
determination and recommendation that the effluent be piped
downstream some 21000 feet to a point of positive 7Q10 flow rate.
On behalf of our client, Linville Ridge Development Company, we had
transmitted to you our initial report and had 'subsequently sent
additional supporting documentation. It was our understanding that
your office had agreed with our.findings and recommendations.
We now understand through a June 9, 1992, letter to Linville
Ridge Development Company that the proposed relocating of the
discharge constitutes a major modification to the NPDES Permit and
as such must be submitted through a formal application with
supporting documentation. Therefore, we hereby request on behalf
of the Linville Ridge Development Company that you. modify- the
current NPDES Permit -,so as to approve the relocation of the
discharge to a point approximately 2,000 feet downstream.
Attached please find three (3) copies of "Application for
Permit to Discharge -Short Form Dll which have been executed by Mr.
Gary G. JohnsTon of Linville Ridge Development Company, together
with a check for $400.00 to cover the processing fee. Also
included are the design calculations supporting our proposed
discharge•point relocation which is indicated on an accompanying
map. These calculations are appended to a copy of a letter to Mr.
Dale Overcash of your office marked as Exhibit A.

Dear Mr. Jonnston:
In accordance with your permit modification request, the
Technical Support Branch of the Division of Environmental Management
has completed a wasteload allocation for the requested change in
location of your wastewater discharge. Attached to this letter is a
copy of the wasteload which lists the existing permit limits and the
proposed effluent limits to be included in the permit if the discharge
is relocated.
Please advise this office as soon as possible as to your choice
of maintaining the existing discharge location and complying with the
more stringent effluent limits or relocating the discharge point to a
location where the stream has more flow. Additionally, I would like
to point out that effluent data -submitted for your facility indcates
that there maybe a problem complying with the ammonia nitrogen limit
without additional treatment facilities. It is recommended that you
discuss this situation with your engineers to determine the best
solution for this problem.
