Dear Mr. Waters:
Division of Water Resources' Central and Regional staff has reviewed the application package
received December 12, 2019. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on March 12,
2020.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A and B, or failure to provide the additional information on or before the above requested date
may result in your application being returned as incomplete.
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with two paper
copies and one electronic copy submitted to my attention at the address below.

A. Application:
The submitted Land Application Site Certification (LASC 06-16) form indicates that all the fields
are being modified. Some of these fields are increasing in area, while some decrease in area.
However, there was not any explanation for these modifications. Some of the modified areas that
increased are drastically bigger such as NC-PI-201-02 (increased from 30.40 to 49.40 acres), NC-
PI-201-07 (from 35.40 to 48.69 acres), NC-PI-201-11 (from 12.00 to 17.64 acres), and NC-PI-201-
17 (from 5.3 to 10.44 acres). Please provide an explanation of why these acreages were modified.
B. Compliance Boundar■ 115A NCAC 02L .01071:
1. The submitted application area and setback maps did not include a delineation of the compliance
and review boundaries as defined in the 15A NCAC 02L .0107 and .0108 rules. In accordance with
the June 9, 2011 policy memorandum "Map Guidance for Residuals Land Application Fields (Non -
dedicated)" and 15A NCAC 02T .1104, compliance and review boundaries are required to be
delineated on application/setback maps. These maps shall be amended to meet this requirement.
Note: The maps may include a note indicating the delineation of the compliance and review
boundaries instead of the line drawn on the map. Please see the June 9, 2011 policy memorandum
for an example of this.
2. According to the submitted maps, there appear to be multiple water supply wells that would be
located within the compliance boundaries of land application fields. 15A NCAC 02L .0107(d)
prohibits the construction or operation of water supply wells within the compliance boundary,
which is established either 250 feet from the waste boundary or 50 feet within the property
boundary, whichever is closer to the source [15A NCAC 02L .0107(b)]. Water supply wells appear
to be within the compliance boundaries for the following fields:
➢ NC-BF-210-01 — The well is located between the two sections of this field.
➢ NC-BF-210-02 — The well is located east of the field.
➢ NC-BF-210-09 — The well to the north of the field.
➢ NC-BF-210-10 — The well to the north of the field.
➢ NC-BF-210-12 — The well to the south of the field.
An alternative to this requirement can be approved in accordance with 15A NCAC 02T .0105(h).
Upon the Permittee's request, the compliance boundary may be located closer to the waste disposal
area (i.e. more restrictive) due to an on -site water supply well. If this option is chosen, the following
items shall be resubmitted:
a. Section III on page 2 of 3 of the Land Owner's Agreement form (LOA 06-16) shall be updated
for the above fields to request for the alternative compliance boundary; and
b. Maps showing wells with the re-established compliance boundary shall be submitted with the
redefined boundary delineated, or include a footnote describing . the redefined compliance
boundary.
Please consult the June 9, 2011"Map Guidance for Residuals Land Application Fields (Non -
dedicated)" and January 31, 2007 "Alternatives for Water Supply Wells Inside the Compliance
Boundary" policy memorandums for alternative compliance boundary guidance. Please note that
the alternative compliance boundary shall be located at least 50 feet from the water supply well and
