APPROVAL of 101 Water Quality Certification

Dear Mr. Kidd:
You have our approval, in accordance with the attached conditions and those listed below, to excavate 0.2 acres
of lake bottom on High Rock Lake in Rowan County for the purpose of providing private recreational pier access, as
you described in your application received by the Division of Water Quality on December 18, 2000. After reviewing
your application, we have decided that this action is covered by General Water Quality Certification Number 3280.
This certification allows you to use General Permit Number 198200030 when the Corps of Engineers issues it. In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but
not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed
regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise
specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application.. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you
must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a
hearing. y
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

The applicant is requesting 401 Water Quality Certification from the North Carolina Division of
Water Quality. The NCWRC has reviewed information provided by the applicant, and field biologists on
our staff are familiar with habitat values of the project area. These comments are provided in accordance
with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d) and the Federal License of Water
Resource Project Act (Federal Power Act-16 U.S.C. 791 a et seq.) as well as the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-6674).
'fhe applicant proposes to dredge four feet of material from High Rock Lake. The purpose of the
project is for a boat pier access channel. This activity will occur on a Federal Energy Regulatory
Commission Project.
Based on our review ofthe documents submitted, we have no objections to the project as
proposed. Unless suction dredging is utilized, activities should be accomplished in the dry during low
water lake levels. 'file NCWRC also encourages the utilization of Fish-Friendly Pier construction practices
such as those designed by Duke Power. We also recommend the establishment of shoreline vegetation for
enhanced habitat and shoreline erosion control. All excavation activities must follow any guidelines
required in FERC operation and licenses as well as any other special conditions specified by the NC
Department of Environment and Natural Resources. Turbidity and sediment impacts from the project
should not violate NC Sate water quality standards. Attached is a copy of a DWQ settling basin design
utilized by Duke Power on their lakes for similar dredging activities. We do not recommend a direct
discharge into the lake as an onshore disposal site should provide better protection.

I am requesting written approval to excavate and remove sediment within the
Yadkin River basin - High Rock Lake. I am requesting this permit approval to
facilitate recreational boat access to my private pier. This area of concern has
never been excavated and has continued to be filled with siltation.

Excavation Plan
A private contractor specializing in excavation is to be hired to complete the
planned excavation. The planned excavation is to encompass permitted pier #2935
and pier #2880. According to records and information from the original owners,
this area within this small cove indentation on Crane Creek has never been
excavated or dredged.
It is panned to remove approximately 2 feet of loose siltation and sand from the
area between the stated permitted piers, from the high water contour line to the
end of the fixed piers. This planned excavation is expected to remove an area
of 4,601 square feet, with average removal of 2 feet of siltation. Aggregate
excavation for this area will encompass approximately 9,202 cubic feet of
siltation. This equates to 1,022 square yards of excavation removal.
It is planned to remove approximately 4 feet of loose siltation from the area
beyond the fixed pier ends, clearly to the current high water level during the
upcoming winter drawdown. This area will also encompass the adjacent area where
the private boat ramps terminate, clearly to the current high water level during
the upcoming winter drawdown. These areas will be excavated to allow free and
clear normal drainage into the river basin.
This excavation will create an additional four feet of water depth, at full pond
(655') for these fixed piers with floating docks. This excavation will provide
approximately ten (10) feet full pond depth (655') at Yadkin pier #2880. Final
finished grade at pier ##2880, will be approximately 6451.
This excavation will create an additional four feet of water depth at full pond
(655') for these fixed piers with floating docks. This excavation will provide
approximately nine (9) feet full pond depth (6551) at Yadkin pier #2935. Final
finished grade at pier 42935, will be approximately 6461.
It is planned to remove approximately 4 feet of loose siltation and sand from the
area beyond the fixed piers, and encompassing the boat ramp termination points,
toward the high water contour line during he winter drawdown. This planned
excavation is expected to remove an area of 12,372 square feet, with average
removal of 4 feet of siltation. Aggregate excavation for this area will
encompass approximately 49,488 cubic feet of siltation. This equates to 5,499
square yards of excavation removal.
Total soil excavation and removal for this project is forecast at 6,522 square
yards.
This excavation will incorporate adequate drainage from the excavated site to the
lake basin. Excavation contours will be gradual and tapered to further
facilitate adequate drainage and and safe footage during low water drawdown
periods.

Resource Impacts Assessment
Slight resource impact is anticipated, due to lack of vegetation within this
proposed area. Removal of siltation and sediment from this area will actually
improve the water quality, due to additional depth and potential for added fish
habitat. Fish habitat is to be added into this area upon completion of
excavation project. This sediment removal will improve the water quality within
this cove section, due to added water depth and reduced potential for muddy
conditions during high traffic periods. Muddy water conditions are normally
noted presently, due to lack of depth and nominal wave actions. Photos are
attached for illustrating these conditions.
Plan and Schedule of Completion
It is proposed to complete this excavation project during he month of January -
2001, during the normal expected lowest draw down period. This project is
expected to be completed within 5 five working days, according to contractor
estimates. This excavation is expected to be commence on or before the mid-
January period - 2001.

Dear Mr. Kidd:
This Office is in receipt of your letter dated November 30, 2000 regarding a possible
dredging project. In order to dredge waters or wetlands along High Rock Reservoir, you will need
to apply for and receive a 401 Water Quality Certification from this Office. (Please be advised
that you may also need to receive approval from the Army Corps of Engineers.)
Please find the enclosed Pre-Construction Notification Application with instructions
along with the letter and supporting information that you sent to this Office. Seven copies of a
completed application should be submitted to this Office along with appropriate documentation
such as maps and a site plan that clearly detail the proposed impacts to surface waters and/or
wetlands. Also, please be advised that as of January 1, 1999 an application fee, made out to the
North Carolina Division of Water Quality, must be submitted along with the application in order
for the application to be processed. The fee is $200.00 for impacts of less than I acre of waters or
wetlands and less than 150 feet of stream or $475.00 for impacts of greater than 1 acre of waters
or wetlands and greater than 150 feet of stream. Also, please visit our web site at
