Nationwide Permit (NWP) No. 12 in the above-referenced atter (Attachment A). The approximate
7.8-mile Long Creek Parallel Sewer Outfall project, located in northwest Mecklenburg County, was
originally permitted under NWP No. 12 by the U.S. Army rps of Engineers (USACE) on May 27,
1997 (Action 1D No. 199702392) (Attachment R). However, since the issuance of this permit, NWP
No. 12 has been reautbori7ed and modifications to the s wer alignment have boon made. An

The Long Creek Parallel Sewer Outtall will extend approximately 7.8 miles (41,220 linear feet) and
roughly parallels i,ong Creek from the existing pump station, located approximately 1,000 feet east
of the confluence of Long Crcck and the Catawba River, i''•,cast to Oakdale Itoad. Phase II of the
project extends from the existing pump station to Gum B arch and Phase I from Cum Branch to
just above Oakdale Road. The proiect vicinity and loc ion of the Long Creek Parallel Sewer
Outfall project are presented on Figures 1 and 2 (Attachment C), respectively. The proposed
improvements ofthis project include upsizing the existing outfall with a parallel outfall, The existing
outfall is comprised of approximately 17,830 linear feet ?lf) of 15-inch pipe and approximately
23,390 if of 21-inch pipe. The proposed outfall consists o` an estimated 6,540 if of 36-inch pipe,
28,860 If of 42-inch pipe, and 5,820 If of 48-inch pip. The northernmost terminus of the
approximate 1,000-foot horizontal realignment of 42-inch pipe is located approximately 650 feet
southwest of Mount Holly-Huntersville Road (NC: 27) (Fi I$urc 2 - Attachment Q. The proposed
sewer realignment accommodates changes requested by exi ing property owners along this portion
of the project corridor.
The project will require the acquisition of additional R/W, !paralleling the existing sewer R/W, in
order to accommodate the new outfall. Tltc existing sewer is situated within a 30-foot R/W.

Additional R/W, generally 15 feet in width, will be acqui d for the installation of the proposed
sewer. The outfall will be installed generally on the outer edge of the existing 30-foot R/W. A
temporary construction casement (TC:E) of approximately I feet wide and adjacent to the now or
existing R/W will be acquired to facilitate construction. '1'h proposed outfall within the new R/W
will closely parallel the existing sewer, being placed as close ' s possible to the existing sewer, within
15 feet center-to-center (12 to 13 feel edge-to-edge) wherev?r possible, and generally to the upland

including the two proposed realignment crossings, are depicted on Figures 3A, 3B, and 3C
(Attachment C). A typical plan view and profile of a pmje t stream crossing is depicted in Figures
4A and 413, respectively (Attachment Q. With the exception of the two stream crossings
necessitated by the 1,000-foot realignment, these stream ?rossings are dictated by the project's

(maximum). All stream crossings have been designed to be as close to perpendicular to the stream
as possible, and still provide unencumbered sanitary flows. Existing channel alignments will not
be impacted by the project. The existing outfall R/W has been severely eroded in a number of
locations by Long Creek floodwaters. These eroded areas 'ill be backftlled and stabilvcd as part
of the new outfall construction. The Nationwide Pentit previously issued in this matter
authorized temporary impacts to 4.76 acrd of wetlands. 11e majority of wetland impacts will

anticipated. The total impacts associated with the Long ;reek Parallel Sewer Oulfall, including
the 1,000-foot realignment, are 4.82 acres of waters of the I? J.S., including 0.33 acre and 4.49 acres
of stream and wetlands, respectively. I?

Regulatory Implications
The project design complies with the conditions of the Section 401 General Certification (GC) for
projects eligible for NWP No. 12, effective June 1, 2000. ritton concurrence from the Division of
Water Quality is not required. In accordance to with this Cif;, the edge of the construction corridor
shall not be installed parallel to and closer than 10 feet (3 peters) to a stream, except at crossings.
Utility lines shall not cross a stream channel at other th n a near-porpendieular direction (i.e.,
stream channel crossings shall not be at an angle of less th n 75 degrees or more than 105 degrees
to the stream bank). No-seam piping will be installed wit in the footprint of a stream channel or
within two feet of the stream batiks. Measures shall be ken to prevent livo or flesh concrete

Appropriate sediment and erosion control practices which equal or exceed those outlined in the
most recent version of the "North Carolina Sediment and Erosion Control Planning and Design
Manual" or the "North Carolina Surface Mining Manual" hichever is more appropriate shall be

and maintenance of such Best Management Practices in (order to assure compliance with the
appropriate turbidity water quality standard. All sediment Ind erosion control treasures placed in
wetlands or waters shall be removed and the natural grad restored within two months after the
Division of Land Resources has released the project. An ual species suitable for wet locations
shall be planted and established within jurisdictional wetlands for soil and erosion control.

meters) of streams. The construction corridor (includi? g access roads and stockpiling of
materials) will be limited to 40 feet (12.2 meters) in width i4 wetlands and across stream channels
and will be minimized to the maximum extent practicable.

