APPROVAL of 401 Water Quality Certification and Additional Condition
Dear Mr. Cushing:
You have our approval, in accordance with the attached conditions, to place fill in 0.30 acre of wetlands and to
construct a utility line crossing of Campbell Creek at the Kimmerly Glen Site in Mecklenburg County, as described in your
application received by the Division of Water Quality on October 3, 2000. Based upon our discussion with Mr. Phillip Hobbs
of Site Solutions, Inc., there are no stream impacts associated with this project. After reviewing your application, we have
determined that this fill is covered by General Water Quality Certification Numbers 3287 and 3288. This Certification allows
you to use Nationwide Permit Numbers 39 and 12 when issued by the U.S. Army Corps of Engineers. In addition, you should
get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the
accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold,
the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all
conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the
attached certification and the additional condition listed below.
1. Deed restrictions or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet
of all streams and ponds in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in
place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification can
be found on our web site at http://h2o.enr.state.nc.us/ncwetlands .
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B
of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

12. Wetland to be impacted by this permit will be excavated and filled with track-
mounted equipment for the purpose of creating (2) permanent dry ponds for
storm water detention.
14. A significant effort was made to avoid and minimize impacts to wetlands and
waters. Impacts to streams were avoided totally. Although only 0.3 acres of
wetlands are impacted, a much greater area of the, site would need to be
preserved to avoid all impacts, based on the location and configuration of the
wetlands. The project design currently incorporates a considerable amount of
retaining walls, two separate stormwater detention basins, and a substantial
increase in development costs to preserve the waters and wetlands. The
proposed project will result in preservation of 100% of the natural stream and a
good consistent wetland buffer.

On July 13, 2000, S&M& lnc. (S&M met with Mr. Steve Chapin of the U.S. Amy Corps of
Engineers (ACOE) at the above-referenced site for verification of S&ME's Juiis&ctional Wetland
Delineation (reference report dated July 5, 2000) and to evalum the on-Site stream in temp of
aquatic siSrilicance. In addition, Mr. Pete Caldwell of the North Carolina Depatwmt of
Environment and Natural Resources (NCDENR) visited the site on July 13, 2000 to evaluate the on-
sate sttr= in temps of potential permitting and compenwitory mitigation r Twemews,
Based upon the ACOE's field review, the wetland area su mmnding the on-site strum has been
broadened and now totals an agtimattd 1.0-acre in size. On July 13, 2000, S&,ME identified and
delineated the updated upland/wetland boundary (reference the enclosed Figure 2: Estimated Waters
of the U_S.). The newly delineated arcs should be surveyed, platted and combined to the previous
swvvy of Waters of the U.S. The final survey of Waters of the U.S_ should be forwarded to the
ALOE for review and jurisdictional determination- S&ME requests an olrporwWty to review the
final survey prior to its issuance.
With regards to the =eam evaluation, based upon obm rvations made during the July 13 site visit,
the ACOE considers the entire length of the stream channel to be aquactically significant. Therefore,
the ALOE would require compensatory mitigation for any impacts to the sumnbed. The
NCDENR also co=d= the entire length of the stream significant based upon observations made
during the site visit and would require compensatory mitigation for stream impacts. However, since
heavy rainfall has bcfilleu the Charlotte area in the past several days, I& Caldwell indicated that
the NCDENR would be willing to re-visit the site during fitwe 401 Watm Quality Certification
permit review to rc-evaluate the steam.

SUBJECT: Review of a 401 Application by Portrait Homes, DWQ #001275,
Kimberly Glen Property, Mecklenburg County
You are requesting a letter of concurrence from the North Carolina Wildlife
Resources Commission (NCWRC) for the issuance of a 401 Certification. The NCWRC
has reviewed information provided by the applicant, and field biologists on our staff are
generally familiar with habitat values of the project area. These comments are provided
in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.)
and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-
667d).
Based on the information provided by the applicant, we do not object to the
project as proposed. We recommend that pre and post development runoff conditions
remain relatively equal so that any stream destabilization and flooding will be minimized
below the site. We also recommend that trees and shrubs be planted around any
detention facilities in order to lower water temperature elevations in the ecosystems and
to provide avian and terrestrial habitats as well as visual aesthetics. Biologists of the
NCWRC can provide planting specifications and schedules, if requested.
