Dear Sirs:
You have our approval, in accordance with the attached conditions and those listed below, to fill 0.28 acres of
wetlands in Moore County for the purpose of lake maintenance as you described in your application received by the
Division of Water Quality on September 29, 2000. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide
Permit Number 39 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal
Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you
must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

Supplemental Information
17. Directions to Site: From Raleigh, US 1 South to Vass. Through light, right on
Vass/Carthage Road. Travel +/- 5 miles, tum left on Niagara/Carthage Road. Right on Hardy
Lane. Right on Country Club Boulevard. Left at stop sign. Right at end of rail fence. Office is in
the course maintenance area.
18. Nature of Activity: The project will involve the maintenance excavation of an existing
irrigation lake associated with the Country Club of Whispering Pines Golf Course. The lake was
originally created within the channel of a perennial tributary of Little River prior to permit
requirements. The stream currently flows through the lake and sediment has gradually
accumulated in the upstream pond area over the years through natural processes. The project
will involve the removal of these sediment accumulations and disposal of the dredged spoil on
adjacent highground.
(a) Project Impacts: The original lake size and maintenance area is approximately 0.633
acres. Of this area, approximately 0.282 acres of the accumulated sediments are vegetated with
volunteer wetland species. These wetlands consist of cypress (Taxodium distichum), red maple
(Acer rubrum), silver maple (Acer saccharinum), black willow (Salix nigra), button bush
(Cephalanthus occidentalis), tag alder (Alnus serrulata), soft-stem bulirush (Juncus effusus),
nutsedge (Cyperus sp.), smartweed (Polygonum sp.), tearthumb (polygonum sagittatum), water-
horehound (Lycopus virginicus L.), and cattail (Typha latifolia). The vegetation is to be removed
with the accumulated sediment by the maintenance excavation. In addition, the lake will be
expanded slightly. This will involve 0.079 acres of the upland area adjoining the lake (see Figure
3).
Uplands on the southeast side of the pond are presently vegetated with domestic grass species
and the area is manicured similar to the adjacent golf course fairways. On the northwest side, the
uplands are vegetated with mature loblolly pine (Pinus taeda), sweet gum (Liquidambar
styraciflua), red maple (Acerrubrum), white oak (Quercus albs), magnolia (Magnolia virginiana),
flowering dogwood (Comas florida), frost grape (Vitus labrusca), and common greenbrier (Smilax
rotundifolia). Soils on either side of the lake appear to have been filled previously by the original
lake construction.
In executing the project, the stream will be temporarily diverted to reduce the in-stream
sedimentation and to allowthe excavation to be conducted as dry as possible. Clean fill will be
utilized to divert the stream around the lake excavation. The stream diversion will require the
discharge of approximately 50 cubic yards of material into 0.0135 acres (590 square feet) of the
inlet and outlet of the lake to accomplish the stream diversion. Upon completion of the
maintenance excavation, the stream will be retumed to its original configuration.
Spoil from the excavation will be deposited on both sides of the lake. Approximately 5,600 cubic
yards of spoil material will be removed from the lake. Approximately 3,200 cubic yards will be
placed to the southeast side and 2,400 cubic yards to the northwest side. Spoil disposal will
encompass approximately 0.665 acres (0.297 acres on northwest side and 0.368 acres on the
southeast side.) The spoil will ultimately be shaped into a berm for visual screening. This berm
will be permanently stabilized with grass and shrubbery. Heavy equipment utilized in the project
activity will include bulldozer, backhoe and/or dragline.
(b) Alternatives Analysis: Natural sediment accumulation in. lakes is a natural process
and is well documented. Natural sediment accumulation in this particular lake has reduced the
water capacity by approximately half to three-quarters of the original design. This proposal to

restore the original function of the lake by re-establishing the pre-existing conditions is the logical
choice of the applicants and the most practicable alternative. The next expected maintenance
excavation would be in approximately 10 to 15 years.
A logical alternative considered was utilizing groundwater as an irrigation water source. Utilizing
groundwater sets up potential use conflicts, because groundwater resources are typically utilized
for the public drinking water supply. In addition, extracting irrigation water from groundwater wells
requires more energy expenditure than pumping water from a surface water source. Additionally,
additional wells would have to be sited and constructed at considerable expense to the applicant.
The "no action" alternative denies the applicant present and future use of existing infrastructure
and loss of the original construction investment.

