Landex, Inc. proposes to place approximately 2213 linear feet of utility (sewer) line across portions
of the 113-acre Kings Grant property located across from the Concord Mills Mall in Concord, N.C.
(Figures 1 and 2). The subject property is positioned between the Rocky River (to the north) and
Concord Mills Boulevard (to the south). The purpose of this work is to provide services in support
of future development planned for the property.
A 40-foot easement is proposed from an existing sanitary sewer easement located east of the
property, extending westward following slope contours of an existing, but disturbed bottomland
system. Trenching will be undertaken to a depth of 7.5 feet with 1-foot of bedding. A 12-inch
diameter PVC pipe will be buried to depths of 6 to 6.5 feet. Backfilling will occur upon completion
of pipe placement to pre-construction grade elevations. The easement will be immediately re-
vegetated after construction and maintained for access purposes.
The proposed utility easement has been planned in an effort to avoid wetlands to the greatest extent
possible. Termination with the existing utility line at the east end of the project will result in
unavoidable impacts to jurisdictional systems due to the presence of wetlands along the existing
easement corridor in this area (Figure 2). Approximately 0.07 acre of wetland will be temporarily
affected at this termination point. A crossing of the disturbed bottomland community is also
unavoidable at the western end of the utility corridor in order to provide services to the southern part
of the tract (Figure 2). A successional, herbaceous wetland fringe area will be affected (0.02 acre),
along with approximately 40 feet of a small (2 feet in width) stream channel. As previously
indicated, jurisdictional systems within this former bottomland area are highly disturbed. This entire
system is currently being investigated as a mitigation site to include restoration of stream and
wetland components. All impacts will be temporary in that pre-construction elevations will be
restored after pipe placement and backfilling are completed.

Wetlands have been avoided wherever feasible, and all work will be concentrated within the 40-foot
easement limits in order to minimize disturbance. No long term loss of wetlands or streams will
occur as pre-construction grade levels will be re-established after completion of this project. In
addition, a comprehensive mitigation plan for the entire bottomland area on Kings Grant property
is being prepared and will be submitted for review and permitting by regulatory agencies.
Jurisdictional systems on the Kings Grant property were delineated, platted, and approved by the
U.S. Army Corps of Engineers on January 24, 2000 (see attached approval).
We believe associated jurisdictional impacts (0.09 acre of wetland and 40 linear feet of stream
channel) can be permitted under Nationwide Permit (NWT) #12 for utility line work (65 FR 12887-
12888, March 9, 2000). This project will have minimal impact on wetlands (less than 0.10 acre) and
no mechanized land clearing of forested vegetation will be required to complete the work (all
wetlands have been previously cleared and are currently in a successional state). An erosion and
sediment control permit has already been received from the county for proposed actions. Our review
of the notification procedures for issuance of NWP # 12 indicate that project activities do not qualify
for notification to your office. However, we are providing you with this submittal and request
review and concurrence with our evaluation for compliance with NWP #12. Right-of-Way and
Easement agreements for access to adjacent properties are also provided as part of this package. By
copy of this letter, we are also notifying the N.C. Division of Water Quality (DWQ) of our intent to
proceed with this project under existing General Certification #3288 without the need for written
concurrence.

Construct a temporary road in order to bridge and provide access for construction equipment
across an utujamed tributary to Rocky River and adjacent wetlands. The crossing will consist of
S side by side 36-inch, 40 foot long culverts in the channel and two side by side IS-inch, 40 foot
long culverts in.the wetlands. The work will temporarily impact approx. 0.06 acre of wetlands
and approx- 40 linear feet of an approx. 20 foot wide stream channel. After upland site
construction is completed, the temporary crossing will be remcoved and the stream channel and
wetlands impacted restored to the original condition (and in accordance with your submitted
"Restoratiou Plan").
