9. PROJECT DESCRIPTION
The proposed project is located on the northern end of Canal #14 at 94 Wilmington Street in Ocean Isle Beach,
Brunswick County.
The property can be reached by traveling south on NC HWY 17 towards South Carolina. Continue 11 miles
past the Supply 4-way intersection and make a left turn onto Ocean Isle Beach Road SW. Drive south on Ocean
Isle Beach Road SW for 3.5 miles and continue straight through the round -about towards Causeway Drive.
Continue over the bridge and take a left onto East 2" d Street. Drive down East 2"d Street for I mile and take a
left onto Wilmington Street. Drive to the end of Wilmington Street until the road dead ends at the applicant's
property.
Previous permits include a bulkhead replacement and new floating dock on 3/4/2011 (GP 56624), a new section
of bulkhead and riprap realignment on 3/19/2015 (GP 65128), and a floating dock expansion on 1/2/2020 (GP
74844). There are currently two docking facilities at this residence. The docking facility on the western side of
the property consists of a 10' x 10' fixed platform, a 6' x 27' access pier, and an 8' x 20' floating dock. The
close proximity of the floating dock to the property's riprap revetment prevents vessel usage on the backside of
the 8' x 20' floating dock. The docking facility on the eastern side of the property consists of a 14'x 24' fixed
platform and an 8' x 16' floating dock. The project site is approximately .6 acres and is vegetated primarily with
domestic grasses and ornamental landscaping. The high ground portion is elevated approximately 4' above the
normal high water (NHW) level, and the shoreline (+/- 642 linear feet) is stabilized by a bulkhead and
reinforced with a riprap revetment. There is no indication of any Coastal Wetlands on -site. The applicant's
property sits at the end of a "natural" canal system between Canal #15 to the west and Canal #14 to the east.
Residential properties and Wilmington Street border the project site to the south and the AIW W borders the
property to the north. The width of Canal # 14 measures approximately 123' from bulkhead to bulkhead at the
proposed project site.
The waters of the canal system are classified SA by the Division of Water Quality and ARE NOT designated as
a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish. Based on visual observations made by DCM staff during the January 2020 site visit, there appears to
be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths in the vicinity of the
proposed docking facility range from -2.5' to -3', relative to NLW.
PROPOSED PROJECT
The applicant proposes to replace an existing 8' x 16' floating dock with an 8' x 30' floating dock to
accommodate a larger vessel for a total of 2 boatslips.
The proposed floating dock would be located in the same location as the existing floating dock and would
extend an additional 14' north towards the AIWW (Sheet 3 of 5). Pilings would be driven on the south end of
the floating dock.

10. ANTICIPATED IMPACTS
The proposed floating dock would incorporate approximately 240 sq. ft. of Estuarine Waters and Public Trust
Area. The docking facility would remain consistent with similar pier length requirements (established pier -head
line). The proposed docking facility would not encroach into the 15-foot riparian corridor setback of either
riparian neighbor. Minor increases in turbidity should be expected during piling installation.

As acting agent for Rufus Yates, 94 Wilmington Street, Ocean Isle Beach, NC, I
am submitting the enclosed CAMA Major Permit Application for proposed
changes to his existing docking facility located on the east side of the lot, adjacent
to a man-made canal. Mr. Yates would like to replace the existing 8' x 16' floating
dock with an 8' x 30' floating dock for his larger boat. The proposed new floating
dock would be located essentially in the same location as the existing floating
dock, just extending an addition 14' towards the AIWW and would not exceed the
original pier -head alignment. Mr. Yates obtained CAMA General Permit #74844-
D on 1/2/20 to replace this same existing 8' x 16' floating with an 8' x 25'hfloating
dock but has decided not to constunct the 8' x 25'/2' float and instead apply for this
CAMA Major Permit for the 8' x 30' floating dock which would be better suited

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following applications were submitted for a development permits in Areas of Environmental
Concern as designated under the CAMA: On January 29, 2020, John Murphy proposed to construct a newfour
(4) slip private docking facility at 224 Waynick Blvd., adjacent to Banks Channel, in Wrightsville Beach, New
Hanover County; on February 4, 2020, Rufus Yates proposed to replace an existing 8'x16' floating dock w/
an 8'x30' floating dock at 94 Wilmington St., adjacent to a man-made canal, in Ocean Isle Beach, Brunswick
County; and on January 14, 2020, Jonathan Holland proposed to expand an existing private docking facility
from two (2) to three (3) slips at 480 Roberts Rd., adjacent to the AIWWITopsail Sound, in Hampstead, Pender

The Division of Coastal Management hereby acknowledges receipt of your application, acting as
the agent for State approval for the expansion of a one (1) slip docking facility to accommodate a
larger vessel at 94 Wilmington St., Ocean Isle Beach, Brunswick County, NC. It was received

Rufus Glenn Yates and wife, Edna'['. Yates and Leonard R. Odham and wife, Anna Y. Odham dated August 26,
1999 and recorded in Book 1352 at page 610, Brunswick County Registry. Reference is hereby made to said deed
for more clarity, fullness and particularity of description of the land being conveyed herein.
The Grantor is conveying rile interest which Edna Earl Tyler Yates possessed at the time of her death and
also the interest which Rufus Glenn Yates owns individually. Edna Earl Tyler Yates' estate is probated in the Office