Permanent, maintained access corridors in jurisdictional areas will be restricted to the minimum
width practicable and will not exceed 10 feet (3 mctcrs) i width except at manhole locations. A
10 feet (3 meters) by 10 feet (3 meters) perpendicular vehicle turnaround will be spaced at least
500 feet (152.4 meters) apart, An anti-seep collar shall b placed at the downstream (utility line
gradient) wetland boundary and every ISO feet (45.7 metet') up the gradient until the utility exits
the wetiand for buried utility lines. Permanent changes in I pre-construction elevation contours in
waters or wetlands or stream dimension, pattern or proftl will not be permitted and any excess
material will be removed to a high ground disposal area. Pri-construction wetland contours will be
restored in accordance with CMU's construction documents.

Possible sedimentation of the stream during and immediati'ly following the construction phase of
this project will be minimized by strict implementation of State-approved sediment and erosion
control plan. This plan will employ a network of sedimonl traps, check dams, and silt fencing to
control the export of sediment from the project site to atii...?.it undisturbed areas. All erosion and
sediment control devices will be inspected for compliance with the construction contract
documents during and after construction, as well as foliong any major storm event, to identify
any needed repair, maintenance, or redesign. Activities o the subject site involving impacts to
waters of the U.S. will be required to follow the General onditions of the Nationwide Permits
(Federal Register, Vol. 65, No. 47; March 9, 2000) a d State Consistency Conditions, as
applicable. All nationwide and regional Conditions for NW No. 12 will be met by CMU's design
and adhered to by CMU's contractors.
Please be advised that the Long Creek Parallel Sewer qutfall project is subject to the State
Environmental Policy Act (SEPA) as a major activity under the NCDENR's Departmental Rules for
implementation of the Act (T15A:O] C.0504). An Environmental Assessment (EA) was completed
by WOOLPERT in August 1991 and circulated pursuant o the requirements of the Act (State
Clearinghouse # 92-E4300-0201). The SEPA process con luded with the NCDENR Division of
Environmental Management's (DTM's) issuance of a Find' a of No Significant Impact (FONSI)
dated October 31, 1991 (Attachment D). In a letter dated Ma 9"000, the Division of Water Quality
stated that the proposed approximate 1,000 linear-foot hor ontal realignment of the Long Creek
Parallel Sewer Outfall project will not require a revised EA additional SEPA review (Attachment
E). An archaeological survey of the project area was comp eted in July 1992 by Coastal Carolina

wetlands, respectively. It is our understanding that this pro cot qualifies for Nationwide Permit No.
12. On behalf of CMU, we are hereby requesting written ?pproval from the USACE Wilmington
District to proceed with the above-described activities.

Quality (Division) regarding changes in the ng Creek Parallel Sewer project in
Mecklenburg County, neither a revised Env on mental Assessment (EA) nor an
additional SEPA review of the proposed ch ges are needed. It is our understanding,
from your letter to me dated March 29, 200 , that the proposed changes involve
alterations in the vertical profile/ increases i pipe sixes, and a modification in horizontal
aligno=t of approximately 1,000 linear fee . The realignment will require two
additional crossings of Long CTeCk, and ace, rding to follow-up information you
provided on April 17. 2000. will not affect cultural resources. Your March 29, 2000
letter also identified that all other project impacts will remain virtually dl t same as
identified In the October 31. 1991 EA prepated for the proposai.
Based on the above information, additional tcview of the project through the SEPA process
is not needed. However, I would like to em hasize that where the outfall impacts wetlands
and streams, the project must be in complia cc with conditions in the Division's 401 Water
Quality Certification for sewer lines (see at hed). If the project will not be in compliance
with these conditions, application must be ade to the Division's Wetlands/401 Unit for a

the National Register of Historic Places:

Secause no sites listed in or eligible for the National Register are present in the
project's area of potential effect, no additional archaeological investigations need
to be conducted and the project can proceed as Fined.
We would like to note that the study conducted d monstrates the potential major
Impacts to areas that could contain significant archaeological sites, While no sites
were discovered within the project corridor, the s bsurface tests documented the
widespread disturbance of floodplain soils associiiginal ed with pipeline construction
activities. The disturbances associated with the Long Creek sewer lines
clearly exceed the idealized construction limits depicted in Figure 6 of the report,
According to Ms. Lautzenhelser, the -profiles shov?J in Figure 7 depict construction-
related deposits of spoil and pipeline wench fill rat er than stress deposits. These
observations underscore problems of relying exclusively on engineering drawings
of projected construction limits to gauge potential impacts to archaeological
resources.
The above comments are made pursuant to Section 106 of the National Historic
Prq*servation Act of 1966 and the Advisory Coun I on Historic Preservation's
Regulations for Compliance with Section 106, cogified at 36 CFR Part 800.
