The NCDMF proposes to fill approximately 10.89 acres of the 20 area with 35,000 tons of class B limestone rip -rap to enhance oyster habitat with the creation of an artificial reef. NC Division of Marine Fisheries Swan Island Oyster Sanctuary Expansion Major Modification 4140-09 Carteret County Project Setting This is a Major Modification to CAMA Major Permit No. 140-09. The North Carolina Division of Marine Fisheries (NCDMF) Oyster Sanctuary Program has 14 existing Sanctuaries in the Pamlico Sound complex authorized under Major CAMA Permit No. 140-09 originally issued on November 3`d 2009 and modified by Major Modification on November 23rd 2011, November 301h 2011, February 7th 2015, and October 251h 2016. The permit has also been modified through letters of refinement issued on August 11`h 2011. April loth 2012, December 14`h 2012, June 13'h 2013, and February 24`h 2014. The Major Modification to Permit No 140-09 issued on October 25" 2016 included a 40- acre area for placement of material and a 100ft buffer surrounding the sanctuary encompassing approximately 60 acres total. The existing sanctuary is located 1.4 nautical miles NE of Point of Marsh at the mouth of the Neuse River and contains 55,000 tons of class B limestone and 25,000 tons of class A granite. The 20-acre expansion area of the currently proposed Major Modification would move to the northern boundary of the existing sanctuary northward 263ft which includes the 100ft buffer. The water depths in the area are approximately -13' @ NH W, the bottom composition is sandy mud, and does not contain existing shellfish resources or submerged aquatic vegetation. All existing sanctuaries permitted under Major CAMA Permit No. 140-09 are located in waters classified SA-HQW by the Environmental Management Commission. Deep Bay (#4) and Middle Bay (47) are both designated as Secondary Nursery Areas by the NCDMF. The areas surrounding the sanctuaries are open to shellfishing. The waters of the proposed site are classified SA-HQW and are currently open to shellfishing. Project Description The NCDMF proposes to expand the existing reef boundary for the Swan Island Oyster Sanctuary northward 263ft for the entirety of its 3690ft in width; this will encompass an additional 20 acres of bottom in the Pamlico Sound in Carteret County. The NCDMF proposes to use previously approved material and methodology to offload 35,000 tons of class B limestone rip -rap into ridges 2-4ft tall on the Sound bottom using heavy equipment and barges. All material will be placed inside the reef boundaries with a 100ft buffer. Materials will be staged at the at the NCDMF's South River facility prior to deployment. The proposed construction time frame in Spring/Summer 2020. Anticipated Impacts The project as proposed would expand the existing boundaries of the Swan Island Oyster Sanctuary encompassing an additional 871,200ftz (20acres) of Pamlico Sound bottom of which 474,640ft2 (10.89acres) are proposed to be filled with class B limestone rip -rap. The project would result conversion of soft bottom habitat to hard bottom habitat and localized temporary turbidity during construction. The project, if successful should result in additional shellfish habitat and hard bottom habitat finfish in the Pamlico Sound. ROY COOPER Governor MICHAEL S. REGAN Secretnrr STEPHEN W.MURPHEY Director NCDMF Artificial Reefs The North Carolina Division of Marine Fisheries (NCDMF) Artificial Reef Program has been formally operating since the 1970s and manages 68 artificial reefs and oyster sanctuaries. Twenty-five (25) of these sites are in estuarine waters, and the remaining 43 are in ocean waters. In 2016, the NCDMF released an artificial reef guide that outlines each of the artificial reefs and oyster sanctuaries. This document provides material information, coordinates, and a figure of the material on the reef site. The NCDMF Artificial Reef Program has also developed an interactive reef guide, set up in an ArcGIS format is available here: https://ncdenr.maps.arceis.com/apps/webgppviewer/index.html?id=3b27e8594cb6444c88b5525b f763aa55. The interactive guide is complete with material shapefiles, latitude/longitude information, side -scan sonar imagery, and much more. This is available for review by the public, state, and federal agencies. Boundaries for each reef site were defined in a boundary packet that detailed the coordinates of each reef, material locations, reef boundaries, and acreages of reefs and materials. This packet was accepted by the Division of Coastal Management on July 10, 2017, and USACE on October 25, 2017. Letters acknowledging the acceptance of this reef packet are shown in Attachments I and 2, the relevant reef page is shown in Figure 1. Project Background Swan Island Oyster Sanctuary is an existing reef site located about 1.4 nautical miles NE of Point of Marsh at the mouth of the Neuse River. Construction at this reef site was initially permitted on October 25, 2016. The site is 60 acres in size and currently contains 55,000 tons of class B limestone rip rap and 25,000 tons of class A granite rip rap. The reef is marked on each corner with a 13" diameter spar buoy emblazoned with an orange diamond and the word "REEF". MLW depth is 10 feet and this site has a vertical clearance requirement of 6 feet. Proposed Enhancements NCDMF proposes expanding the reef boundary northward to encompass an additional 20 acres (Figure 2). This area is composed of sandy mud bottom and does not contain any shellfish, submerged aquatic vegetation, or other natural resources. Construction methodology will mirror the existing practices at the reef site, with heavy equipment offloading rock from a barge to create parallel ridges 2-4 feet tall (Figure 3). This construction is expected to occur in Spring/Summer 2020 and will include up to 35,000 tons of class B (6-10 inch diameter) limestone rip rap which will be staged at NCDMF's South River facility. Deployments will follow protected species avoidance measures as outlined in the biological opinion issued by NMFS on 10/18/19 as well as USFWS Guidelines for Avoiding Impacts to the West Indian Manatee. Oyster sanctuaries are a restoration strategy employed by NCDMF to place hard substrate on the bottom where oyster spat will attach, grow, reproduce, and enhance natural oyster populations. This boundary expansion will allow 20 more acres of _ hard substrate which,will grow oysters, provide habitat for numerous finfish species, provide recreational fishing - opportunities, and support natural oyster populations in Pamlico Sound: c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. Large aggregate rock (limestone, granite, or recycled concrete rip rap) is typically used for oyster restoration activities. This will be delivered and stored at a State-owned facilely, loaded onto a barge, and o0loaded in large ridges using heavy equipment (excavators/front end loaders). Each load is approximately 1200.1500 tons and deployment is observed by NCDMF staff to ensure it remains inside permitted boundaries and meets navigational clearance requirements. d.
