NC 27596 Dear Mr. Stallinss: You have our approval to impact 120 feet of an unnamed tributary to Brandy Creek and the associated riparian buffers in Franklin County for the purpose of residential subdivision construction, as you described in your application received by the Division of Water Quality on October 20, 2000. After reviewing your application, we have decided that this project is covered by the Tar-Pamlico River Buffer Rules (15A NCAC 2B .0259). In addition, you should get any other federal. state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this approval letter and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. 1. Stormwater shall be directed to sheetflow at non-erosive velocities through the protected stream buffer. If you do not accept any of the conditions of this approval, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447. Raleigh. N.C. 27611- 7447. This approval and its conditions are final and binding unless you ask for a hearing. We also request written concurrence from the NC Division of Water Quality (NC-DWQ) that the project complies with the Tar River Basin buffer rules. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. S&EC delineated the wetlands and jurisdictional waters present within the road corridor on the subject site in October 2000. No wetlands were observed within the road corridor. One data form completed for the wetland delineation is also attached. This phase of the proposed project consists of a residential subdivision of 28 lots, located approximately 5000 feet northwest of the intersection of SRI 115 and SRI 125. Please refer to the attached map (Figure 1) for the project's location on a USGS topographic quadrangle. The current phase comprises approximately 15 acres (The entire property is 141 acres. This road will impact 120 linear feet (100' pipe + 20' rip-rap = 120') of an approximately 5-foot-wide (600 sq. ft./0.01 ac.) stream channel, which is also subject to the Tar River Basin (TRB) riparian buffer rule. Approximately 12,000 square feet of riparian buffer (Zone 1, 7200 sq. ft./Zone 2, 4800 sq. ft.) will be impacted by the proposed road. It is important to note that no wetlands will be impacted at this road crossing. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). This road crossing was designed to cross the stream channel at a perpendicular angle and the right-of-way width was reduced as much as possible to minimize the impacts associated with the crossing. In fact, as stated above, no wetlands will be impacted at this crossing. NC-DWQ's current policy does not require mitigation for wetland and stream channel impacts below 1 acre and 150 linear feet. Because the proposed impacts resulting from this project do not exceed the aforementioned thresholds (0.01 acre/120 linear feet), S&EC believes that wetland or stream channel mitigation should not be required. The tributary of Brandy Creek that will be impacted by the proposed road is subject to the Tar River Basin riparian buffer rules. This road was designed to cross the stream channel and corresponding riparian buffer at a perpendicular angle to minimize impacts. As noted above, the road crossing impacts less than 150 linear feet of stream channel and less than 1/3 acre of riparian buffer. Current NC-DWQ policy allows road crossing without mitigation if the impacts are less than or equal to 150 linear feet of stream channel or 1/3 of an acre of riparian buffer. Because the project impacts are within these thresholds, S&EC believes that riparian buffer mitigation should not be required. Sincerely, ?? C' .0 Kevin C. We also request written concurrence from the NC Division of Water Quality (NC-DWQ) that the project complies with the Tar River Basin buffer rules. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. S&EC delineated the wetlands and jurisdictional waters present within the road corridor on the subject site in October 2000. No wetlands were observed within the road corridor. One data form completed for the wetland delineation is also attached. This phase of the proposed project consists of a residential subdivision of 28 lots, located approximately 5000 feet northwest of the intersection of SRI 115 and SRI 125. Please refer to the attached map (Figure 1) for the project's location on a USGS topographic quadrangle. The current phase comprises approximately 15 acres (The entire property is 141 acres. See attached map). This road will impact 120 linear feet (100' pipe + 20' rip-rap = 120') of an approximately 5-foot-wide (600 sq. ft./0.01 ac.) stream channel, which is also subject to the Tar River Basin (TRB) riparian buffer rule. Approximately 12,000 square feet of riparian buffer (Zone 1, 7200 sq. ft./Zone 2, 4800 sq. ft.) will be impacted by the proposed road. It is important to note that no wetlands will be impacted at this road crossing. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre). This road crossing was designed to cross the stream channel at a perpendicular angle and the right-of-way width was reduced as much as possible to minimize the impacts associated with the crossing. In fact, as stated above, no wetlands will be impacted at this crossing. NC-DWQ's current policy does not require mitigation for wetland and stream channel impacts below 1 acre and 150 linear feet. Because the proposed impacts resulting from this project do not exceed the aforementioned thresholds (0.01 acre/120 linear feet), S&EC believes that wetland or stream channel mitigation should not be required. The tributary of Brandy Creek that will be impacted by the proposed road is subject to the Tar River Basin riparian buffer rules. This road was designed to cross the stream channel and corresponding riparian buffer at a perpendicular angle to minimize impacts. As noted above, the road crossing impacts less than 150 linear feet of stream channel and less than 1/3 acre of riparian buffer. Current NC-DWQ policy allows road crossing without mitigation if the impacts are less than or equal to 150 linear feet of stream channel or 1/3 of an acre of riparian buffer.