17. Directions to Site: From Raleigh, US 1 South to Vass. Through light, right on
Vass/Carthage Road. Travel +/- 5 miles, turn left on Niagara/Carthage Road. Right on Hardy
Lane. Right on Country Club Boulevard. Left at stop sign. Right at end of rail fence. Office is in
the course maintenance area.
18. Nature of Activity: The project will involve the maintenance excavation of an existing
imgation lake associated with the Country Club of Whispering Pines Golf Course. The lake was
originally created within the channel of a perennial tributary of Little River prior to permit
requirements. The stream currently flows through the lake and sediment has gradually
accumulated in the upstream pond area over the years through natural processes. The project
will involve the removal of these sediment accumulations and disposal of the dredged spoil on
adjacent highground.
(a) Project Impacts: The original lake size and maintenance area is approximately 0.633
acres. Of this area, approximately 0.282 acres of the accumulated sediments are vegetated with
volunteer wetland species. These wetlands consist of cypress (Taxodium distichum), red maple
(Acer rubrum), silver maple (Acer saccharinum), black willow (Salix nigra), button bush
(Cephalanthus occidentalis), tag alder (Alnus serrulata), soft-stem bullrush (Juncus effusus),
nutsedge (Cyperus sp.), smartweed (Polygonum sp.), tearthumb (polygonum sagittatum), water-
horehound (Lycopus virginicus L.), and cattail (Typha latifolia). The vegetation is to be removed
with the accumulated sediment by the maintenance excavation. In addition, the lake will be
expanded slightly. This will involve 0.079 acres of the upland area adjoining the lake (see Figure
3).
Uplands on the southeast side of the pond are presently vegetated with domestic grass species
and the area is manicured similar to the adjacent golf course fairways. On the northwest side, the
uplands are vegetated with mature loblolly pine (Pious taeda), sweet gum (Liquidambar
styraciflua), red maple (Acerrubrum), white oak (Quercus alba), magnolia (Magnolia virginiana),
flowering dogwood (Comus florida), frost grape (Vitus labrusca), and common greenbrier (Smilax
rotundifolia). Soils on either side of the lake appear to have been filled previously by the original
lake construction.
In executing the project, the stream will be temporarily diverted to reduce the in-stream
sedimentation and to allow the excavation to be conducted as dry as possible. Clean fill will be
utilized to divert the stream around the lake excavation. The stream diversion will require the
discharge of approximately 50 cubic yards of material into 0.0135 acres (590 square feet) of the
inlet and outlet of the lake to accomplish the stream diversion. Upon completion of the
maintenance excavation, the stream will be returned to its original configuration.
Spoil from the excavation will be deposited on both sides of the lake. Approximately 5,600 cubic
yards of spoil material will be removed from the lake. Approximately 3,200 cubic yards will be
placed to the southeast side and 2,400 cubic yards to the northwest side. Spoil disposal will
encompass approximately 0.665 acres (0.297 acres on northwest side and 0.368 acres on the
southeast side.) The spoil will ultimately be shaped into a berm for visual screening. This bens
will be permanently stabilized with grass and shrubbery. Heavy equipment utilized in the project
activity will include bulldozer, backhoe and/or dragline.
(b) Alternatives Analysis: Natural sediment accumulation in. lakes is a natural process
and is well documented. Natural sediment accumulation in this particular lake has reduced the
water capacity by approximately half to three-quarters of the original design. This proposal to

restore the original function of the lake by re-establishing the pre-existing conditions is the logical
choice of the applicants and the most practicable alternative. The next expected maintenance
excavation would be in approximately 10 to 15 years.
A logical altemative considered was utilizing groundwater as an irrigation water source. Utilizing
groundwater sets up potential use conflicts, because groundwater resources are typically utilized
for the public drinking water supply. In addition, extracting irrigation water from groundwater wells
requires more energy expenditure than pumping water from a surface water source. Additionally,
additional wells would have to be sited and constructed at considerable expense to the applicant.
The "no action" alternative denies the applicant present and future use of existing infrastructure
and loss of the original construction investment.
