APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to place fill material in 0.22acres of wetlands
for the purpose of constructing a sewer line for West Point subdivision at US 264 and Forest Hills Road in Wilson as described in %our
application dated October 5, 2000. After reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 12. This certification allows you to use Nationwide Permit Number 3288 when the Corps of Engineers issues it. In
addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment
and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval is also valid for the Neuse
River Buffer rules (15A NCAC 2B .0233) This approval will expire when the accompanying 404 or CAMA permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If you change
your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a
copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project
(now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this
approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below.
1. The sewer line between Manholes 3 and 4 shall be relocated so that the edge of the construction corridor is at least 30 feet from the edge
of the stream.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of
the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 1508 of the North Carolina
General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are
final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions,

Deed nonfications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order
to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this
letter or the issuance of the 404 Permit (whichever is later).
An additional condition is that a final, written stormwater management plan shall be approved by [iris Of"ce before the impacts specified
in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facthues
designed to remove 35% TSS according to the most recent version of the NC DErVR Stormwater Bes: Managemeni Prac:ices .Vanca .1
Also. before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and
operational. and the stormwater management plan. as approved by this Office. shall be implemented.

Dear Mr. Dorney:
Enclosed for your review and approval is the Pre-Construction Notification Application
for approval to construct sanitary sewer improvements that will impact 0.22 acres of wetlands
that exist on the above project's site. This package was submitted originally on September 20,
2000 but did not include the check for the $200.00 fee that is associated with this application. I
apologize for this omission and have included the check with this package for resubmittal.
Please contact my office if there are any questions regarding this package.
Also on behalf of James Properties, Green Engineering has submitted the Sedimentation
and Erosion Control plan for this project to the Land Quality Section of NCDENR. Upon the
preliminary review performed by Joe Dupree of John Holley's office, Land Quality has stated
that this project impacts the Neuse River Buffer. The water feature shown on the enclosed plans
is not the stream that shows up as a feature on the enclosed Sheet 5 of the "Soil Survey of Wilson
County North Carolina". The stream shown on the soil survey is located behind the existing
Lowe's Home Improvement Center. The stream located on the enclosed construction plans lies
in front of the existing Lowe's Home Center. We feel that this stream should not be subject to
the Neuse River Buffer Regulations and would like to cite the fact that previous development

along this same stream has not had NRB regulations enforced upon it. By copy of this letter,
Green Engineering is requesting that the stream shown on the enclosed construction plans not be
held subject to the Neuse River Basin Buffer Regulations.
