8. PROJECT SUMMARY: The applicant proposes to install one freestanding mooring within Upper
Broad Creek. The mooring will consist of three 300 lb. anchors each connected to a central junction
point by 75 ft. of chain. The junction point will be connected to a 21 in. buoy via 20 ft. of chain.
9. NARRATIVE DESCRIPTION:
Project Setting
The applicant, Mr. James Oster, owns 20 acres adjacent to Upper Broad Creek within the Creek Point
Subdivision (lots 1 & 2) near the terminus of Creek Point Road off NCSR 1103 outside the Reelsboro
community of Pamlico County. The site consists of a single-family residence, managed lawn, access road,
and managed timber acreage. The tract has approximately 400 ft. of frontage on Upper Broad Creek. In
September 2000, General Permit #26936-C was issued to Mr. Oster for the construction of a 3 ft. X 63 ft.
pier with a 12 ft. X 15 ft. platform and associated tie poles delineating two slips. The site is bordered on
either side by large residential lots similar in size and characteristics to Mr. Oster's lot. Fairfield Harbor, a
golf course community, and Blackbeards Marina are located across the creek. The site is approximately 17
ft. in elevation. Water depths immediately offshore fall from -1.0 ft. to -8 ft. gradually over a linear
distance of 1000 ft. from shore. Water depths in the center of the creek range from -8 ft. to -9 ft. Upper
Broad Creek is not a primary nursery area as defined by the NC Division of Marine Fisheries. This creek is
classified as SB SW NSW by the NC Division of Water Quality and is not open to shell fishing. The creek is
approximately 3100 ft. wide at this location. No federally maintained channel exists in Upper Broad Creek.
Project Description
The applicant has authorized Mr. David L. Andrews to install a single freestanding mooring within the
applicant's riparian corridor. The mooring will be used primarily by Mr. Andrews who keeps his boat at
Blackbeards Marina during the majority of the calendar year. Mr. Andrews seeks this mooring primarily for safe
harborage during hurricanes, tropical storms, etc. and when wind tides prevent marina access. His boat requires
a draft of > 6 ft. The mooring will consist of three 300 lb. anchors each connected to a central junction point by
75 ft. of chain. The junction point will be connected to a 21 in. buoy via 20 ft. of chain. The swing of a boat
tied to the mooring will have a maximum diameter of 200 ft. This swing diameter is entirely within the proposed
1032.9 ft., distance from NWL. The proposed location meets the 15 ft. setback from the adjacent riparian
property lines. There is no high ground development associated with this project.

Anticipated Impacts
Approximately 0.72 ac. of Estuarine Waters would be usurped by the placement of the proposed mooring
structure. Minor, short-term increases in turbidity would be expected during the installation of the proposed
mooring. The structure's placement is within the 1/3 distance across Upper Broad Creek. The placement of this
single mooring with permanent, marked buoy should have limited to no interference with the boating public. The
proposed location is over 400 ft. from the middle of Upper Broad Creek where there is a depth of -9 ft. NWL.
However, there is the potential for navigational concerns to increase in this area should additional individuals seek
similar authorizations.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross-sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7I.020) for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue4ine
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.

6. CERTIFICATION
TO ENTER ON LAND
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

Mooring Description:
Each mooring will consist of three 300 pound naval anchors, each connected by
a 5/8" shackle to 75 feet of Y2" chain connected by a 5/8" shackle to a 3/<" center
junction. A 20 foot 1/2" chain will be connected to the center junction by a 5/8"
shackle leading to a mooring buoy on the surface. The mooring buoy will be 21
in diameter and colored white with a blue stripe. -
