Thorpe, Ph.D.; Acting Director -- - = Division of Water Quality Re: NCSU Main Campus Drive and South East Entrance Drive APPROVAL of 401 Water Quality Certification and Authorization Certificate per the'Neuse River Buffer Protection Rules (15A NCAC 2B.0233) with ADDITIONAL CONDITIONS Dear Mr. Worsley, You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.10 acres of wetlands and 460 feet of streams for the purpose of constructing the Main Campus Drive and South East Entrance Drive at Centennial Campus and 60 feet of stream for the placement of a rip-rap apron associated with the South East Entrance Drive crossing, as you described within your original Pre-Construction Notification (PCN) application dated January 18, 2000 with revisions on August 8, 2000 and July 11, 2001. After reviewing your application, we have decided that this fill is covered by General -Water Quality Certification Number 3289 and 3108' This Certification allows you to use Nationwide Permit Number 14 and 26 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved Authorization Certificate for impacts to the protected riparian buffers as required under 15A NCAC 213 .0233(8). In addition, you should get any other required federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This Certification replaces the one issued to you on August 15, 2000. This approval is only valid for the purpose and design that you described in your revised application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland, compensatory wetland mitigation may be required as described in 15A NCAC 2H.0506 (h). For this approval to be valid, you must follow the conditions listed in the DWQ General Certification No. 3287 and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet of surface waters to notify the state in order to assure compliance for future wetlands and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. 3. You are required to mitigate for impacts to the streams and their protected riparian buffers. The required area of mitigation to compensate for impacts to the streams and their protected riparian buffers is 520 feet of stream and 124,800 square feet of buffer as required under 15A NCAC 2H.0506 and 213 .0242. DWQ shall be copied on a buffer and stream mitigation plan for these impacts within 10 days of the issuance of this approval. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Z do We respectfully request a modification to the approval of 401 Quality Certification for the crossing of the "Unnamed Tributary" by Southeast Entrance Drive, DWQ Project # 000060. The disturbance to the "Unnamed Tributary" leading out of the existing farm pond north ofu i Southeast Entrance Drive has increased by ±60 linear feet from the original permit. The cz increase resulted from the extension of the riprap apron at the inlet of the twin 60" RCP storm pipe system northward to the base of the pond's dam. The extension of the riprap apron will protect the channel in this area from further erosion caused by discharge from the outlet of the pond. Enclosed please find a Vicinity Map and a Wetlands Impact Map for your use. We have requested and received the 404 general permit verification from the US Army Corps of Engineers Action ID # 200020270 for the above mentioned modification from Todd Tugwell. Several areas are currently being evaluated for suitability of on-site mitigation for streams and buffers. The College of Veterinary Medicine and the Lake Wheeler Field Research Laboratory are being evaluated as possible stream and buffer restoration sites. Additionally, a tributary to Lake Raleigh, located on the Southwest corner of Lake Raleigh, is being considered for buffer preservation. The University is awaiting two items in order to make a decision as to how best to proceed. These items include a suitability and cost analysis of restoration projects being prepared by NC State Water Quality Group, and the preservation assessment of the Lake Raleigh tributary being conducted by DWQ staff, as requested in the referenced letter. We expect to have the information by 30 September 2000 and will provide written confirmation of the University's mitigation plan at that time. If on-site mitigation proves not to be a practical alternative, the University will fulfill its mitigation requirement through payment to the Wetlands Restoration Program. Because of a realignment of South East Entrance Drive, there will be fewer impacts to the wetlands there. We had requested and had been approved for 0.371 acre of total disturbance in the DWQ Project # 000060. The disturbance for the South East Entrance Drive is now 0.10acres versus 0.371. We would also like to amend the records for cumulative impacts to this point. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3102 and 3108. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when the Corps of Engineers issues them. