APPROVAL of Neuse River Riparian Buffer Protection Rules MINOR VARIANCE [15A NCAC 2B
.0233(9)(b)] with ADDITIONAL CONDITIONS
Dear Mr. Oaks,
You have our approval, in accordance with the conditions listed below, to impact ± 210 ft` of Zone 2
of the protected riparian buffers for the purpose of constructing the proposed single-family residential home.
This letter shall act as your Minor Variance approval as described within 15A NCAC 2B .0233(9)(b). In
addition, you should get any other required federal, state or local permits before you proceed with your project
including (but not limited to) Sediment and Erosion Control Permits and Cary Riparian Buffer Protection
Ordinance Approval.
This approval is only valid for the purpose and design that you described in your Minor Variance
Request dated 11/20/00 except as modified below. If you change your project, you must notify us and you
may be required to send us a new request for approval. If the property is sold, the new owner must be liven a
copy of this approval and is thereby responsible for complying with all conditions. For this approval to be
valid, you must follow the conditions listed below.
1. No impacts shall occur to Zone I of the protected riparian buffers.
2. Stormwater shall be directed to sheetflow at non-erosive velocities through the protected
stream buffers as identified within 15A NCAC 2B .0233(5). Roof drainage from the house
shall be directed to vegetated areas at non-erosive velocities prior to entering the protected
riparian buffers. Any additional stormwater located on the remainder of the property shall
be directed to sheet-flow at non-erosive velocities prior to entering the protected riparian
buffers. Roof-drainage should be directed outside of the protected riparian buffers and
discharged at non-erosive velocities. No new ditching or piping of stormwater through the
protected buffers is allowed.
3. A mitigation plan to compensate for impacts to the protected riparian buffer per 15A NCAC
2B .0242 must be approved by this office for this approval to be valid. One method to meet
this mitigation requirement is to make a payment into the Riparian Buffer Restoration Fund
administered by the NC Wetlands Restoration Program (WRP). In accordance with 15A
NCAC 2B .0242(7), this contribution will satisfy our compensatory mitigation requirements
under 15A NCAC 2B .0233(10). Until the WRP receives and clears your check (made
payable to: DENR - Wetlands Restoration Program), buffer impacts shall not occur. Mr.

WRP. You have one month from the date of this Certification to make this payment. For
accounting purposes, this Certification authorizes payment into the Riparian Buffer
Restoration Fund to compensate for 315 ft2 of required riparian buffer mitigation
(1.5:1 ratio) for impacts to 210 ft2 (and 27 linear feet) of protected riparian buffers; 03-
04-01 river and subbasin."
If you do not accept any of the conditions of this certification, you may ask for and adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, PO Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under the Neuse River Riparian

I am pleased to advise that on August 7, 1996, the Director of Development Review, based on the
review and recommendations from the Development Review Committee, approved the above
referenced site plan. Please note the following items for construction:
BEFORE ANY SITE WORK CAN BEGIN, you must obtain or submit (lie required items to the

prior to incorporation into the fmal plans.) Please submit these plans to the Planner

PRIOR TO THE ISSUANCE OF A RECORDED PLAT the following items must be addressed
and development fees paid to the Finance Department. The department listed below is responsible
