Based on your correspondence for August 21, 2000 and October 18, 2000 it is
clear that this project began and received an NWP 26 from the US Army Corps of
Engineers before January 1, 2000. Therefore we believe that this project is grandfathered
or vested from the Tar-Pamlico River buffer rules. Therefore the Tar-Pamlico River
buffer rules (15A NCAC 2B .0259) do not apply to this project.
