Division of Water Resources INSTRUCTIONS FOR FORM- FTA 04-16 & SUPPORTING DOCUMENTATION
This application is for sewer extensions in%olving gravity sewers. pump stations and force mains, or any combination that has been
certified by a professional engineer and the applicant that the project meets the requirements of 15A NCAC 02T and the Division's
Minimum Design Criteria and that plans, specifications and supporting documents have been prepared in accordance with, 15A
NCAC 02T, 15A NCAC 02T.0300, Division policies and good ensincerine practices.
While no upfront engineering design documents are required for submittal, in accordance �%ith 15A NCAC 02T .0305(b), design
documents must be prepared prior to submittal of a fast track permit application to the Division. This would include plans, design
calculations, and project specifications referenced in 15A NCAC 02T , )] W3 and the applicable minimum design criteria. These
documents shall be available upon request by the Division.
Projects that are deemed permitted (do not require a permit from the Division) are explained in 15A NCAC 021".0303
Projects not eligible for review via the fast track process (must be submitted for full technical review):
Projects that require an environmental assessment in accordance with 15A NCAC I .0100:
Projects that do not meet any part of the minimum design criteria (NIDC) document;
Projects that involve a variance from the requirements of 15A NCAC 2T:
Pressure sewer systems utilizing septic tank -effluent pumps (STEPS) or simplex grinder pumps;
STEP or simplex grinder pumps connecting to pressurized systems (e.g. force mains);
Vacuum sewer systems.
General— When submitting an application, please use the following instructions as a checklist in order to ensure all required items
are submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and
reduce the amount of requested additional information. Failure to submit all required items will necessitate additional
processing and review time, and may result in return of the application. Unless otherwise noted, the Applicant shall submit
one original and one copy of the application and supporting documentation.

® List all items included in the application package, as well as a brief description of the requested permitting action.
Be specific as to the system type, number of homes served, flow allocation required, etc.
If necessary for clarity, include attachments to the application forth.
C. Application Fee (All New and Major Modification Application Packages):
® Submit a check or money order in the amount of S480.00 dated within 90 days of application submittal.
Payable to North Carolina Department of Environmental Quality (NCDEQ)
D. Fast Track (Form: FTA 04-16) Application (Required for All Application Packages):
® Submit the completed and appropriately executed application.
If necessary for clarity or due to space restrictions, attachments to the application may be made.
® If the Applicant Type in Item 1.2 is a corporation or company, provide documentation it is registered for business with
the North Carolina Secretary of State.

Deeds in the county of business.

the Company, and management decisions shall require the approval, consent, agreement or
ratification of a majority of the Managers.
(b) The Company shall initially have two (2) Managers. TheAhitii IManagers of the,
Company shall be: Scott Levitan and Linda K. Hall. The number of Managers of the Company
shall be fixed from time to time by the Member. The Member, at any time and from time to time
and for any reason, shall have the power to remove a Manager then acting and the power to
elect a Person to serve as a Manager to fill a position created by reason of an increase in the
number of Managers or to replace any Manager no Ionger able to serve in such capacity due to
such Manager's death, dissolution, resignation or removal in accordance with the provisions of
this Agreement.
(c) Nothing contained in this Agreement (including without limitation this Section
6.1) is intended to deprive a Member who is not a Manager from participating in any vote or
consent to which such Member is required to participate under the terms of the North Carolina
Limited Liability Company Act (or any successor provision), where depriving such Member of
such vote or consent is not permitted under such statute. Accordingly, to the extent that a Member
is required to vote or consent to such matters under the North Carolina Limited Liability
Company Act, such Member shall be permitted to vote or consent. In such event, the requisite
vote shall be determined by reference to the Percentage Interest of the Members or on such other
basis required by such statute.
(d) Any Manager designated herein shall continue to serve as a Manager in
accordance with the provisions of Section 57D-3-20(e), North Carolina General Statutes.
(c) In addition to the powers given to the Managers by law, the Managers, subject to
the terms, provisions and restrictions of this Agreement, are hereby authorized:
(i) to expend the Company's capital and income in furtherance of or relating
to the Company's activities and purposes;
(ii) to employ or retain from time to time, on such terms and for such
compensation as the Managers may determine, such Persons; fuzes or corporations as the
Managers may deem advisable, including without limitation attorneys, accountants,
bookkeepers, financial and technical consultants, supervisory managing agents, insurance
brokers, real estate brokers, loan brokers, profcssionaI land planners and architects, who
may also provide such services to the Managers and Persons, firms or corporations in
which the Managers or the Member may have an interest;

I --tx► certify to the best of my knowledge that the addition of
the volume ofwastewater to Wpermitted in this project has been evaluated along the route to the receiving
wastewater treatment facility and that the flow from this project is not anticipated to cause any capacity
related sanitary sewer overflows or overburden any downstream pump station en route to the receiving
treatment plant under normal circumstances, given the implementation of the planned improvements
identified in the planning assessment where applicable. This analysis has been performed in accordance
with local established policies and procedures using the best available data. This certification applies to
those items listed above in Sections I and I1 plus all attached planning assessment addendums for which i
am the responsible party. Signature of this form certifies that the receiving collection system or treatment
works has adequate capacity to transport and treat the proposed new wastewater.

As to Boxyard RTP, LLC, perhaps the deficiency owes the the recent creation of the LLC. We created the LLC to conform

In response to the Boxyard sewer comments below, we are getting the information for item #1 from the County.
For item #2, Scott Levitan is the Manager of Boxyard RTP, LLC as signed on the application. What confirmation do you
need to keep this moving? Or do we need to re= -execute the application with Linda Hall who is listed on the NC
Secretary of State website? We trying to keep this moving and I understand that Ted is out until Monday, if you can
clarify this then we'll get the info to you both ASAP.
