They are building a home and have cleared some of Zone 2. No violation. However, they may be planning to but a parallel driveway within Zone 2. If not, let me know I'll head out there during lunch today. - Bob "Steve, I just received a call from a Mr. Herman Lipkin (852-4886) concerning a potential violation of either buffers, 401 or erosion and sediment control. He said that they are working very close to a stream. The subject property is adjacent to his. He lives at 2608 Bradford Grove Place, off Graham-Newton Road, two blocks from Penny Road, Raleigh. The subject property apparently has a construction entrance off Blue Cypress Lane (possibly a new road). Please have someone over there check into this. Let me know if no one can get to it and I'll see if I can get out there tomorrow. The site inspection was conducted in response to a citizen complaint involving the potential clearing of vegetation along a stream within the Lake Wheeler watershed. The investigation revealed that protected riparian buffers associated with an unnamed intermittent tributary stream to Dutchman's Branch above Lake Wheeler had been impacted. Dutchman's Branch and the unnamed stream are within the Neuse River basin and are classified by the NC DWQ as Water Supply III Nutrient Sensitive waters. The riparian buffers are protected under the Neuse River Buffer Rules (15A NCAC 2B .0233). It was determined during the field investigation that approximately 100 feet of protected buffer (measured parallel to and along one side of the stream) had been cleared of vegetation on the subject property. The removal of vegetation within Zone 1 of the 50-foot protected riparian buffers is prohibited under the Neuse River Buffer Rules (15A NCAC 2B .0233). Therefore, the DWQ has determined that the clearing of vegetation that occurred on the subject property is in violation of the Neuse River Buffer Rules (15A NCAC 2B .0233). The Neuse River Buffer Rules (15A NCAC 2B .0233) protect fifty (50) foot riparian areas (buffers) along surface waters (including, but not limited to, intermittent streams) within the Neuse River basin. The Neuse River Buffer Rules (15A NCAC 2B .0233) have been in place as temporary rules since July 22, 1997. The 50-foot buffer is divided into two Zones. The first zone, Zone 1, consists of the first 30 feet from the bank of the stream. This zone is intended to be an undisturbed vegetated area. Only limited clearing of vegetation within Zone 1 is allowed as identified within the Neuse River Buffer Rules (15A NCAC 2B .0233(6)). The second zone, Zone 2, consists of the outer 20 feet of the 50-foot buffer. This zone is intended to be a managed vegetated area. Clearing and grading is allowed within Zone 2 as long as the area is left vegetated. No new impervious surface is allowed within the 50-foot buffer. A copy of the Neuse River Buffer Rules can be obtained by visiting the DWQ 401 Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands/ or by calling the DENR / DWQ Raleigh Regional Office at 919-571-4700. Your response must address the following items: 1) Please discuss your efforts to abate impacts to the protected riparian buffers. 2) Please discuss your riparian buffer restoration proposal. The vegetation plan for Zone 1 shall include a minimum of at least two native hardwood tree species planted at a density of 320 trees per acre at maturity and appropriate ground cover to preventsoil erosion. The vegetation plan for Zone 2 shall include a minimum of at least appropriate ground cover to prevent soil erosion. c) A fertilization plan. (Only a one-time application of fertilizer will be allowed to establish replanted vegetation.) d) A schedule for implementation. .3) Finally,,please explain, why the violation occurred and if any other impacts to the protected buffers (including any - -... potential deck or patio) are planned. The Raleigh Regional Office of the Division of Water Quality is considering sending a recommendation for enforcement action to the Director of the Division of Water-'Quality Please be aware that you may be subject to enforcement action with the possible assessment of civil penalties of up to $25,000.00 per day, per violation.
