Dear Mr. Perry:
You have our approval, in accordance with the attached conditions and those listed below, to fill 0.1 acres of
wetlands in Dare County for the purpose of commercial construction as you described in your application received
by the Division of Water Quality on September 28, 2000. After reviewing your application, we have decided that
this fill is covered by General Water Quality Certification Number 3106. This certification allows you to use
Nationwide Permit Number 18 when the Corps of Engineers issues it. In addition, you should get any other federal,
state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Water shed regulations. This approval will expire
when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the property is sold, the
new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h) (6) and (7). For this approval to be valid, you
must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which
conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 276 1 1-7447. This certification and its conditions are final and binding unless you ask for a
hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If

Staff review of the plans and specifications has determined that
the project, as ,proposed, will comply with the Stormwater
Regul.rtions set forth in Title iSA NCAC 2H.1000. We are forwarding
Permit No. SW7990722 dated August 19, 1999 to Oceanfront
Enterprises, L.L.C.
This permit shall be effective from the date of issuance until
August: 19, 2009 and shall be subject to the conditions and
limitations a;; specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure
to establish an adequate system for operation and maintenance of
the stormwaater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this
permit are imaeceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request crust be in the form
of a written petition, conforming tv Chapter 150B of the North
Carolina GeneraI Statutes, and filed with the Offices of
Administrative Hearings, P.U. Drawer 274470 Raleigh, NC 27611-7447.
Unless such demands are made this permit shall be final and

certification in writing to the Director that the changes have

I1. SCHEDULE OF COMPLIANCE
1. The permittee will comply with the following schedule for
construc.i.on and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built-upon surfaces
except roads.

permitted facility, a certification must be received from an
;appropriate designer for, the system installed certifying that

this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the

Quality.
7. A copy :)f the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
!rears fr_?m the date of the completion of construction.
III. GENERAL 20NDITION'S
1. .,his permit is not transferable. In the event there is a
desire fir the facilities to change ownership, or there is a
name change of than Permittee, a formal permit request must be
:;ubmitte,l to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials as may be appropriate, The
approval of this request will be considered on its merits and
nay or may not be approved.
2. Failure -o abide by the conditions and limitations contained
i.n this permit may subject the Permittee to enforcement action
by the Civision of Water Quality, in accordance with North
Carolina General Statute 143-215.6(a) to 143-215.6(c).
3. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
