After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3106. This certification allows you to use Nationwide Permit Number 18 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. (ATTACH PLANS; 8 1/2 BY 11 DRAWINGS ONLY) A bulldozer will be used to push material for filling the site. A backhoe will be used to move the fill around the site. A 70-ton crane will deliver the 12'x24' precast concrete building onto the subject site. A low-boy will be used to transport equipment onto and off of the site. About 4-feet of unsuitable material will be removed beneath the buildin_c footprint and replaced with a bridge lift consisting of a granular material (sand or washed No. 57 or 67 stone). The bridge lift is needed to obtain a firm subbase. We anticipate that a 5 foot bridge lift will be constructed. Upon completion of the bridge lift, a 2-foot laver of compacted fill will be placed. The fill should be placed in 8 to 10 inches loose and compacted 6 inches. Fill should be compacted to 95 percent of a standard Proctor maximum dry density (ASTM D 698). The concrete mat footing will rest on the 2-foot compacted fill laver. Masonry walls will be constructed to about 8 feet in height and rest on the mat footing. Fill (sand) will be placed between the four masonry walls to provide support of a concrete slab that the building will rest on. Fill should be compacted as stated above. 13. PURPOSE OF PROPOSED WORK: Cellular tower co-location on the Duck water tower. The building is required for operation of the new antenna. 14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN WETLANDS (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) Custom Building Company is avoiding major impacts by co-locating on the water tower, thus not requiring the construction of a new tower. Once the water tower was identified for co-location, analysis began on the location of the required 12x24 ft. utility building. The original location for the building was to the south of the tower, near the small canal between the county's land and the adiacent commercial development. However, in order for the building to be constructed at that location wetland fill would have been required for the entire building. In addition, this location was in close proximity to the aforementioned canal, which is fed by Currituck Sound. The building's location was moved to the northwest corner of the property to minimize the wetland impacts as well as to keep it away from Currituck Sound. The present location is on the edge of iurisdictional wetlands and as far from Currituck Sound as is feasible. 15. (ATTACH PLANS; 8 1/2 BY 11 DRAWINGS ONLY) A bulldozer will be used to push material for filling the site. A backhoe will be used to move the fill around the site. A 70-ton crane will deliver the 12'x24' precast concrete building onto the subiect site. A low-boy will be used to transport equipment onto and off of the site. About 4-feet of unsuitable material will be removed beneath the building footprint and replaced with a bridge lift consisting of a granular material (sand or washed No. 57 or 67 stone). The bridge lift is needed to obtain a firm subbase. We anticipate that a 5 foot bridge lift will be constructed. Upon completion of the bridge lift, a 2-foot laver of compacted fill will be placed. The fill should be placed in 8 to 10 inches loose and compacted 6 inches. Fill should be compacted to 95 percent of a standard Proctor maximum dry density (ASTM D 698). The concrete mat footing will rest on the 2-foot compacted fill laver. Masonry walls will be constructed to about 8 feet in height and rest on the mat footing. Fill (sand) will be placed between the four masonry walls to provide support of a concrete slab that the building will rest on. Fill should be compacted as stated above. 13. PURPOSE OF PROPOSED WORK: Cellular tower co-location on the Duck water tower. The building is required for operation of the new antenna. 14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED OUT IN WETLANDS (INCLUDE ANY MEASURES TAKEN TO MINIMIZE WETLAND IMPACTS) Custom Building Company is avoiding major impacts by co-locating on the water tower, thus not requiring the construction of a new tower. Once the water tower was identified for co-location, analysis began on the location of the required 12x24 ft. utility building. The original location for the building was to the south of the tower, near the small canal between the county's land and the adjacent commercial development. However, in order for the building to be constructed at that location wetland fill would have been required for the entire buildingg. In addition, this location was in close proximity to the aforementioned canal, which is fed by Currituck Sound. The building's location was moved to the northwest corner of the property to minimize the wetland impacts as well as to keep it away from Currituck Sound. The present location is on the edge of iurisdictional wetlands and as far from Currituck Sound as is feasible. 15.
