HomeMy WebLinkAbout01b_NCS000250 Construction Program Overview 2019NORTH CAROLINA Department of Transportation Construction Program September 2019 Agenda • Permit Requirements • Program Accomplishments • Considerations for the Future 2 Program Objectives • Continue to control development activities disturbing one or more acres of land surface including activities by NCDOT contractors. • Require construction site operators to implement appropriate erosion and sediment control (ESC) practices. • Require site inspection and enforcement of control measures. • Establish requirements for construction site operators to control waste that may cause adverse impacts to water quality such as discarded building materials, concrete truck washout, chemicals, litter, and sanitary waste at the construction site. • Continue to implement ESC measures and reclamation plans on all borrow pit and waste site projects, including activities at Ferry Terminals associated with dredging activities and contractor owned or leased borrow pits associated with NCDOT projects in keeping with the ESC program delegated by North Carolina Sedimentation Control Commission. 3 Permit Requirements .. Maintain theme Implementation of NCDEQ DEMLR ESC Program delegated to NCDOT by delegation agreement Sedimentation Control Commission (SCC) in February, 1991... for NCDOT with NCDEQ DEMLR construction projects and implementation of the applicable requirements of ESC Program on an General Permit NCG010000 effectively meets the objectives above by annual basis. permitting and controlling development activities disturbing one or more acres of land surface and those activities less than one acre that are part of a larger common plan of development. This program is authorized under the Sediment Pollution Control Act of 1973 and Chapter 4 of Title 15A of NCAC. This program includes procedures for public input, sanctions to ensure compliance, requirements for construction site operators to implement appropriate E&SC practices, review of site plans which incorporates consideration of potential water quality impacts, and procedures for site inspection and enforcement of control measures. This program has been delegated to and implemented by NCDOT. Maintain compliance NCDOT shall incorporate the applicable requirements of NCG010000... into with the applicable its delegated ESC Program, pursuant to "NCDOT Applicable Requirements requirements of the from NPDES General Permit No. NCG010000 for Construction Activities and General Permit Guidance for Complying with Those Applicable Requirements" in the NCG010000. memorandum dated June 9, 2014 or as updated. Permit Requirements Implement ESC measures on NCDOT shall implement ESC measures on all non-commercial all non-commercial borrow pits/waste sites. Implement approved reclamation plans on all non- commercial borrow pits/waste sites. borrow pit and waste site projects. The measures utilized shall be in keeping with the ESC program established by the North Carolina Sedimentation Control Commission. NCDOT shall implement the approved reclamation plan on all non- commercial borrow pit/waste site projects. The reclamation measures utilized shall be in keeping with the reclamation program established by the North Carolina Mining and Energy Commission. Borrow Pit Discharge NCDOT in coordination with DEMLR will implement the Borrow Pit Management Program Discharge Management Program. This process will consist of the following tasks: • Implement appropriate management measures to treat borrow pit wastewater for given conditions. • Implement an inspection and maintenance program. • Maintain training material and instruct field personnel overseeing borrow pit operations. • Evaluate and implement appropriate new/innovative technologies. Construction Program Overview • NCDOT's Construction Program controls potential impacts to water quality from land disturbance at construction sites and from borrow pit and waste site activities. • NCDOT implements the ESC Program, which incorporates NCGO10000 requirements on construction projects. 6 Delegation Agreement • Allows NCDOT to review and approve ESC plans based on compliance with SPCA, water quality regulations, and permit conditions for each project. • Authorizes NCDOT to perform inspections for land disturbing activities associated with Highway construction. • Did not grant enforcement authority, so policies and procedures were developed to correct compliance issues with NCDOT construction projects. Delegation Annual Review Annual Reviews are presented at the Sedimentation Control Commission Meeting each year Daily Project Inspection • Project personnel inspects and monitors the construction of a project daily and records daily activities and rainfall amounts. • Responsible for NCG01 record keeping. • If a compliance issue develops, project personnel in conjunction with the contractor will address the issue and corrective actions are made. • If the corrections are deemed severe by the project engineer, then operations on the project are suspended until the compliance issue is rectified. 9 Monthly Project Inspections • There are 7 REU Field Operations offices, each covering 2 of the 14 highway divisions in the State. Each office has at least two engineers per office. • REU Field Operations staff performs monthly site reviews on all DOT land disturbing projects to determine if the ESC plans and permits are implemented accordingly, and that the necessary maintenance is occurring. • NCG01 documentation is reviewed and any deficiencies are identified. • Each project is evaluated on a scale of 1-10 for installation of measures, maintenance of measures, effectiveness of measures, plan implementation and overall project evaluation. • If the site review identifies a situation that is not being corrected, then an Immediate Corrective Action (ICA) notice can be issued. An overall score of 6 or less results in the issuance of an ICA report. 10 Immediate Corrective Action • Issued when project is out of compliance with SPCA/NCG01 • ICA alerts NCDOT Management of an issue that needs immediate attention. • Establishes corrective action timeframe • Notifies DEMLR and/or DW R of project status North Carolina Department of Transportation Roadside Environmental Unit Erosion & Sedimentation !