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, No Discharge and Water Supply t Watershed regulations. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. 3. DWQ shall be copied on a buffer and stream mitigation plan for these impacts within 60 days of the issuance of this approval. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. PROPOSED PROJECT DESCRIPTION North Carolina State University intends to construct a multilane roadway system (Main Campus Drive South and the connector between Main Campus Drive and Centennial Parkway). Construction will begin from the existing southern stub-out of Main Campus Drive at its intersection with Capability Drive South and eastward approximately 3,600 linear feet past its proposed intersection with future eastern Main Campus Entrance Drive, across Walnut Creek to the southern entrance of the proposed Campus Conference Hotel facility. The proposed section of Main Campus Drive will be 43 feet wide. The Connector to Centennial Parkway will be approximately 1,450 linear feet, and 78 feet wide. Portions of the proposed alignment have been cleared and rough graded in conjunction with the restoration of the Lake Raleigh Dam. The proposed roadway system is being designed to meet the North Carolina State University Centennial Campus, Phase I, master plan zoning compliance documents. Main Campus Drive South is proposed to be constructed as a 43' back to back curb and gutter roadway from its existing termination to a point south of Walnut Creek where it will provide access to the future Conference Center development. In later phases it is to be continued southward eventually connecting to the Magnet Middle School. The Southeast Entrance Connector between Main Campus Drive South and Centennial Parkway is proposed to be constructed as a multi-lane facility with a 16-foot wide divided median. It will be ±1,450 feet in length. The improvements and construction of Main Campus Drive South and connector to Centennial Parkway will include a landscaped shoulder and median as well as pedestrian sidewalks, and bike lanes. The roadway will cross Walnut Creek utilizing a system of multiple box culverts. The unnamed tributary crossing will be made using reinforced concrete pipe. B. PURPOSE AND NEED FOR PROPOSED PROJECT The project will provide multi lane roadways, bikeways, and sidewalks for utilization by motored vehicles, bicycles and pedestrians on Centennial Campus. It will compliment the existing vehicular circulation system and provide an additional link for ingress and egress to the developing Centennial Campus. C. ALTERNATIVES ANALYSIS In the Master Planning Phase of Centennial Campus and in the design development of the project, several alignments have been considered. The alternative chosen has the least impacts on Walnut Creek, South Creek, the unnamed tributary, wetlands, floodplain, and Neuse Buffers. Other alignments studied encroached into the floodplain to a greater extent, crossed stream channels at angles, paralleled streams within buffer areas and crossed through the middle rather than edges of wetlands. The no action alternative would result in a no build situation. This would represent a failure of the University to meet its commitments to both the people of North Carolina and the University's corporate partners. Alternative alignments would not serve the existing and/or proposed development outlined in the approved Campus Master Plan. Selection of an alternative alignment would be less supportive of existing development and would not take advantage of the previously improved alignment. Selection of alternative alignments for these roads would therefore be less supportive of existing and planned development. D. EXISTING ENVIRONMENTAL CHARACTERISTICS OF PROJECT AREA (1) (2) Topography & Soils The site is located in the Raleigh Belt of the Piedmont physiographic province. According to the USDA Soil Survey for Wake County (Exhibit 5) most of the site falls in the (Ceie3) Cecil series. These soils are typical of the region and present no constraints to urban development. Slopes along the proposed alignment range from 0% to 18% with elevations varying from 266 feet to 320 feet MSL. Exceptions to this description are several areas of cut and fill material excavated and/or placed on the site during the repair of the Lake Raleigh Dam and construction of other facilities on the campus. Soils in this area have been classified as the Cecil (CeF), Chewacla (Cm), Wilkes (WmF) Series according to the Wake County Soils Survey. No water table was encountered in the vicinity of this project during the prior grading operations and repairs to the dam. Off site borrow will be necessary for the project. Imported fill will be obtained from areas previously designated for borrow areas on Centennial Campus or areas approved for excavation under separate local, State, or Federal permit approvals and permits. Should it become necessary