After reviewing your application, we have determined that this action is covered by General Water Quality Certification Number 3288. This Certification allows you to use Nationwide Permit Number 12 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your-project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. CF: NEUSE RIVER BUFFER NARRATIVE TOWN OF ZEBULON - WATER SYSTEM IMPROVEMENTS PN - 00 - 306 October 10, 2000 The purpose of this narrative is to define the scope of the project and to define any stream and buffer crossings that will occur during this project. The proposed water main extensions are intended connect existing dead-end lines in the Town of Zebulon's water system to provide increased pressures and fire flows in an area of Town where these lines are deficient. Work performed for the installation of the water main extensions will include approximately 2,020 LF of 6" diameter ductile iron water mains that connect the existing 6" diameter water main in the Town's Community Park to the existing 6" diameter water main along Barbee Street. Due to the location of the existing lines, the water main extensions had to be placed across an unnamed tributary to Moccasin Creek on the Town's property to facilitate the looping of these lines. However, the installation of the proposed water mains will not involve any disturbance of the existing streambed as all crossings of the tributaries to Moccasin Creek will be accomplished by installing the proposed water main under the existing storm culverts. These culverts occur in a cleared and maintained easement for an existing 8" diameter sanitary sewer line. Buffer Crossing # 1 & 2 The buffer crossings each consist of a near 90° crossing of an unnamed tributary to Moccasin Creek with a 6" diameter ductile iron water main buried beneath the existing culverts that are located in the existing streambed. These improvements will not involve any disturbance of the streambed due to this fact. These buffer encroachments are located on the southern part of the Town of Zebulon in the northeast portion of the Town's Community Park property before connecting to the existing water main located along the eastern end of Barbee Street. The project involves the installation of water mains in portions of the Town of Zebulon. The water main extension that crosses an unnamed tributary of Moccasin Creek will parallel an existing 8-inch sanitary sewer line located along a cleared and maintained easement. The water mains will be installed under three (3) existing culverts that cross these tributaries within this maintained easement and will not involve any disturbance of the existing streambed. These additional extensions are part of a change order to a Clean Water Bond Fund project that has been awarded to the Town. Attached are 81/2" x 11" sheets of the buffer encroachments along with a brief narrative of the encroachment and a check for $200.00 for the application fee.
