Vincent National Auto Properties, LLC 5315 South College Road Wilmington, NC 28412 Dear Mr. Vincent: You have our approval, in accordance with the attached conditions and those listed below, to 6110.08 acres of wetlands and impact 25 feet of stream channel in New Hanover County for the purpose of commercial construction, as you described in your application received by the Division of Water Quality on November 1, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. . If you do not accept any of the conditions of this certification, you may ask for, an adjudicatory hearing. You must act within 60 days of the date that you receive this-letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. CD We have by copy of this letter also sent seven (7) copies of this same application with attachments to Mr. John Dorney with the NC Division of Environmental Management in Raleigh, NC. The subject site is owned by National Auto Properties, LLC, 5315 South College Road, Wilmington, NC 28412. Mr. Jon T. Vincent is the contact person for the property owners and is the individual that has signed the application. The wetlands on the property have been delineated. The delineation has been approved by the US Army Corps of Engineers based on your check of the delineation in the field. A copy of the Notification of Jurisdictional Determination is attached to the application. The proposed project consists of the following three (3) elements that will impact wetlands: 1. The expansion of an existing stormwater retention pond that will encroach on a small portion of the wetlands area. 2. The construction of an overflow pipe and flow dissipation structure that will divert properly regulated stormwater flows to Spring Branch. A temporary sediment trap will also be constructed in the creek channel as required by local stormwater regulations. However, this structure will be removed once construction work on the other elements have been completed. 3. A culvert installed in the creek to allow the placement of a road across the creek so that access to the rear portion of the property can be obtained. The culvert and flow dissipation structure will be so designed as not to impede natural flows (normal or peak) in the streambed. SITE REMEDIATION ' PERMITS ` WETLANDS DELINEATIONS ° EA/EIS PREPARATION Ms. Angie Pennock, US ARMY CORPS OF ENGINEERS October 10, 2000, Page 2. Figure 1 attached shows the location of the subject site on the Scotts Hill, NC 7.5 Minute Topographic Quadrangle. Figure 2 shows the project, the delineated wetlands and the relationship of these elements to the overall site. By necessity, this figure is 11"X17" in size in order to show all of these elements at a reasonable scale. Figure 3 shows an enlarged portion of the site where the proposed project will impact the wetlands. All of the major elements of the project are indentified on this plat. There is 0.41 acre of wetlands on the property, of which only a nominal 0.08 will be impacted by the proposed project. There will be little if any impacts to the streambed once the project is completed. However, some disturbance of the streambed is needed in order to install the culvert and flow dissipation structure. Siltation and erosion during construction will be controlled by standard techniques. The remaining wetlands on this property will remain intact and will continue to provide their normal natural functions unharmed, including that of adsorption and attenuation of stormwater flows both from this site and other upstream sources. Issuance of a Nationwide Permit for this work is respectively requested.