to dispose of unsuitable soil material, it will be removed to areas previously designated for waste soil material off campus. All appropriate permits will be obtained for off site borrow and waste areas if not already in place. (3) Land Use This project will impact approximately 1.0 acres of currently rough graded land and ±16.0 acres of undisturbed area. It will also impact ± 175 linear feet of Walnut Creek's channel, ±175 linear feet of the unnamed tributary's channel, adjacent flood plain areas, and approximately ±0.30 acres of Jurisdictional wetlands adjacent to Walnut Creek and its tributary. The approved Master Plan for the Centennial Campus, the Open Space and Recreation, and previous environmental documents collectively describe a coherent organization of land uses within the Centennial Campus. The proposed project is in keeping with these documents and is consistent with the carrying capacity of the natural systems throughout the campus. 4 Adjacent land uses consist of undeveloped Centennial Campus land to the east and west, Lake Raleigh and undeveloped land to the south and the existing Centennial Campus buildings to the north. The proposed project will provide access to new and proposed sites on the campus as well as an additional point of ingress and egress for the campus. (4) Wetlands Approximately 175 linear feet of 404 and 401 jurisdictional waters of the U.S. within the banks of Walnut Creek and its tributary will be impacted by the proposed alignment. Approximately ±030 acres of 404 jurisdictional wetlands adjacent to the two creeks will also be impacted. (Exhibit #6). (5) Prime or Unique Agricultural Lands The supplement to the 1982 Wake County Soil Survey entitled Important Farmland indicates no important farmland on this site. Although portions of the property appear to have been farmed in the past, no farming activity has occurred within recent years. According to Mr. Milton Cortes of the USDA (Exhibit #7), there are no unique farmlands in the area. USDA criteria outlines that prime farmland does not include land already in or committed to urban development or water storage. Prime farmland `already in' urban development includes all land that has been designated for commercial or industrial use or residential use that is not intended at the same time to protect farmland in a 1. Zoning code or ordinance adopted by a state or local unit of government or 2. A comprehensive land use plan which has expressly been either adopted or reviewed in its entirety by the unit of local government in whose jurisdiction it is operative within 10 years preceding the implementation of the project. (6) Public Lands and Scenic, Recreational, and State Natural Areas The Centennial Campus property is owned by the State of North Carolina and allocated to NC State University for management. Neither parkland nor designated or recognized scenic areas nor any "informal" recreational uses presently exists on the proposed site. (7) Areas of Archaeological or Historic Value The survey of Centennial Campus by Thomas H. Hargrove of Archaeological Research Consultants, Inc. in November 1986 and included in the Environmental Impact Statement for North Carolina State University Centennial Campus identified no significant discoveries of archeological or historical value. (Exhibit #8) (8) Air Quality Currently, Wake County is in attainment for all criteria pollutants. However, the county is undergoing evaluation for redesignation for ozone to nonattainment. The proposed site is within the City of Raleigh limits Current sources of air emissions in the area are automobiles and heating boilers, air handling units, and emergency generators from nearby office buildings, labs, and classrooms. During dry periods dust from adjacent construction and the unimproved roadway also contribute to particulate matter in the air. (9) Noise Levels Current noise levels are minimal since the roadway currently terminates at the southern end of the existing Centennial Campus. Existing noise levels in the vicinity are largely attributable to automobile traffic. Existing Main Campus Drive, Centennial Parkway, Research Drive, Capability Drive, and to construction repairs to Lake Raleigh and its dam and to building construction on nearby Centennial Campus projects. (10) Water Resources (Surface Water and Groundwater) The proposed project falls within the Lake Raleigh/Walnut Creek Watershed. Lake Raleigh is now classified as WS-III-NB-NSW and will once again be a valuable natural resource when restored, making it important as a recreational and visual asset to Centennial Campus. The proposed roadway will drain to Lake Raleigh and to Walnut Creek and the unnamed tributary to Walnut Creek. Through July 1986, Lake Raleigh was classified as a WS-II water supply for the City of Raleigh. The lake was reclassified to its current status by the North Carolina Division of Environmental