The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. All work authorized by this permit must be performed in strict compliance with the permit plans, which are a part of this permit. 2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 3. All backfill materials will be obtained from a highground source and confined landward of the permitted bulkhead. -2- 4. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3274. This Certification allows you to use. your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. PROJECT SUMMARY: Benjamin B. Barnwell Trust proposes to construct a bulkhead 10.5' waterward of normal water level, and construct a 50' x 25' concrete boardwalk paralleling the bulkhead. Existing riprap along the applicant's shoreline will be used in conjunction with sand and gravel brought to the site for backfill. Benjamin Barnwell Trust Field Report Page 2 PROJECT SETTING The applicant's property is located on Harbour View Drive, more specifically described as being Lot 11, Section O, in Colington Harbour Subdivision. Colington Island, Dare County, adjacent the Roanoke Sound. Accordin` to the application, the property consists of approximately 12,941 square feet with 50?' of shoreline that is protected by riprap. The lot is undeveloped with the exception of the concrete riprap, and is vegetated with a variety of ?_rasses. Located north and south of the applicant's property are two residentially developed, bulkheaded lots. In April of this year, both riparian property owners received CAMA Minor Permits to install eight-foot wide concrete boardwalks adjacent to their bulkheads. The applicant's shoreline did show evidence of severe erosion in April of this year. The applicant's agent, Jeff Emanuelson, requested a General Permit in April to place riprap from normal water level to the alignment of an old remnant bulkhead, approximately fifteen feet waterward of normal water level (See Attachment #I). Mr. Emanuelson was informed that the placement of the riprap material in the manner requested could not be authorized through the General Permit process. Based on this information Mr. Emanuelson requested a General Permit (See Attachment #2) to place riprap along the shoreline with a maximum base of five feet waterward of normal water level, and backfill the shoreline. The existing riprap has successfully stopped erosion on the applicant's property. However, it is the contention of the applicant's agent that he only placed the riprap to stop the erosion while they applied for the Major Permit to build a new bulkhead. Located below the surface of the water bottom, between the old bulkhead alignment and normal water level is the old concrete and asbestos bulkhead. Water depths along the old bulkhead alignment are between 3'-0" and 3'-6". Inspection of the site revealed that there is no submerged aquatic vegetation within the remnant bulkhead alignment. Rock and riprap debris, remnant tieback rods and deadmen pilings litter the applicant's shoreline and shallow water bottom. Roanoke Sound adjacent to the applicant's property is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Roanoke Sound, at this site, is SB (swimming). Additional review indicates that there are no known archeological sites or unusual geological formations associated with the applicant's property. PROJECT DESCRIPTION The applicant, the Benjamin B. Barnwell Trust, proposes to construct 39.34' of replacement bulkhead, beginning at the return wall on the north side of the property, and extending approximately 5.33' behind a remaining 10.94' section of the old concrete capped bulkhead. The bulkhead will be 6'-3" tall, measured from shallow water bottom. The bulkhead will be wooden, and will be located 10.5' waterward of NWL. Benjamin B. Barnwell Trust Field Report Page 2 According to staff calculations the total area of shallow water bottom to be filled in conjunction with the new bulkhead will be approximately 527 square feet, and will involve the placement of approximately 61 cubic yards of fill waterward of normal water level. Existing riprap will be used along with gravel, as backfill landward of the bulkhead. According to the application, the landward limit of all land disturbing activity will be 25' from the proposed bulkhead allgnment. Immediately adjacent to the bulkhead the applicant proposes to place a 50' x 8' boardwalk, for increased protection against erosion. The remaining 50' x 17' fill area will have six inches of dirt fill to dress out the yard. Total landward disturbance is estimated to be 728 square feet. - ANTICIPATED IMPACTS • Construction of the bulkhead as proposed will result in the placement of approximately 61 cubic yards of fill water-ward of NWL, and the loss of approximately 527 square feet of shallow water bottom and Estuarine Water. • The concrete boardwalk will result in 401 square feet (< 10.8%) of impervious surface within the Estuarine Shoreline AEC. • High ground/ upland disturbance (landward of NWL) within the Estuarine Shoreline AEC will equal approximately 728 square feet. • Temporary localized turbidity can be expected during the installation of the bulkhead.