Management, Water Quality Section. This designation allows for recreational uses, but still provides protection as a water supply. In September 1996, Lake Raleigh's dam failed due to the heavy rains associated with Hurricane Fran and the lake drained. In the near future, it is expected to function as a lake again. The University is committed to a stormwater management system designed to prevent reduction of the water quality in Lake Raleigh and is currently working to restore the dam and remove sediment deposition from the lakebed. Soil borings along the proposed alignments revealed groundwater existing at locations between 1.5 and 2 feet below the existing grade in the vicinity of Walnut Creek. It is expected that the proposed crossings at Walnut Creek and the smaller creek will have a minor effect on the groundwater levels near these two crossings. These impacts will be confined mainly to the construction phase of the project. The borings reveal no significant pattern of ground water. In the areas adjacent to the proposed roadway where boring for other projects have been performed, groundwater did not exist at levels of the proposed 6 excavations. No ground water has been encountered in the proposed borrow area or potential spoil areas. Copies of the soil report can be made available upon request. The Walnut Creek drainage way is located on the southern side of the alignment. It is classified as B NSW water. The creek is the discharge for Lake Raleigh and a watershed of several square miles at its proposed crossing. Other surface drainage to the east and north consists of surface swales, an old farm pond; and the unnamed tributary to Walnut Creek, which is discharge from the pond. The unnamed tributary and Walnut Creek are the only surface features, which will be impacted by the proposed alignment. South Creek, which flows into Walnut Creek-from-the southern-part -of Centennial Campus, will not be impacted by this project. (See Exhibits #3 & #6). (11) Forest Resources N/A (12) Shellfish or Fish and Their Habitats Walnut Creek and its unnamed tributary to the north are both perennial stream which will be crossed by the proposed project. Both have been noted in previous documents as being aquatic habitat. Common species of fish and other aquatic fauna that are found in typical urbanized piedmont streams can be expected to exist in Walnut Creek and its unnamed tributary. These have been documented in the approved EIS for Centennial Campus. (13) Wildlife and Natural Vegetation According to the National Institute for Urban Wildlife's inventory of the terrestrial ecology for the Environmental Impact Statement for North Carolina State Centennial Campus, there are no unique habitat or species and no threatened or endangered species present on the Centennial Campus site. Since the project alignments have been significantly disturbed in conjunction with prior agricultural and campus projects, wildlife habitat has already been effected within the project area. Areas other than those already impacted include large areas of Kudzu and mixed hardwood and pine forest. Neither protected species nor indicators of such species have been found along the proposed alignment or in either Walnut Creek or its northern tributary. E. PREDICTED ENVIRONMENTAL EFFECTS OF PROJECTS (1) Topography N/A 7 (2) Soils N/A (3) Land Use Changes in land use will be consistent with the North Carolina State University Centennial Campus Master Plan, the Open Space and Recreation Master Plan, the FEIS and previously submitted EA's. The additional point of ingress and egress at Centennial Parkway will provide for better surface vehicular access to the campus. (4) Wetlands The proposed project will impact ± 175 linear feet of Walnut Creek's channel and its tributary's channel and ±0.30 acres adjacent flood plain which have been delineated as 404 jurisdictional areas. (5) Prime or Unique agricultural Lands N/A (6) Public Lands and Scenic, Recreational, and State Natural areas N/A (7) Areas of Archaeological or Historical Value N/A (8) Air Quality As indicated in the FEIS for Centennial Campus, there will be temporary, localized impacts on air quality from dust and exhaust emissions resulting from land clearing and construction activities. Open burning will not be permitted during construction, as stated in the FEIS. Building programs are not anticipated to generate fumes or other problematic emissions. Traffic analysis provided by Kimley Horn & Associates for the Centennial Campus EIS and other documents indicate the projected level of service for this project and intersections exterior to the campus will not be reduced to levels which would cause air quality to decline. With the second connection to Centennial Parkway constructed with this project, air quality related to exhaust emissions could see potential improvements. Due to the type and scope of the proposed project and the traffic projections prepared for the EIS and Master Plan, no air quality permit is required. 8 (9) Noise Levels Noise levels, which will be generated within and around the proposed roadways and walkway systems, will not be objectionable. During the building of the project and future structures adjacent to the roadways, noise levels normally associated with construction will occur. It is projected that vehicles utilizing the roadways after their completion will not create significant noise levels. (10) Water Resources (Surface Waters and Groundwater) Ground water is not expected to be encountered during construction except where it may exist in the vicinity of the Walnut Creek and tributary culvert construction. However, if it is, appropriate measures consistent with the FEIS and regulatory constraints will be employed. Measures will be taken to divert ground and surface water through or around the construction. Permanent measures will be installed to assure that neither ground nor surface water is trapped by the project. The construction of Main Campus Drive South and connector to Centennial Parkway with the associated walkways and median will create approximately 6.5 acres of impervious surface. Stormwater runoff from these areas will be directed to stormwater facilities along the roadways and piped to existing natural surface features on Centennial Campus. Conveyance facilities will consist of subsurface storm drainage culverts, curb and gutter, and overland flow. The stormwater run off velocity from the project will be controlled as described in the FEIS developed for Centennial Campus. The direction of surface water runoff will remain as it now is, into Lake Raleigh, Walnut Creek and its tributary. There will be no new impervious surface that will not have run off velocity controlled prior to discharge into the receiving natural drainage way. With controls in place, long-term increases in stormwater velocity from the project area are not expected, nor will there be any long-term detrimental impacts on stormwater or groundwater quality. Minimal short-term impacts to surface waters may be seen from land disturbing activities associated with construction of the project. Areas subject to the Neuse River Buffer Rules have been identified within this project. The Neuse River rules apply to the Walnut Creek's and its tributary's streambeds and 50 feet on both sides of the streams as measured from top of bank. Prior to construction, a sediment and erosion control permit will be obtained for all areas to be disturbed during this project. An NPDES permit for the construction will also be obtained, if necessary. Existing measures have been incorporated into the Centennial Campus to reduce stormwater velocities, quantities and suspended solids. Additional stormwater velocity control measures are to be incorporated into this project. Based on the currently available information and the existing and proposed improvements, this project will have no 9 long-term adverse impact on groundwater, surface waters, or the eutrophication of receiving waters. (11) Forest Resources N/A (12) Shellfish or Fish and Their Habitats There will be no long-term impact to aquatic species due to this project. However, some fish may have short-term displacement and incidental mortality during the construction of the stream crossings. (13) Wildlife and Natural Vegetation N/A (14) Introduction of Toxic Substances No toxic wastes should be associated with this project. No operations should occur which would generate such wastes within the Limits of this project. F. MITIGATIVE MEASURES The University is committed to ensure that development on Centennial Campus is conducted in accordance with responsible land stewardship, as well as the recommendations and agreements included in the FEIS, approved Phase I Master Plan and Zoning Conditions established for the.campus. The following measures are to be employed to mitigate the possible adverse environmental consequences of this development. (1) Topography N/A (2) Soils N/A (3) Land Use N/A 10 (4) Wetlands The waters of Walnut Creek, its unnamed tributary and adjacent jurisdictional wetlands adjacent to the two streams will be protected by sediment and erosion control facilities during construction and by sediment control and storm water velocity controls as described in the previous environmental documents for Centennial Campus. Proposed alignments have been designed to avoid wetlands where possible and to cross Walnut Creek and its tributary at as close to perpendicular as possible. The jurisdictional areas proposed to be impacted by the project have been minimized and will be permitted accordingly. Where required by the permitting agencies, the necessary disturbance to the creek channels and adjacent wetlands will be mitigated elsewhere on the campus or the appropriate mitigation fees paid to the designated wetland funds. Where Neuse River Buffers are impacted by the stream crossings, disturbed areas adjacent to the completed roadways will be restored to woody vegetation. (5) Prime or Unique Agricultural Lands N/A (6) Public Lands, scenic and Recreational Areas N/A (7) Areas of Archaeological or Historical Value N/A (8) Air Quality N/A (9) Noise Levels N/A (10) Water Resources (Surface Water and Groundwater) Stormwater management will be provided at pipe outlets via velocity control measures. These provisions will mitigate the water velocity impacts of the proposed project. 11 The control of sedimentation and erosion will be outlined on plans submitted to and approved by the NCDENR Division of Land Resources, Land Quality Section and the City of Raleigh (courtesy review) for this project. Methods and devices to meet these requirements will be installed and maintained to provide proper control and prevent offsite damage. Care will be taken to contain sediment and keep it from entering Lake Raleigh, Walnut Creek, and the unnamed tributary. The disturbed area associated with this project will be reseeded and stabilized immediately following the construction. The areas adjacent to roadways and walks will be landscaped with trees and shrubs at the appropriate time of year depending on species. The proposed crossings of Walnut Creek and its unnamed tributary will be designed and . constructed to cross the streams at as close to perpendicular as possible. Inlets and outlets at the crossings will be designed to control excess velocities. The buffers adjacent to construction will be protected with the appropriate barriers. Provisions for future utilities will be made within the crossings to prevent future disturbance. (11) Forest Resources Comments received from the North Carolina Wildlife Resources commission for EA/FONSI 98-0227 have been reviewed in conjunction with the on going planning for the Centennial Campus and will be taken into consideration as future landscape plans and streetscapes are developed. Where appropriate, species will be selected and planted which will afford value to wildlife in the short and long term. Streetyard and pedestrian ways adjacent to the proposed roadway will include appropriate plantings to limit views into existing and proposed parking areas and enhance the overall Centennial Campus Master Plan and City of Raleigh zoning conditions. Landscaping of areas adjacent to the roadways and pedestrian ways and within the medians will include trees, shrubs, grasses, mulches and/or ground covers. Selection of plant material will take into consideration species that might provide sources of food for songbirds and other wildlife species found on the Centennial Campus. CONCLUSION AND RECOMENDATIONS In agreement with the recommendations of the approved Environmental Impact Statement for NCSU Centennial Campus and this Environmental Assessment, the following conclusions and recommendations are made: • NCSU will take mitigative measures as outlined in this document in agreement with the EIS, the Phase I Master Plan, Rezoning Conditions and applicable federal, state, and local statutes and standards. 12 • The construction of this section of Main Campus Drive South and the Southeast Entrance Connector to Centennial Parkway on the Centennial Campus will not negatively affect the environment as discussed herein. Any environmental consequence& of this, project will be. minimal and confined to the. construction process. No Environmental Impact Statement is to be prepared for this project. This finding of No Significant Impact completes the environmental review record for this project, which is available for inspection at the State Clearing House, NC Department of Administration. • The summary of this EA/FONSI shall be published in the Environmental Bulletin. 13 G. These Incremental impacts in conjunction with other incremental impacts to a basin are likely to cause a significant cumulative adverse impact on flood storage and water quality in this basin. There has been a previous request for expenditure of federal funds to alleviate the consequences of flooding to the Rochester Heights area within tltc Walnut Creek subbusin. These flood projects typically request channel vnidening, riprapping of strcambanks and oversize culverts. These type actions to treat the symptoms of poor floodplain prowotion result in adverse impacts to fish and wildlife habitat. It is not clear from the document what the impacts to the 100-yyear floodplain will be from this project. We recently expressed concern (Lake Raleigh, DLNR No. 00-E- 0043) about the cumulative impacts to wetlands and floodplain resulting from consuwtion of tho NCSU Centennial Campus. We can concur with the pro( ect Provided that efforts are made to minimize the direct impacts to wetlands and the floodplain and the cumulative impacts to the 100-year floodplain are not significant.
